Background:
The California Office of Traffic Safety (OTS) is awarding grant funds for their Selective Traffic
Enforcement Program (STEP) grant, using best-practice strategies shown to reduce traffic
collisions and gain favorable media coverage. OTS funding is based on the federal fiscal year
beginning October 1, 2014. The grant application requesting overtime reimbursement will
become operational on October 1, 2014, and ends September 30, 2015. The grant application
was mailed in and had to be postmarked no later than January 31, 2014. The San Bernardino
Police Department has been awarded and has administered similar grants over many years.

In past years, the Office of Traffic Safety has awarded our agency grants under the titles of STEP
grant, Checkpoint grant, and the Avoid the 25 grant, which is a grant that we have participated in
but is managed by the Ontario Police Department. For the 2014/2015 federal fiscal year, these
grants are being combined and all activities will fall under one grant titled STEP grant rather
than funding and managing three(3) separate grants.
The police department will use STEP grant funds, if awarded, to reimburse overtime expended
strategies such as DUI/CDL checkpoints and DUI saturation patrols. This program will also
develop a "Hot Sheet" program to notify patrol and traffic officers to be on the lookout for
identified repeat DUI offenders with suspended or revoked licenses as a result of DUI
convictions. There will also be enforcement patrols focused on speed enforcement, seatbelt/child
restraint seat violations, distracted drivers, motorcycle safety and motorcycle DUI saturation
patrols, and traffic enforcement operations. Each of these traffic operations will be conducted in
an attempt to make the streets of San Bernardino safer for all pedestrians and motorists. The
STEP program will seek voluntary compliance of traffic laws by generating publicity throughout
the one-year grant period.
OTS will cover all costs associated with overtime for enforcement programs for the full 12-
month grant period. After conducting an evaluation of available resources and developing a
deployment strategy during this period, the police department has requested funding to conduct
15 DUUCDL checkpoints, 26 DUI saturation patrols, two warrant service operations, four
motorcycle safety DUI saturation patrols, 10 traffic enforcement operations, 10 distracted driving
enforcement operations, 10 motorcycle safety enforcement operations, eight night-time Click It
or Ticket enforcement operations, 10 speed enforcement operations, and four traffic safety
educational presentations impacting 50 community members. We are asking that approximately
10 officers be funded for each event, which puts that many more police officers on our streets,
increasing visibility of patrol cars in our neighborhoods.
"{ The police department is also requesting that OTS cover the costs of grant related phlebotomy
1 services, and other supplies to include: a robotic total station (surveying type equipment used for
diagram fatal traffic collision scenes), copier/printer/fax machine, three PAS (Preliminary
Alcohol Screening) devices and supplies, and two Lidar units (used to capture speed of vehicles).
We are requesting approximately$54,249.00 of funding to purchase equipment and services.
Overtime funding will include supervisor, detective, officer, and clerical positions for a total cost
of$668,208.53. Staffing varies depending on the enforcement detail being worked. There is no
matching fund requirement for this grant. See Exhibit "A" for goals and objectives and budget
sections of the grant application describing the agreement and allotted funds.
This item was sent to the Grant Ad Hoes Committee. The Chairman of the Grants Committee
forwarded this item to the full Council without a recommendation.

1. PROBLEM STATEMENT

The City of San Bernardino has been on a steady financial decline since 2010. Every year since a
then we have experienced more and more cuts in programs and personnel. Then in 2012,the City of a
San Bernardino filed for bankruptcy protection. Since that time our City has been struggling to
balance the budget, which has not been an easy feat in this very difficult financial climate. As a
result of this bankruptcy, staffing throughout the City of San Bernardino has been reduced
drastically. Many of these cuts in personnel have occurred within the San Bernardino Police a
Department. In December 2012,the police department staffed slightly over 300 sworn personnel. o
Today, late December 2013,the police department has only 245 sworn personnel. This is a cut of
approximately 18%of our sworn personnel. Unfortunately crime has not declined, which makes a
our police agency have to do more with less.
The San Bernardino Police Department Traffic Unit currently has 1 sergeant position, 1 detective w
position, 8 traffic/motor officer positions,2 community services officer II positions, 2 senior office
assistant positions, 1 administrative assistant position and 5 parking enforcement officer positions.
Our most senior traffic/motor officer left our agency mid-year in 2013 to lateral to another agency
and his position has been held vacant since that time. There are currently 2 additional traffic/motor w
officers in backgrounds with other agencies. Should these two experienced traffic officers leave, it a
is the department's intention to replace them; however, they will likely be replaced by officers
inexperienced in traffic, which means much of their first year will be spent in training. This is a
substantial decrease in personnel from what the traffic unit maintained in 2006, which was when the
unit was staffed the highest with a total of 17 sworn officer positions. Unfortunately, because our
patrol unit is so short staffed,as of January 2014 the traffic unit is expected to give up one
traffic/motor officer to work a patrol shift 4 days each week to handle regular calls for service to
augment patrol.

