CASE OVERVIEW

- This property is approximately a 552 square foot single-family residential structure located in
an area designated as RS, in the southern most downtown area of the City on an approximate
4,500 square foot lot.
- The owners obtained title to the property in March 7, 1996.
An inspection was conducted by the Fire Department, Police Department and Code Compliance
Division on June 12, 1997. The structure was posted with an "Immediate Order to Abate" by
the Fire Department. On July 15, 1997 a Notice of Hearing was mailed to property owner
regarding the following violations: Vacant Unsecured Structure; Unmaintained Landscaping;
Weeds, Dry Brush and Overgrown Vegetation; Trash, Debris and Litter; Dangerous Building -
Abandoned Unmaintained Structure; Structure requires Painting, Roof, Window or Door Repair;
and Infestation of Insects and Rodents. On August 7, 1997, the hearing was held with an
appearance by Jamie and Marie Jinesta having an interest in the property. The Board ordered
the property owners to maintain the property and incur the cost of $2,088.88.
The property owner filed an appeal on the basis that the incurred fees are unfair, therefore he
wishes all fees incurred be waived.

MAYOR AND COMMON COUNCIL MEETING OF NOVEMBER 17, 1997
BACKGROUND
06-12-97 An inspection was conducted by the Fire Department, Police Department and Code
Compliance Division and the following conditions were observed during the inspection:
vacant unsecured structure, unmaintained landscaping, weeds, dry brush, overgrown
vegetation, trash, debris, litter dangerous building-abandoned unmaintained structure,
structure requires painting, roof, window or door repair, and infestation of insects and
rodents. A board-up contractor was contacted and was instructed to secure the structure.
07-15-97 A Notice of Hearing was sent to property owner Esperanza Bravo Nolasco, 123 N.
Sierra Way, San Bernardino, CA 92402 and Jamie and Maria Jinesta, 12702 Salisbury
Street, Baldwin Park, CA 91706 by certified mail with a copy to all interested parties.
Signed return receipts were received.
08-07-97 A hearing was held with an appearance by Jamie and Marie Jinesta, the first trust deed
holder having an interest in the property. The Board accepted staff's recommendation
thus the action taken was correct and assessed the fees of $2,088.88 of abatement and
process costs.
08-18-97 Board of Building Commissioner's Order #4379 was mailed certified to property
owner(s) and posted on the property.
08-29-97 Received written appeal from property owner.

The appellant feels the incurred fees are unfair.

4 WHEREAS, pursuant to the San Bernardino Municipal Code, Title
5 15, Chapter 15 . 28, the Supervising Building Official has posted a
6 building(s) located at 123 N. Sierra Way, San Bernardino,
7 California, with a "Notice to Abate Nuisance" and has notified the
8 person (s) having an interest in said property that the said
9 building (s) or premises constitute a public nuisance;
10 WHEREAS, the Supervising Building Official ordered abatement
11 of said property to protect the health and safety of the
12 community;
13 WHEREAS, pursuant to San Bernardino Municipal Code, the
14 Supervising Building Official has served a "Notice of Hearing
15 Before the Board of Building Commissioners of the City of San
16 Bernardino" , relating to abatement of said nuisance, to all
17 person (s) having an interest in the above property, and has
18 prepared a declaration of mailing of the notice, a copy of which
19 is on file in these proceedings; and;
20 WHEREAS, a hearing was held to receive and consider all
21 relevant evidence, objections or protests on August 7, 1997, and;

NOW THEREFORE, IT IS ORDERED BY THE BOARD OF BUILDING
4 COMMISSIONERS OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1 . In reference to the property located 123 N. Sierra
6 way, San Bernardino California, based upon the evidence submitted,
7 the Board finds that the action to summarily abate the nuisance
8 was appropriate and that the violations noted in the Notice of
9 Hearing do in fact exist on the property, and that the property is
10 being maintained in violation of the San Bernardino Municipal
11 code, and therefore constitutes a nuisance .
12 SECTION 2 . The Board of Building Commissioners accepted

13 staff' s recommendations . The property owner (s) are hereby
14 directed to comply with the following requirements . Within ten
15 (10) days from the date of this order, the property owner shall
16 obtain required permits to rehabilitate or demolish the abandoned
17 unmaintained structure, to include obtaining an abestos report
18 prior to demolition . All required work must be completed within
19 thirty (30) days from the date of this order. All work completed
20 must be inspected and approved by the Inspection Services
21 Division. To prevent unauthorized entry, the property owner shall
22 keep all vacant structures boarded to FHA Board up stadards until
23 the property is either rehabilitated or demolished. Owner (s)
24 shall maintain the property free from weeds, dry brush, overgrown
25 vegetation, trash, debris or any items causing an unsightly
26 appearance . The property shall meet all applicable codes adopted
27 by the City of San Bernardino.
28 SECTION 3 . Upon the owner (s) of record failure to comply with

4 the order of the Board of Building Commissioners within the time
specified, the Code Compliance Division shall proceed to initiate
5 abatement action by obtaining an Inspection/Abatement warrant to
7 abate violations noted. If the owner fails to comply with the
8 Board' s order within the time specified, the City may initiate
9 action including demolition, removal of any unauthorized
construction, and the abate the nuisance.

