REQUEST: A request to amend Chapter 19.22, Section 19.22.030 and Table 022.01 of the San
Bernardino Municipal Code (Development Code) to permit secondary signage for retail tenants
larger than 15,000 square feet and for service stations and drive-thru fast food restaurants. This
amendment will affect parcels in all commercial land use districts except CR-3.
BACKGROUND: The applicant, Nix Check Cashing, has requested this amendment because
of their interest in being secondary tenants for the Pic 'N Save at 466 Orange Show Road. There
is a trend in retailing toward "co-branding", which involves, for example, the siting of fast food
outlets at service stations and banks in supermarkets.
Since the Planning Commission hearing on this project, a request has been made for secondary
signage for fast food outlets since the industry is also trending toward "co-branding". As a
result, development standards for fast food outlets have been added to this Development Code
Amendment.
KEY ISSUES: None
ENVIRONMENTAL DISCUSSION: Exempt per General Rule, CEQA Section 15061(b)(3)
PLANNING COMMISSION RECOMMENDATION: The Planning Commission voted 9 to
0 (Enciso, Gonzalez, Hamilton, Lockett, Quiel, Reilly, Schuiling, Suarez and Thrasher) to
recommend approval of Development Code Amendment No. 97-03 based upon the Findings of
Fact contained in the September 2, 1997 staff report (Exhibit 1).
RECOMMENDATION: Staff recommends that the Mayor and Common Council approve
Development Code Amendment No. 97-03 to amend Chapter 19.22, Section 19.22.030 and
Table 022.01 of the San Bernardino Municipal Code (Development Code) to permit secondary
signage for retail tenants larger than 15,000 square feet and for service stations and drive-thru
fast food restaurants, except those in the CR-3 land use district, based upon the Findings of Fact.

REQUEST - The project consists of a proposal to amend Chapter 19.22 of the San Bernardino
Municipal Code (Development Code) to permit secondary signage for tenants 15,000 square feet or
larger and service stations. This amendment will affect parcels within all commercial land use
districts except CR-3.
The applicant, Nix Check Cashing, has requested this amendment because of their interest in being
secondary tenants for the Pic 'N Save at 466 Orange Show Road. There is a trend in retailing toward
"co-branding", which involves for example, the siting of fast foot outlets at service stations and banks
in supermarkets.
PROJECT DESCRIPTION - The proposed changes include additional text under "Remarks" on Table
022.01 and two new definitions to be added to Section 19.22.030. The proposed text changes are
shown on Attachment "A". The following matrix describes the particulars of the amendment and is
followed by the new definitions to be added.

PROPOSED DEFINITIONS
Secondary Sign A sign identifying a business located within the tenant space of the primary business.
Primary Wall The wall on a commercial/industrial structure that contains the primary entrance to the
business.
FINDINGS AND ANALYSIS - This DCA is has been determined to be exempt from CEQA in
accordance with Section 15061(b)(3) which exempts those projects that will not have a significant
effect on the environment.
Development Code Amendment Findings
(1)The proposed amendment is consistent with the General Plan in that it is consistent with Goal 4D
which states:
"Maintain and enhance commercial regional cores and economically sound community-serving
commercial concentrations."
Because of the trend by major retailers toward "co-branding", permitting the use of secondary signage
will encourage businesses to co-locate together in an economically beneficial manner where it may not
have been viable before due to lack of signage.
This proposal is also consistent with Policy 4.16.3 which states:
"Set, and require adherence to, standards for retail buildings in order to create and maintain an
attractive image for each commercial corridor..."
This Code Amendment limits the number and size of signs to avoid clutter, and overzealous signage
that can create a negative image for the City. The secondary signs as permitted are subject to adopted
design guidelines already in place in the Development Code. Staff, in researching and reviewing this
proposal, has recommended a conservative method of allowing this type of signage by essentially
expanding the definition of informational signs for tenants 15,000 square feet or larger. Service
stations, another popular vehicle for co-branding, would be allowed secondary signage in addition to
the primary signage with the total area consistent with general commercial sign standards instead of
more restrictive service station standards.
(2)The proposed amendment would not be detrimental to the public interest, health, safety,
convenience, or welfare of the City in that signage in general is already permitted in the City. This
limited Code Amendment addresses a nationwide trend that is evident in many regional and
neighboring cities. This Development Code Amendment limits the number and location of secondary
signs and maintains the maximum total sign area. This DCA will not permit land uses where they

