- This property is a commercial parking lot located in the vicinity of Mt. View
between Highland Avenue and 21st Street.
The owners obtained title to the property approximately August 29, 1995.
On February 28, 1997 a title search revealed that the owners were Mr. and Mrs.
Bhasin. A Notice to Abate addressing the unmaintained landscaping, weeds, dry
brush and overgrown vegetation, trash, debris and inoperable/abandoned
vehicles/vehicle parts was sent by certified mail to the property owners. They
failed to comply with the notice sent to correct violations.
- The Board of Building Commissioners suspended the fees contingent the property
owner maintains the property free of violations.
- A second complaint was received and a Notice of Hearing was sent to the
property owners.
- The Board of Building Commissioners upheld the staff recommendations to
correct all violations.
- The property owner filed an appeal on the basis that the violations do not exist
and are invalid and inaccurate, therefore he wishes all fees incurred be waived.

MAYOR AND COMMON COUNCIL MEETING OF NOVEMBER 17, 1997
BACKGROUND
05-14-96 Complaint received regarding property being used as parking lot for trucks, etc.;
unmaintained landscaping, trash and debris, trash can never being taken in.
05-20-96 An inspection was conducted and found unmaintained landscaping, weeds, trash,
debris.
07-15-96 A Notice to Abate was mailed certified to the property owner Y. Pal Bhasin at
1255 Newman, Simi Valley, CA.
07-23-96 Received letter from the owner stating his manager would handle the violations.
08-12-96 A re-inspection was conducted with no compliance.
09-19-96 Mailed a Notice of Hearing to property owner by certified mail with a copy to
all interested parties.
09-19-96 Filed a Notice of Pendency with the County Recorder's Office.
10-08-96 Received letter from property manager S. K. Bhasin disagreeing with our Notice
of Hearing.
11-07-96 A hearing was held with Ron Myers appearing as a representative of the property
manager.
The Board accepted staff's recommendation and directed the owners to maintain
the landscaping; remove all weeds, dry brush, overgrown vegetation, trash, debris
or other items causing unsightly appearance; to obtain permits and install a fence
around the property. The fees were suspended contingent upon the property
owner maintaining the property for one year free of violation. Fees will be
automatically reinstated if any violations occur.
11-21-96 Board of Building Commissioner's Order #3840 mailed certified to property
owner(s) and posted on the property.
02-12-97 New complaint received regarding trash, debris and fence not repaired.
02-13-97 A re-inspection was conducted and found outside storage of personal property.
03-20-97 Mailed a Notice of Hearing to property owner by certified mail with a copy to
all interested parties.

04-03-97 A hearing was held with Dr. Bhasin appearing as the property manager.
The Board accepted staff's recommendation and directed the owners within 10
days to remove all outside storage and any other items causing an unsightly
appearance. A lien in the amount of $786.76 was approved.
04-15-97 Board of Building Commissioner's Order #4096 mailed certified to property
owner(s) and posted on the property.
As of this date there has not been any compliance with the instructions to clean
the property.
APPELLANT STATED GROUNDS OF APPEAL
The owner states that the violations have been addressed when requested.
APPELLANT'S ACTIONS SOUGHT FROM MAYOR AND COMMON COUNCIL
Asking that the incurred costs be waived.
STAFF RECOMMENDATION
That the Mayor and Common Council deny the appeal and uphold the Order of the Board of
Building Commissioners as described in Order Number 4096 dated April 3, 1997.

Dear Property Owner/Interest Holder:
THIS NOTICE is hereby served to you as owner or interest holder of the above referenced
property. An abatement hearing in regards to outstanding violations of the San Bernardino
Municipal Code located upon the above referenced property has been scheduled for
THURSDAY, APRIL 3, 1997 AT 9:00 A.M. before the Board of Building Commissioners,
at Economic Development Agency located at 201 North "E" Street, 2nd Floor, San
Bernardino, California. Evidence will be presented by staff at this hearing pertinent to the
outstanding violations and the costs of abatement incurred by the City. You may be, but need
not be, represented by legal counsel. You may present any relevant evidence or have witnesses
testify at this hearing to challenge the abatement.
OUTSTANDING L'1OLATIONS
On September 19, 1996 the property owner of record was notified that violations of the San
Bernardino Municipal Code exists on the property. The owner was requested to correct the
violations within a specified time period. On February 13, 1997 a subsequent inspection
revealed that the requested corrections were not completed. The outstanding violations are listed
in the attached Inspection Report.
Based on the property owner's failure to correct the violations, a "Notice of Pendency/ Notice
of Substandard or Dangerous Building" is being Filed with the County Recorder to give public
notice of the action taken by the City. A processing fee is automatically assessed at the time of
recordation.