A
Even though our sworn staffing has taken a substantial cut, San Bernardino Police officers continue
to arrest impaired DUI drivers. In 2012 our officers made approximately 298 arrests for DUI while
in 2013 the number of DUI drivers arrested increased to approximately 310. Even though we do not
have a large amount of pro-active enforcement time, our traffic and patrol officers are committed to
taking impaired drivers off the streets.
As you can see by the statistics below,the number of fatal traffic collisions that occurred in the city
of San Bernardino increased last year by over 50%. Traffic personnel were tasked with
investigating almost all of these collisions. Although alcohol was confirmed to be a factor in only
three(3) of our fatal traffic collisions, nine (9) of the eighteen(18)fatal collisions in our jurisdiction c�
were or will be sent to the San Bernardino County District Attorney's Office for review and possible W
manslaughter flings due to negligence on the part of at least one of the involved parties. These N
investigations are time consuming and take the traffic officers off the street for a substantial amount Ln
of time, which decreases our proactive time to enforce traffic laws. N

The monies that our agency is awarded from the Office of Traffic Safety in the form of traffic grants N
ensures that our agency is able to put officers on the streets with the sole purpose of enforcing traffic c
laws and looking for impaired drivers. This helps to increase the awareness of our drivers and N
makes the streets safer for all that travel on and around the streets. _

2. PROPOSED SOLUTION
A. Strategies:
The San Bernardino Police Department will deploy officers during each grant event that are
knowledgeable in traffic enforcement. The department will only deploy those motivated to seek
out offenders in an attempt to make the streets safer for motorists as well as pedestrians. We

will research our department stats ahead of time in an attempt to deploy in the area that has the
higher number of collisions, injuries, and DUls.
The traffic detective will participate in these events as well and will work to ensure prosecution
on the violators, especially those arrested for DUI. We will ensure that most of the officers
working these events have the proper training so that he/she will easily detect and affect the
arrest of all of the impaired drivers that they locate on the streets.
We will schedule the events during times when there is likely to be more traffic related to the
particular event. DUI events will generally be scheduled on Friday or Saturday nights, as these 0

generally be scheduled for week days when traffic is heavier. u~i

We will use our department's Facebook and Twitter accounts to add to the advertisement of N
these events,which will notify the media and others immediately when an event is occurring as o
well as the results of the event. "!

B. Agency Qualifications:
c
The San Bernardino Police Department has been awarded many grants from OTS in years past 2
and has staffed and managed them as required each grant year. This will be the traffic sergeants 2
3"d consecutive year in this position, and she will be assigned as the department's grant CL
coordinator for the 2"consecutive year. Because she has had this responsibility in years past, a
she has a good understanding as to what the requirements are and has developed a great working
relationship with the OTS coordinator as well as the coordinators from the Avoid the 25 county
grant. As the grant manager, the traffic sergeant also works most grant events so that she can
oversee the work being done and assure that everything is being done in accordance with the a
rules of the grant. When the traffic sergeant is unable to work any events,she verifies that o
another responsible sergeant steps in to oversee the activity. The back-up sergeant attended the
Checkpoint management course provided in 2013 so he too has an understanding as to the a
requirements and laws regarding the checkpoint activities.
The fiscal portion of the grant is handled through a finance manager at the police department w
then reported through a fiscal representative from San Bernardino City Finance Department.
Each of these ladies is experienced with the OTS grants as well as many other grants that the
San Bernardino Police Department also manages.

The San Bernardino Police Explorer Unit,which is a group of volunteer youths assists in our Q
checkpoint activities as do many Citizen Patrol Volunteers. These volunteers have to
successfully complete a background check,which is done by the police department's Personnel
and Training Unit, prior to being appointed to their position. They are also closely supervised at
each of the grant activities by the supervisor on scene.

C. Program Sustainability:
This OTS traffic grant funds overtime and equipment expenses only. If funding is removed it
will have a catastrophic impact on our agency. There is no additional funding source for this
program at our law enforcement agency.

