Resolution of the Mayor and Common Council of the City of San Bernardino Approving the Use
of the City Seal on Plaques Installed on Properties to Recognize that Said Properties Are Part of
the City's Mills Act Program. (#2981)

Financial Impact:
There will be no impact to the General Fund, unless the City proposes to reimburse property
owners for the costs of the plaques, which will cost approximately$450-$500 per plaque.
Motion: Adopt the Resolution.
Synopsis of Previous Council Action:
None.
Background:
As part of the Mills Act program, the Historic Preservation Commission (HPC) has requested
that plaques be placed upon the properties that are included within the City's Mills Act Program.
A photo of the proposed plaque design is provided as Attachment A.
While the original concept was to have the plaques be optional, the HPC now recommends that
the plaques be mandatory. The property owner would purchase the plaque directly from the
manufacturer and install it on their property.
However, it should be noted that the cost of the plaques will range from approximately$450-
$500, depending on the type of metal used for the plaque. If the plaque is mandatory, then the
cost may be a burden for some property owners, as was evidenced by the waiver of the $200
Mills Act application fee. If the City were to reimburse the property owner for the cost of the
plaque, the funds would have to come from the General Fund. Therefore, the Council may want
to consider simply approving the attached Resolution allowing the City's seal to be used on the
plaques and keeping the plaques as an option, to be paid for by property owners who desire to be
recognized as owning a property within the Mills Act Program.
However, should the Mayor and Common Council desire to mandate the signs be installed on all
properties added to the Program from this date forward,per the HPC's recommendation, an
amendment to Resolution 2005-363 that includes this requirement will need to be brought to the
Council for adoption.

6 WHEREAS, The Mills Act is a state law designed to provide financial incentives for
7 property owners that restore and maintain historic residential and commercial properties; and
8
WHEREAS, on November 7, 2005, the Mayor and Common Council adopted
9
Resolution 2005-363 establishing the application process, review procedures and required
10 contract provisions for the implementation of the Mills Act Program; and _N

WHEREAS, San Bernardino Municipal Code §9.04.025 provides that the Mayor and o
13 Common Council may authorize the use of the City Seal for private use when it is determined 2

14 to be in the best interests of the City, and when it is determined that the public will not be
15 misled thereby.
