HomeMy WebLinkAbout2014-255 1 RESOLUTION NO. 2014-255 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING AMENDMENT NO. 2 TO A CONSULTANT 3 SERVICES AGREEMENT WITH WILLDAN FOR DESIGN OF A TRAFFIC SIGNAL 4 AT ROUTE 210 WESTBOUND WATERMAN AVENUE OFF-RAMP AT 30TH STREET (TC08-09). 5 WHEREAS, on April 19, 2010 the Mayor and Common Council adopted Resolution 6 No. 2010-076 approving a Consultant Services Agreement with Willdan for design of a traffic 7 signal at Route 210 westbound Waterman Avenue off-ramp at 30th Street (TC08-009), and 8 WHEREAS, on May 20, 2013, Resolution No. 2013-093 was adopted awarding a 9 10 construction contract to Siemens Industry, Inc. for installation of a traffic signal at the Route 11 210 westbound Waterman Avenue off-ramp at 30th Street (TC08-009); and 12 WHEREAS, on June 17, 2013, Resolution No. 2013-189 was adopted approving 13 Amendment No. 1 to Consultant Services Agreement with Willdan for design of a Traffic 14 Signal at Route 210 westbound Waterman Avenue off-ramp at 30th Street (TC08-09). 15 THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 16 SECTION 1. The City Manager is hereby authorized and directed to execute this 17 18 Amendment No. 2 to Consultant Services Agreement with Willdan on behalf of the City, said 19 Amendment being attached and incorporated herein as Exhibit"A". 20 SECTION 2. SAENZ, 23 City Attorney 24 By: t . _ 25 26 2014-255 EXHIBIT A AMENDMENT NO. 2 TO CONSULTANT SERVICES AGREEMENT WITH WILLDAN FOR DESIGN OF A TRAFFIC SIGNAL AT ROUTE 210 WESTBOUND WATERMAN AVENUE OFF-RAMP AT 30TH STREET (TC08-009) THIS AMENDMENT is made and entered into this 7th day of July 2014 ("Effective Date"), by and between the CITY OF SAN BERNARDINO, a charter city ("City"), and WILLDAN ("Consultant"). WITNESSETH : A. WHEREAS, on April 19, 2010 the Mayor and Common Council adopted Resolution No. 2010-076 approving a Consultant Services Agreement with Willdan for design of a traffic signal at Route 210 westbound Waterman Avenue off-ramp at 30th Street (TC08-009); and B. WHEREAS, on May 20, 2013, Resolution No. 2013-093 was adopted awarding a construction contract to Siemens Industry, Inc. for installation of the traffic signal at Route 210 westbound Waterman Avenue off-ramp at 30th Street(TC08-009); and C. WHEREAS, on June 17, 2013 Resolution No. 2013-189 was adopted approving Amendment No. 1 to Consultant Services Agreement with Willdan for design of a Traffic Signal at Route 210 westbound Waterman Avenue off-ramp at 30th Street (TC08-09); and D. WHEREAS, said Services Agreement with Consultant (as amended) expired on December 31, 2013; and E. WHEREAS, City wishes to extend said Services Agreement for Consultant's services to provide design support during construction; and NOW, THEREFORE, for and in consideration of the mutual covenants and conditions contained herein, the parties hereby agree as follows: 1. Section 4.1. "Term" of said Services Agreement is hereby amended to add the following: The term of said Consultant Services Agreement is hereby extended to August 31, 2014. 2.
