Synopsis of Previous Council Action:
See the attached chronology for detail about the City-related measures, including Charter
amendments, sent to voters since 1955.
Background:
Over the past several months, members of the Common Council, the Mayor's office and the
public have asked for information about the process of putting a Charter amendment to the
public for vote. Recent changes in state law make this an ideal time to review the process.
Charter amendments require approval by voters, as per California Elections Code §9255. They
may be submitted to the voters at any established municipal election date, or at any established
date pursuant to Section 1200 (which provides for an election on the first Tuesday following the
first Monday of November of each numbered year), provided there are at least 88 days before the
election.
There are three ways to get a Charter amendment on a ballot. The first is for the Council to put it
on by its own motion; the second is for an elected or appointed Charter commission to put it on;
and the third is by petition of the voters. By far the easiest method is for the governing body to
vote to do it. The General Outline for Action Required and Deadlines for Charter Amendments,
attached, explains the process for the other two possibilities.
If the MCC chooses to place a Charter Amendment on the November 2014 ballot, the
Government Code §34458 requires two public hearings. To meet the 88-day-prior requirement,
the council would have to vote on the matter no later than its August 4, 2014 meeting, after
hearing the item at its July 21, 2014 meeting.

In reviewing Charter files,we did locate a letter, dated February 9, 1966, from the Secretary of State's
Office to Jack T. Felton, City Clerk, which provides a copy of Card Number 1 of the State's index relative v
to the City of San Bernardino. The Copy also includes a statutory record of charter amendments covering d
the period from the City's first incorporation in 1854 through 1963. A copy of that letter is available in the E
City Clerk's Office, as Attachment A of a folder called"Charter Chronology."

provided by the Secretary of State. More detailed information and support data is provided for each of those
charter amendments presented to the electorate since 1955.

California Elections Code 9255 — City or City and County Charter proposals submitted to a

(a) The following city or city and county charter proposals shall be submitted to the voters at i
any established municipal election date, or at any established election date pursuant to Section
1200 (which provides for an election on the first Tuesday following the first Monday of
November of each even numbered year), provided that there are at least 88 days' before the
election:

(1) A charter proposed by a charter commission, whether elected or appointed by a N
governing body. A charter commission may also submit a charter pursuant to w
Section 34455 of the Government Code, provided there at least 95 days before the Q
election. o
(2) An amendment or repeal of a charter proposed by the governing body of a city or Di
a city and county on its own motion.
(3) A recodification of the charter proposed by the governing body on its own E
motion, provided that the recodification does not, in any manner, substantially c
change the provisions of the charter.
(4) An amendment or repeal of a city charter proposed by a petition signed by 15 a

percent of the registered voters of the city. Q
(5) An amendment or repeal of a city and county charter proposed by a petition
signed by 10 percent of the registered voters of the city and county. v
