Synopsis of Previous Council action: 11/06/97 -- Council approved Ordinance No. 97-340 -- an ordinance of the City of San Bernardino repealing Chapter 3. 52 of the San Bernardino Municipal Code and adding Chapter 3 . 54 to the San Bernardino Municipal Code relating to Transient Lodging Tax. 11/17/97 -- Mayor Minor is authorized to submit a ballot argument in favor of the measure being submitted to the voters on February 3, 1998, related to continuance of the Transient Lodging Tax. Recommended motion: That the City Administrator and Finance Director be authorized to prepare an impartial fiscal analysis of the measure related to the Transient Lodging Tax. Description) Finance: Council Notes: 75-0262 Agenda Item No. . f Y STAFF REPORT Background On November 6, 1997, the Council voted to place on the February 3, 1998 ballot a measure related to whether or not an ordinance of the City of San Bernardino, repealing Chapter 3.52 and adding Chapter 3.54 to the San Bernardino Municipal Code, shall be approved so as to permit the City of San Bernardino to continue to collect and use Transient Lodging Tax. This action was prompted by Court action related to the City's existing Transient Occupancy Tax (TOT) ordinance. On November 6, the Council authorized Mayor Minor to submit a ballot argument in favor of the measure, which is known as Measure T. Impartial Fiscal Analysis San Bernardino Municipal Code Section 2.56.190 states: "Whenever any City measure qualifies for a place on the ballot, the Mayor and Common Council may direct designated officers of the City to prepare an impartial fiscal analysis of the measure showing the amount of any increase or decrease in revenue or cost to the City of San Bernardino. The fiscal analysis shall be printed preceding the arguments for and against the measure. If a City Attorney's analysis has been directed pursuant to Section 5011 of the Elections Code, the City Attorney's analysis and the fiscal analysis shall be separately set forth." Recommendation It is recommended that the City Administrator and Finance Director be authorized to prepare an impartial fiscal analysis of the measure related to the Transient Lodging Tax.