11 SECTION 4 . It was determined that the City was required to
12 initiate abatement proceedings and incurred costs in the amount of
13 $2, 088 . 88 . These costs and any future additional abatements shall
14 be the personal obligation of the owner and if unpaid shall be
15 recorded as a special assessment on the county tax record.
SECTION 5 . Upon receipt of an application from the person

1 required to conform to the order and by agreement of such person
18 to comply with the order if allowed additional time, the
19 Supervising Building Official may grant an extension of time, not
20 to exceed an additional 120 days, within which to complete said
21 repair, rehabilitation or demolition, if the Supervising Building
22 Official determines that such an extension of time will not create
23 or perpetuate a situation imminently dangerous to life or
24 property. The Supervising Building Official' s authority to extend
25 time is limited to the physical repair, rehabilitation or
26 demolition of the premises and will not in any way affect or
extend the time to appeal the notice and order.

28 SECTION 6 . Any person aggrieved by this order, may appeal to
the Mayor and Common Council by filing a written statement with

the City Clerk. The statement must include the order number

appealed, the specific grounds of your appeal, and the relief or

action sought . The written appeal must be received within fifteen

Dear Mayor and Common Council:
My name is Mrs. Jeovanny L. Pacheco, daughter of Mr. & Mrs. Jaime Jinesta. I am translating
for my father. Mr. Jaime Jinesta is 74 years old and Spanish speaking.
On July 18, 1997 we received the first certified letter from your office, which requested a
hearing scheduled at 9:00 am. for Thursday, August 7, 1997. Attached was a Statement of
Costs, Direct Cost, Contractor Costs (40% Administrative Costs are unfair). (Previous costs
incurred with no figure amount showed). We received all this information after the fact the
work had been completed through the request of your office. Total Amount Due $2,088.88.
Respectfully! Why should we be charge for direct costs for each individual employee's position?
These employees are employed through The City of San Bemardino.
Mr. Jaime& Maria Jinesta currently lives at 12702 Salisbury Street, Baldwin Park, CA 91706
for the past 22 years. Mr. Jinesta is a tax paying citizen in your community and should be
treated fair just like most of everyone else at the hearing. Majority of owner(s)and vested
parties at the hearing were granted an extension 30 Days to One Year, with the same scenario as
Mr. Jinesta. We attended the hearing and tried to explain our position. After the hearing we
went down stairs to your basement to request for permits too rehabilitated the subject property;
the permits' request was denied because the property is not in Mr. Jinesta name. Mr Jinesta is
first trust deed holder of the above referenced property at this time.
We received on August 20, 1997 second certified letter. Informing us that we may appeal for an
extension of an additional 120 days, from the date of this notice August 18, 1997.

We would like to submit our appeal to the Mayor and Common Council, for the above property
for either the demolition, removal of any unauthorized construction, and the abate of said
nuisance or rehabilitated the subject property based on cost effectiveness. (not through your
office your costs are unfair).
Mr. Jinesta is retired and receives $400 a month from social security; due to financial hardship
he is unable to move as fast as you are requesting 30 days from the hearing Thursday, August 7,
1997.
We have contacted the City of San Bernardino Economic Development Agency(Bob Lemley&
Adam Eliason); to see if perhaps the city would be interested in purchasing our property for the
A.R.R. Program (Acquisition, Rehabilitation, & Resale Program). However, if the city does
decide to purchase our property for the A_R.R Program. We will be unable to sell the property
until after September 25, 1997, Which is when our foreclosure proceeding will be final.
Under Section (5): The Board of Building Commissioner of The City of San Bernardino, Order
No: 4379. We would appreciate if the Supervising Building Official, Mayor and Common
Council will consider our appeal for 120 days effect September 25, 1997 and grant him
necessary time to either dispose of the property with City of San Bernardino for the A.R.R.
Program or we will acquire the necessary fiords to hire a license contractor company to either
demolition or rehabilitate the subject property.
