Funding is allowed for fire personnel costs, education expenses, and equipment. There will be no impact to the City's General Fund. It does not include non-encumbered reoccurring expenses or expenses incurred,but not yet processed. There is a need that an account number be established to recognize the expenditures and the grant revenue from this application. This will allow the Administration Services Department to process payments and charge back personnel costs to the agency/grant. Synopsis of Previous Council Action: 09/20/10 Resolution #2010-310 authorizing the Fire Department to apply for and administer the 2010 Environmental Enforcement and Training Grant application to be submitted to the California Environmental Protection Agency. 03/02/09 Resolution#2009-38 ratifying the submittal of a grant application to the California Environmental Protection Agency in the amount of$20,000 and 1 authorizing the Fire Department to administer the grant. Updated:2/26/2014 by Norma Camarena B Packet Pg. 122 S.J 2933 Background: In September 2013, the City of San Bernardino Fire Department was made aware of the availability of the 2013/2014 California Environmental Protection Agency (CAL/EPA) grant which is funded by the State of California. The CAL/EPA is charged with developing, implementing and enforcing the state's environmental protection laws that ensure clean air, clean water, clean soil, safe pesticides and waste recycling and reduction. CAL/EPA has been encouraging the creation and support of local and regional task forces dedicated to the deterrence, detection, investigation and prosecution of environmental violations. CAL/EPA established the Environmental Enforcement and Training Grant Program as authorized by Penal Code sections 14300 et seq. and Title 27, Section 10011 of the California Code of Regulations. The program provides financial assistance for environmental enforcement, investigation and training programs that enhance statewide enforcement of environmental laws. On January 27, 2014, CAL/EPA representative notified Fire staff that the City will receive a check in the amount of $40,000. The funding is to support the Hazardous Materials Investigation Unit in the amount of$10,000 for procurement of equipment for the enforcement of illegal dumping of hazardous materials and hazardous waste. In addition, $30,000 has been awarded for personnel costs and travel expenses as it relates to peace officer environmental training according to Penal Code Section 14300 and applicable regulations. Fire was scheduled for the February 25, 2014 Grants Ad Hoc Committee meeting to discuss the acceptance and administration of the 2013/2014 CAL/EPA grants; however, the Committee Chair has requested that the Fire Department place this item on the Council agenda. Fire is requesting that the Mayor and Council ratify the submittal of the grant applications and authorize the Fire Department to accept and administer the grants (Exhibit A and B). There is no cost-share or match requirement associated with the CAL/EPA grants. California Cade of Regulations, title 27, section 10011 et sect. contains the implementing regulations for the Environmental Enforcement Training Account Grant Program.