This structure and/or use may be nonconforming. If the use of a nonconforming structure or
a nonconforming use is discontinued for a period of 12 or more consecutive calendar months,
the structure or use shall lose its legal nonconforming status, and shall be removed or altered
to conform to the provisions of the City's Development Code pursuant to Sections 19.62.020 and
19.62.030.
The direct costs incurred by the City for this abatement action are attached for your review. If
the abatement action and costs are upheld by the Board of Building Commissioners, the City will
place an assessment lien on the above referenced property for all costs incurred. To avoid the
placement of the lien, the incurred costs must be paid to the City Clerk's Office at 300 North
"D" Street, Second Floor, San Bernardino, California, 92418, within 15 days from the date
of the Board of Building Commissioners ruling.
If you disagree with the decision of the Board, you may appeal your case before the Mayor and
Common Council. Your appeal must be submitted in writing to the City Clerk within 15 days
of the Board's ruling. A fee of$75.00 must accompany your appeal. Your written appeal must
include the case number, property location, the specific items appealed and grounds therefore,
and the relief or action sought from the Mayor and Common Council.
By acting immediately to correct these violations prior to the hearing date, the imposition of
incurred costs, a lien, or further abatement actions by the City may be avoided.

4 WHEREAS, pursuant to the San Bernardino Municipal Code, Title
5 15, Chapter 15 .24 , the Supervising Building Official has posted a
6 building (s) located at Mountain View Avenue Parcel #146-013-08,
7 San Bernardino, California, with a "Notice to Abate Nuisance" and
8 has notified the person(s) having an interest in said property
9 that the said building (s) or premises constitute a public
10 nuisance;
11 WHEREAS, pursuant to San Bernardino Municipal Code, the
12 Supervising Building Official has served a "Notice of Hearing
13 Before the Board of Building Commissioners of the City of San
14 Bernardino" , relating to abatement proceeding, to all person (s)
15 having an interest in the above property, and has prepared a
16 declaration of mailing of the notice, a copy of which is on file
17 in these proceedings; and;
18 WHEREAS, a hearing was held to receive and consider all
19 relevant evidence, objections or protests on April 3 , 1997 , and;
20 WHEREAS, there was an appearance by Dr. Bhasine, having an
21 interest in the above property.

NOW THEREFORE, IT IS ORDERED BY THE BOARD OF BUILDING
4 COMMISSIONERS OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
5 SECTION 1 . Based upon the evidence submitted, it was found
6 and determined that the building(s) and or premises located at Mt.
7 View Avenue, Parcel #146-013-08, San Bernardino, California
8 constituted a public nuisance .
9 SECTION 2 . The Board of Building Commissioners accepted
10 staff' s recommendations . The property owner (s) are hereby
11 directed to comply with the following requirements . Within ten
12 (10) days from the date of this order, the owners) of record
13 shall remove trash and debris (outside storage area) and any other
14 item causing an unsightly appearance . The property shall meet all
15 applicable codes adopted by the City of San Bernardino.
16 SECTION 3 . Upon the owner (s) of record failure to comply with
17 the order of the Board of Building Commissioners, the Code
18 Compliance Division shall proceed to initiate abatement action by
19 obtaining an Inspection/Abatement warrant to abate violations
20 noted.
21 SECTION 4 . It was determined that the City was required to
22 initiate abatement proceedings and incurred costs in the amount of
23 $786 .76 . These costs and any future additional abatements shall
24 be the personal obligation of the owner and if unpaid shall be
25 recorded as a special assessment on the county tax record.

4 SECTION 5 . Upon receipt of an application from the person
5 required to conform to the order and by agreement of such person
6 to comply with the order if allowed additional time, the
7 Supervising Building Official may grant an extension of time, not
8 to exceed an additional 120 days, within which to complete said
9 repair, rehabilitation or demolition, if the Supervising Building
10 Official determines that such an extension of time will not create
11 or perpetuate a situation imminently dangerous to life or
12 property. The Supervising Building Official' s authority to extend
13 time is limited to the physical repair, rehabilitation or
14 demolition of the premises and will not in any way affect or
15 extend the time to appeal the notice and order.
16 SECTION 6 . Any person aggrieved by this order, may appeal to
17 the Mayor and Common Council by filing a written statement with
18 the City Clerk. The statement must include the order number
19 appealed, the specific grounds of your appeal , and the relief or
20 action sought . The written appeal must be received within fifteen
21 (15) days from the date of this notice dated April 15, 1997 .

I have just recieved your letter dated April 15, 1997 by my parents on
4/25/97 with the addressed to 1255 Newman St. , Simi Valley, CA 93065.
The order dated is recorded an April 14 , 1997, however I recieved this
order at my office on 4/25/97, which does not always give adequate time
to respond.
I am writing to Object to this order and the cost that the code
compliance officers has submitted. I would like to apply for an appeal
due to the fact that full compliance was performed at the location and
that the mentioned vehicles are personal property which are located on a
personal property lot. In addition the so called "trash" are material
for the sole purpose and use of the store located at 179 N. Highland Ave.
which includes washers, building and repair materils. The trash
requested to be cleared has been removed and the remaining materials are
for construction and or repair and thus there was compliance. When
communication was attempted with the code compliance division as to the
details of the violations there was never any response or written clarity
to my office at the above address. The area of concern does not pose any
harm to any persons of the city or pose a nuisance to the city and pose
any imminently dangerous to life or property. In addition, the code
compliance officers has stated that there is trash and debris, which when
it exists are removed within on to two weeks when the trash is picked up
by the city on a regular basis. Therefore, I will need relief and
attention by the Mayor and Common Council. In addition the complaints
are very misleading and do are not actual in all accounts.
