2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
3 BERNARDINO AUTHORIZING THE CITY MANAGER TO EXECUTE
AMENDMENT NUMBER ONE TO THE AGREEMENT WITH THE PATRONS OF
4 THE ROOSEVELT BOWL FOR THE PROVISION OF SUPPORT SERVICES FOR
MARKET NIGHT AT PERRIS HILL PARK EXTENDING THE TERM OF THE
5 AGREEMENT UNTIL APRIL 16,2016.
6 WHEREAS, the Mayor and Common Council did authorize the City Manager to
Execute an Agreement with the Patrons of the Roosevelt Bowl for the Provision of Support
Services for Market Night at Perris Hill Park in Resolution 2012-37; and,

WHEREAS, the term of said Agreement expires on April 16, 2014.

NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND COMMON
12 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

14 SECTION 1. That the City Manager is hereby authorized to execute on behalf of the
15 City an Amendment Number One to the Agreement between the City of San Bernardino and
16 the Patrons of the Roosevelt Bowl relative to support services for Market Night at Perris Hill
17 Park, a copy of which is attached hereto, marked Exhibit"A" and incorporated herein by
18 reference as fully as though set forth at length.
19 SECTION 2. That the authorization to execute the above referenced Amendment
20
Number One to the Agreement is rescinded if the parties to the Agreement fail to execute it
21
within sixty(60) days of the passage of this Resolution.

1 AMENDMENT NUMBER ONE TO AGREEMENT BETWEEN THE CITY OF SAN
2 BERNARDINO AND THE PATRONS OF THE ROOSEVELT BOWL
3 THIS AMENDMENT NUMBER ONE is made and entered into as of April 7
4 2014 by and between the CITY OF SAN BERNARDINO, a charter city ("CITY") and Patrons
5 of the Roosevelt Bowl, a 501(c)(3) non-profit organization ("Organization"). In consideration
6 of the mutual covenants and conditions set forth herein, the parties agree as follows:
1. This Amendment is made with respect to the following facts and purposes:

a. On March 5, 2012, the City and Organization entered into that certain
8
agreement entitled "Agreement between the City of San Bernardino and the
9
Patrons of the Roosevelt Bowl" ("Agreement") for support services related to
10
the Market Night Program at Perris Hill Park.
11
2. Section 2 Term is hereby amended to extend the expiration of the term of the
12
Agreement until April 16, 2016.
13 3. Except for the changes specifically set forth herein, all other terms and conditions of
14 the Agreement shall remain in full force and effect.
15 IN WITNESS THEREOF, the parties hereto have caused this Amendment Number One
16 to be executed by and through their respective authorized officers, as of the date first above
17 written.
