Good afternoon, honorablelcouncil members. My name is Eli Mashiach and I represent
Portfolio Properties and Management. We are the proud owner and developer of over 50
retail and life style centers which span across the U.S; and over the last 20 years, we have
filled our centers with quality national tenants varying in uses and sizes.
The drawing you see here, and in front of you, depicts our center located at the north east
corner of Highland and Palm, which falls under your jurisdiction. We are in the final
stages of the completion of this class "A"building, which was built with high grade
materials and fine finishes in cooperation and approval of San Bernardino's city staff. We
have been working for the past year in an effort to pre-lease the center to quality national,
or regional tenants, and given the present economic condition, we are faced with great
difficulty in attracting these tenants, as most of them are reluctant to come to this area.
At the present 7-11 is interested in becoming a rna1n tenant in our center, and has
already provided us with a letter of interest. Unfortunately, city ordinance 19.06.025 F-
Prohihibited Uses-prohibits convenience stores under 5,000 sq. ft. if located within one
mile radius of another convenience store. When speaking with city staff, I was provided
an explanation that originally,this ordinance came to limit the proliferation of
independently owned convenience liquor stores, which many times attract the wrong
crowd and create a burden to the city in one way, or another.
7-11 chain stores have gained the reputation and proven themselves nationally to be a
clean and responsible operation, which actually contributes to their immediate
community at all times. Anybody who has kids knows that when they are stuck without
milk for the morning cereal, or any type basic food, they can just run down to the corner
7-11 and get it.
If the true intent of the ordinance was limiting liquor store operators, I would suggest that
the language in this section be amended to limit stores which sell 35% or more in alcohol
in gross sales, as most liquor stores do. I would also suggest, alternatively, exenf U—A4b'oj it 6�

It is the policy of our company to build and keep grade "A" centers. Our intention is to
fully cooperate with the immediate community and neighborhood, and to eventually
contribute our best to the city. Even though our company welcomes any mom and pop
tenants into our centers, we believe that the true way to benefit our center, the immediate
community, and the city, is to draw quality national tenants. If the city ordinance stays as
it is and denies 7-11's operation in our center, I believe that it will be very hard for us to
draw this type tenants, and will create an unnecessary hardship for the owners. Once 7-11
is allowed, we will definitely be able to attract additional high grade tenants to benefit the
center and the city.
