HomeMy WebLinkAbout2014-159 1 RESOLUTION NO. 2014-159 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE 3 CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AMENDMENT 4 NUMBER THREE TO THE AGREEMENT WITH WILLDAN ENGINEERING TO EXTEND THE TERM OF THE AGREEMENT FOR COMMUNITY DEVELOPMENT 5 PROFESSIONAL SERVICES THROUGH DECEMBER 30, 2014 AND AUTHORIZING AN INCREASE TO PURCHASE ORDER NO. 2201 IN THE AMOUNT OF $150,000. 6 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 8 9 SECTION 1. The City Manager is hereby authorized to execute Amendment Number 10 Three to the Agreement with Willdan Engineering, attached hereto as Exhibit "A" and 11 incorporated herein. 12 SECTION 2. The Director of Administrative services is hereby authorized to increase 13 Purchase Order No. 2201 in the amount of$150,000. 14 15 SECTION 3. Saenz, City Attorney 26 27 By: `i ..A-t` 28 2 2014-159 Exhibit"A" AMENDMENT NUMBER THREE TO SERVICES AGREEMENT WITH WILLDAN ENGINEERING THIS AMENDMENT NUMBER THREE TO SERVICES AGREEMENT WITH WILLDAN ENGINEERING ("Amendment") is made between Willdan Engineering ("Company") and the City of San Bernardino (the"City") on June 16, 2014. WHEREAS, the parties wish to amend the Services Agreement that was entered into on September 20, 2010 ("Agreement") to extend the term for one year and increase the total amount to cover the additional term for Community Development Professional Services; NOW THEREFORE, in consideration of the foregoing and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows: 1. This Amendment is made with respect to the following facts and purposes: a. On September 20, 2010, the City and Vendor entered into that certain agreement entitled "Agreement for Professional Plan Review Services" between the City of San Bernardino Community Development and Willdan Engineering" for$266,700. b. On April 7, 2014, The City and Vendor entered into that certain agreement entitled "Amendment Number One to the Services Agreement Between the City of San Bernardino and Willdan Engineering for Fire Life Safety Plan Review Services"which increased the total amount of the agreement by $10,000. c. On April 7, 2014, The City and Vendor entered into that certain agreement entitled "Amendment Number Two to Services Agreement with Willdan Engineering" to include Community Development Professional Services and to extend the term of the agreement to June 30, 2014. 2. Section 4.1 Term of the Agreement is hereby amended to include Community Development Professional Services from June 30, 2014 to December 30, 2014. 3. Section 2.1 Compensation of the Agreement is hereby amended to increase the total amount of the Agreement by $150,000. 4.