The supervisors working each grant event will be responsible for all supervisory paperwork and
assignments, such as briefing, use of force reports,pursuit reports, injury reports, citizen
complaints, etc. The supervisors will also be responsible to manage the officers and collect their
stats at the end of each shift. He/she will complete all reports necessary for grant reporting such as
the pre and post-press releases, which will be sent out to the media and OTS at the conclusion of
each event. In addition, the supervisor will be responsible to choose checkpoint locations, as
required by law and will monitor traffic through the checkpoints to verify that motorists are getting
through the checkpoint in a reasonable amount of time.

The detective/corporal assigned to work each grant event will patrol the streets looking for as
violations relevant to the event being worked and will also be present to assist with any additional N
paperwork needed for successful prosecution of each case. The detective will be responsible to ,r,
send all in-custody reports to the district attorney's office and will be responsible to handle any N
follow-up work as requested by the district attorney's office during his normal working hours,not

on grant funded overtime. N
Police officers working each grant event will patrol the streets looking for impaired drivers or other
traffic violators. They will be responsible to contact drivers, conduct investigations, and complete N N
all appropriate paperwork, whether that is as little as a citation, an arrest or investigation. Each o
officer will record his/her own stats and will report these stats to the supervisor working the event M
at the end of his/her shift. a

Community service officers, senior office assistants or other clerical staff working each grant event
will gather all stats at the event, such as number of arrests, arrestees' names and date of births,etc.
They will also be responsible to stat the citations issued and vehicle impound information as well d
as the number of vehicles screened at the checkpoints in the absence of volunteer staff. At the ar
saturation patrols, the civilian employee assigned to work will also do data entry of the CHP 180s E
into CLETS as well as our system. °

Our agency generally impounds between 15 and 3 a 0 vehicles at each of our grant funded events. -
One (1) non-sworn member of our staff will work each grant event, other than the AVOID
saturations (which will be handled as noted below). He/she will be responsible to stat the number x
of vehicle impounds and the reasons for the impound. In addition, he/she will be responsible for "'
doing all CLETS and other data entry required on each of the CHP 180s (vehicle impound report
forms).

Robotic Total Station-$29,000.00. This is a piece of surveying equipment used for diagraming.
The San Bernardino Police Department Traffic Unit utilizes this type of equipment when a
diagraming the scenes on all fatal and many near-fatal traffic collisions. In 2013, we investigated
and created such a detailed diagram on over 20 collisions scenes. A Total Station gives detailed x
and accurate information as to measurements,to include elevations in a collision scene. These 11?
diagrams are required for successful prosecution of Vehicular Manslaughter cases and murder
cases.
The price noted above includes the Robotic Station, which is estimated to be approximately Q
$18,500;the Robotic Accessory Kit($6,000); the Data Collection Software for Crash 'Lone, which
is required to transfer the information from the Robotic Station to the computer-($600); Installation
of the software and training for traffic personnel, who will be using the equipment ($1,500). This
is all necessary equipment for start-up in use of this Robotic Total Station.

Phlebotomist—to draw and collect blood samples from suspected DUI drivers on scene as
evidence in support of DUI convictions in a court of law. OTS funds will not be used for"testing"
of the evidence. We have already utilized the monies we were awarded in our current 2013-2014
STEP grant so we are asking to increase this funding in the 2014-2015 grant year.
Copier/Printer/Fax machine-to be housed in the traffic office at the San Bernardino Police
Department. This will be used by all traffic personnel to process DUI arrests, which have to be
printed, copied,and sent to the district attorney's office for review and prosecution. This will also
be used to process grant documents. The copy machine currently in the traffic office is a
approximately 6 years old. It is used almost continuously throughout the work week and has been
in need of repairs on a regular basis. Ln

and mouthpieces used with the device. This money will fund 3 PAS devices along with the Q
necessary accessories such as carrying cases, warranty, and mouth pieces. Each PAS device costs a

Lidar—I am requesting to purchase 2 Lidar units,which are a handheld device used to determine
the speed of a vehicle. By reducing the speed that motorists are travelling on our roadways we can a�
reduce the number of traffic collisions and more importantly the number of people seriously E
injured in these collisions. Studies show that collisions that occur at greater speeds more times v
than not result in more severe injuries when a collision occurs. As you can see by our department
stats above, speed is the#1 cause of collisions in our city. The cost of each Lidar unit is a
approximately $4,$00 plus tax and shipping. This price covers the Lidar unit, a high capacity
battery handle, desktop charger, soft storage bag, operator's manual,compact shipping container x
with foam for Lidar,and a 24-month warranty. In addition to the Lidar units we would like to w
purchase 2 holsters, which are needed to mount the Lidar unit onto our police motorcycles. These
holsters cost approximately$400 each. Our agency currently has 8 motorcycle officers enforcing E
traffic violations, to include speed, but we presently have only 3 Lidar units. o
