Descration) Finance: Council Notes: Res 97- 35 Agenda Item No. c /,A/07 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT BACKGROUND In 1993, Police and Fire Management employees petitioned to form a bargaining unit separate from the San Bernardino Confidential and Management Association (SBCMA). The petition was turned down by the Mayor and Common Council. In October 1996, Police Safety management employees submitted a petition for recognition to form a bargaining unit separate from SBCMA. On March 3, 1997, the Mayor and Common Council approved a side letter to Resolution No. 89-129 for Police Safety Management employees on increased benefits effective July 1, 1997. September 16, 1997 - Fire Management employees requested to open negotiations for discussions on increased benefits. The initial proposal included an increased City contribution to PERS, a $500 annual uniform allowance, and educational incentives of $100/month. October 10, 1997 - The City Administrator held an informal meeting was held with Fire Management representatives and requested a proposal more in line with the rank and file. October 13. 1997 - Fire Management submitted a revised pr4Msal for an increased City contribution to PERS and furnishing uniforms. They dropped uniform allowance and educational incentives. Based on data obtained from cities surveyed by Ralph Andersen &Associates in the management compensation study, the City of San Bernardino's benefit practices for Fire Safety management employees are not consistent with the survey cities in certain benefits. Fire Safety management employees will remain as members of the San Bernardino Confidential and Management Association, and will not be petitioning to form a separate bargaining unit at this time. It is recommended that the City: • Increase the City contribution of the Fire Safety management employees' share of PERS, consistent with Fire rank and file (from 7% to 8% now, and from 8% to 9% as of 12/31/98); • Furnish and replace basic uniform items COST Cost is up to $9,200 for FY 1997-98 and $17,400 for FY 1998-99. I: RECOMMENDATION Adopt Resolution. Attachment: Resolution of the City of San Bernardino Approving A Side Letter to Resolution No. 89-129, Resolution Establishing Management and Confidential Compensation and Benefits Plan, Amending Section H, PERS, and adding Section V, Uniform Allowance, for Fire Safety Management employees, effective as of December 1, 1997, with Council approval. SIDE LETTER TO RESOLUTION NO. 89-129 FOR FIRE SAFETY MANAGEMENT EMPLOYEES This exhibit sets forth the Side Letter to Resolution No. 89-129, for full-time, regular, active Fire Safety Management employees. PERS (Add): Effective immediately, the City will contribute eight percent (8%) of the Fire Safety management employees' nine percent (9%) contribution to PERS credited to the employee's account as a fringe benefit. UNIFORM ALLOWANCE (New Section): The City shall furnish and replace as needed the following items: Four (4) work shirts; Three (3) pairs of work trousers; Safety boots or shoes. TWO-TIER RETIREMENT: The Fire Management employees agree to two-tier retirement as outlined in the Confidential and Management Unit agreement. REASONABLE SUSPICION DRUG AND ALCOHOL TESTING - The Fire Management employees agree to have Fire Management employees with drivers licenses of(1) Class "B" FX with "X" endorsement, (2) with Commercial Drivers licenses or (3) Class "C" drivers licenses will participate in reasonable suspicion drug and alcohol testing, as outlined in the Fire Safety Employees' MOU.