were not permitted before, but will allow similar, compatible uses to share tenants space when it is
appropriate.
CONCLUSION - The proposed amendment is consistent with the Development Code and General
Plan and is exempt from CEQA.
RECOMMENDATION - Staff proposes that the Planning Commission recommend that the Mayor
and Common Council approve Development Code Amendment No. 97-03 based on the Findings of
Fact.

SIGN REGULATIONS - 19.22
Portable Sign. A sign that is not permanently affixed to a structure or the ground.
Primary Sign. The largest sign located on the building front wall containing the main entrance.

Primary Wall. The wall on a non-residential structure that contains the primary entrance to the
business.
Promotional Sign. A sign erected on a temporary basis to promote the sale of new products,
new management, new hours of operation, a new service, or to promote a special sale.
Real Estate Sign. An on-site sign pertaining to the sale or lease of the premises.
Roof Sign. A sign erected, constructed, or placed upon or over a roof of a building, including
a mansard roof and which is wholly or partly supported by such buildings.
Secondary Sign. A sign identifying a business located within the tenant space of the primary
business.
Sign. Any structure, housing, device, figure, statuary, painting, display, message placard, or
other contrivance, or any part thereof, which is designed, constructed, created, engineered,
intended, or used to advertise, or to provide data or information in the nature of advertising, for
any of the following purposes: to designate, identify, or indicate the name of the business of
the owner or occupant of the premises upon which the advertising display is located; or, to
advertise the business conducted, services available or rendered, or the goods produced, sold,
or available for sale, upon the property where the advertising display is erected.
Sign. The entire face of a sign, including the surface and any framing, projections, or
molding, but not including the support structure. Individual channel-type letters mounted on a
building shall be measured by the area enclosed by four straight lines outlining each word.
Signs Program. A coordinated program of 1 or more signs for an individual building or building
complexes with multiple tenants.
Temporary Sign. A sign intended to be displayed for a limited period of time.
Trademark. A word or name which, with a distinctive type or letter style, is associated with
a business or business entity in the conduct of business. MC 834 5/19/92
Vehicle Sign. A sign which is attached to or painted on a vehicle which is parked on or adjacent
to any property, the principal purpose of which is to attract attention to a product sold or an
activity or business located on such property.
Wall Sign. A sign painted on or fastened to a wall and which does not project more than 12
inches from the building or structure.
Window Sign. Any sign that is applied or attached to a window or located in such a manner that
it can be seen from the exterior of the structure.

DESCRIPTION: Public hearing-Development Code Amendment#97-03-a request to amend Development Code Chapter
19.22, to permit secondary signage for specified commercial uses.
Applicant: Nix Check Cashing, 17019 Kingsview Ave, Carson, CA 90746. Request/Location: Signage for retail tenants
larger than 15,000 square feet and for service stations and drive-through fast food restaurants. The amendment will affect
parcels in all commercial land use districts except CR-3.
ORDINANCE: Ordinance amending Chapter 19.22, Section 19.22.030 and Section 19.22.160, Table 022.01 of the
Municipal Code (Development Code) to add new definitions for secondary signage and to add specific standards for the
above listed uses. FIRST READING
ACTION: That the hearing be closed; and that the ordinance which approves Development Code Amendment#97-03,be
laid over for final adoption based on findings of fact attached to the Staff Report dated October 16, 1997, from Michael
Hays, Director of Planning and Building Services.
