The submittal of an application for a Selective Traffic Enforcement 9 10 Program ("STEP") Grant from the State of California Office of Traffic Safety ("OTS") in the 11 amount of$722,457.53, for the federal fiscal year October 1, 2014 to September 31, 2015, a 12 copy of which is attached and incorporated herein as Exhibit A, is hereby ratified. 13 SECTION 2. If awarded, the Police Department is hereby authorized to accept the 14 State of California Office of Traffic Safety STEP Grant in the amount of$722,457.53. 15 SECTION 3. The program may also concentrate on speed, distracted driving, seat belt enforcement, operations at intersections with disproportionate numbers of traffic crashes, and special enforcement operations encouraging motorcycle safety. These strategies are designed to earn media attention thus enhancing the overall deterrent effect. 1. PROBLEM STATEMENT The City of San Bernardino has been on a steady financial decline since 2010. Every year since then we have experienced more and more cuts in programs and personnel. Then in 2012, the City of San Bernardino filed for bankruptcy protection. Since that time our City has been struggling to balance the budget, which has not been an easy feat in this very difficult financial climate. As a result of this bankruptcy, staffing throughout the City of San Bernardino has been reduced drastically. Many of these cuts in personnel have occurred within the San Bernardino Police Department. In December 2012,the police department staffed slightly over 300 sworn personnel. Today, late December 2013, the police department has only 245 sworn personnel. This is a cut of approximately 18% of our sworn personnel. Unfortunately crime has not declined, which makes our police agency have to do more with less. The San Bernardino Police Department Traffic Unit currently has 1 sergeant position, 1 detective position, 8 traffic/motor officer positions, 2 community services officer II positions, 2 senior office assistant positions, 1 administrative assistant position and 5 parking enforcement officer positions_ Our most senior traffic/motor officer left our agency mid-year in 2013 to lateral to another agency and his position has been held vacant since that time. There are currently 2 additional traffic/motor officers in backgrounds with other agencies. Should these two experienced traffic officers leave, it is the department's intention to replace them; however, they will likely be replaced by officers inexperienced in traffic, which means much of their first year will be spent in training. This is a substantial decrease in personnel from what the traffic unit maintained in 2006, which was when the unit was staffed the highest with a total of 17 sworn officer positions. Unfortunately, because our patrol unit is so short staffed, as of January 2014 the traffic unit is expected to give up one traffic/motor officer to work a patrol shift 4 days each week to handle regular calls for service to augment patrol. 1 2014-49 STATE OF CALIFORNIA • OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (New 12/13) Even though our sworn staffing has taken a substantial cut, San Bernardino Police officers continue to arrest impaired DUI drivers. In 2012 our officers made approximately 298 arrests for DUI while in 2013 the number of DUI drivers arrested increased to approximately 310. Even though we do not have a large amount of pro-active enforcement time, our traffic and patrol officers are committed to taking impaired drivers off the streets. As you can see by the statistics below, the number of fatal traffic collisions that occurred in the city of San Bernardino increased last year by over 50%. Traffic personnel were tasked with investigating almost all of these collisions. Although alcohol was confirmed to be a factor in only three (3) of our fatal traffic collisions, nine (9) of the eighteen (18)fatal collisions in our jurisdiction were or will be sent to the San Bernardino County District Attorney's Office for review and possible manslaughter filings due to negligence on the part of at least one of the involved parties. These investigations are time consuming and take the traffic officers off the street for a substantial amount of time, which decreases our proactive time to enforce traffic laws. The monies that our agency is awarded from the Office of Traffic Safety in the form of traffic grants ensures that our agency is able to put officers on the streets with the sole purpose of enforcing traffic laws and looking for impaired drivers. This helps to increase the awareness of our drivers and makes the streets safer for all that travel on and around the streets. A. PROPOSED SOLUTION A. Strategies: The San Bernardino Police Department will deploy officers during each grant event that are knowledgeable in traffic enforcement. The department will only deploy those motivated to seek out offenders in an attempt to make the streets safer for motorists as well as pedestrians. We 2 2014-49 STATE OF CALIFORNIA • OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (New 12/13) will research our department stats ahead of time in an attempt to deploy in the area that has the higher number of collisions, injuries, and Dills. The traffic detective will participate in these events as well and will work to ensure prosecution on the violators, especially those arrested for DUI, We will ensure that most of the officers working these events have the proper training so that he/she will easily detect and affect the arrest of all of the impaired drivers that they locate on the streets. We will schedule the events during times when there is likely to be more traffic related to the particular event. DUI events will generally be scheduled on Friday or Saturday nights, as these are the nights we more commonly see impaired drivers while the traffic enforcement details will generally be scheduled for week days when traffic is heavier. We will use our department's Facebook and Twitter accounts to add to the advertisement of these events, which will notify the media and others immediately when an event is occurring as well as the results of the event. B. Agency Qualifications: The San Bernardino Police Department has been awarded many grants from OTS in years past and has staffed and managed them as required each grant year. This will be the traffic sergeants 3rd consecutive year in this position, and she will be assigned as the department's grant coordinator for the 2' consecutive year. Because she has had this responsibility in years past, she has a good understanding as to what the requirements are and has developed a great working relationship with the OTS coordinator as well as the coordinators from the Avoid the 25 county grant. As the grant manager, the traffic sergeant also works most grant events so that she can oversee the work being done and assure that everything is being done in accordance with the rules of the grant. When the traffic sergeant is unable to work any events, she verifies that another responsible sergeant steps in to oversee the activity. The back-up sergeant attended the Checkpoint management course provided in 2013 so he too has an understanding as to the requirements and laws regarding the checkpoint activities. The fiscal portion of the grant is handled through a finance manager at the police department then reported through a fiscal representative from San Bernardino City Finance Department. Each of these ladies is experienced with the OTS grants as well as many other grants that the San Bernardino Police Department also manages. The San Bernardino Police Explorer Unit, which is a group of volunteer youths assists in our checkpoint activities as do many Citizen Patrol Volunteers. These volunteers have to successfully complete a background check, which is done by the police department's Personnel and Training Unit, prior to being appointed to their position, They are also closely supervised at each of the grant activities by the supervisor on scene. 3 2014-49 STATE OF CALIFORNIA •OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (New 12/13) C. Program Sustainability: This OTS traffic grant funds overtime and equipment expenses only. If funding is removed it will have a catastrophic impact on our agency. There is no additional funding source for this program at our law enforcement agency. Note;presentations may include topics such as distracted driving, DUI, speed, seatbelts and child passenger safety. 6 2014-49 STATE OF CALIFORNIA • OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (New 12/13) 16)To participate in the National Distracted Driving Awareness Month in April. 17)To participate in the Statewide Click It or Ticket mobilization period in May. 18)To conduct 10 speed enforcement operations in identified areas of high bicycle and pedestrian traffic. 19)To establish a comprehensive continuing public education program to reduce bicycle and pedestrian collisions. 20)To collaborate with the county's Avoid Coalition by: participating in all planning/ scheduling meetings and MADD/Avoid DUI Seminars; providing your agency's schedule of operations that occur during any Avoid campaign; and reporting your agency's DUI arrests & DUI fatality information during any Avoid campaign. 4. METHOD OF PROCEDURE A. Phase I - Program Pryaration,Training and Implementation (1st Quarter of Grant Year) • The police department will develop operational plans to implement the "best practice" strategies outlined in the objectives section. • All training needed to implement the program should be conducted this quarter. • All grant related purchases needed to implement the program should be made this quarter. • In order to develop/maintain the "Hot Sheets," research will be conducted to identify the "worst of the worst" repeat DUI offenders with a suspended or revoked license as a result of DUI convictions. The Hot Sheets may include the driver's name, last known address, DOB, description, current license status, and the number of times suspended or revoked for DUI. Hot Sheets should be updated and distributed to traffic and patrol officers at least monthly. • Implementation of the STEP grant activities will be accomplished by deploying personnel at high collision locations. Media Requirements • Issue a press release announcing the kick-off of the grant by November 15. The kick-off press releases and media advisories, alerts, and materials must be emailed to the OTS Public Information Officer at pioC ots.ca.gov,and copied to your OTS Coordinator, for approval 14 days prior to the issuance date of the release. B. Phase 2 - Program Operations(Throughout Grant Year) • The police department will work to create media opportunities throughout the grant period to call attention to the innovative program strategies and outcomes. 7 2014-49 STATE OF CALIFORNIA • OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (New 12/13) Media Requirements • Send all grant-related activity press releases, media advisories, alerts and general public materials to the OTS Public Information Officer(PIO) at pio @ots.ca.gov,with a copy to your OTS Coordinator. a) If an OTS template-based press release is used, the OTS PIO and Coordinator should be copied when the release is distributed to the press. If an OTS template is not used, or is substantially changed, a draft press release should first be sent to the OTS PIO for approval. Optimum lead time would be 10-20 days prior to the release date to ensure adequate turn-around time. b) Press releases reporting the results of grant activities such as enforcement operations are exempt from the recommended advance approval process, but still should be copied to the OTS PIO and Coordinator when the release is distributed to the press. c) Activities such as warrant or probation sweeps and court stings that could be compromised by advanced publicity are exempt from pre-publicity, but are encouraged to offer embargoed media coverage and to report the results. • Use the following standard language in all press, media, and printed materials: Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration. • Email the OTS PIO at pio@,ots.ca.gov and copy your OTS Coordinator at least 30 days in advance,a short description of any significant grant-related traffic safety event or program so OTS has sufficient notice to arrange for attendance and/or participation in the event. • Submit a draft or rough-cut of all printed or recorded material (brochures, posters, scripts, artwork, trailer graphics, etc.) to the OTS PIO at pio @,ots.ca.gov and copy your OTS Coordinator for approval 14 days prior to the production or duplication. • Include the OTS Iogo, space permitting, on grant-funded print materials; consult your OTS Coordinator for specifics. C. Phase 3—Data Collection & Reporting(Throughout Grant Year) • Agencies are required to collect and report quarterly, appropriate data that supports the progress of goals and objectives. • Statistical data relating to the grant goals and objectives will be collected, analyzed, and incorporated in Quarterly Performance Reports (QPRs). QPRs for the quarter ending September 30 will include year-to-date comparisons of goals and objectives. They will include information concerning changes made by the Grant Director in planning and guiding the grant efforts. • Reports shall be completed and submitted in accordance with OTS requirements as specified in the Grant Program Manual. 5. METHOD OF EVALUATION Using the data compiled during the grant, the Grant Director will prepare the Executive Summary to accompany the final QPR. The Executive Summary will: (1) briefly state the original problem; (2) specify the most significant goals and objectives; (3) highlight the most significant activities that contributed to the success of the program and the strategies used to accomplish the goals and objectives; and (4) describe the program's accomplishments as they relate to the goals and objectives. 6. He/she will complete all reports necessary for grant reporting such as the pre and post-press releases, which will be sent out to the media and OTS at the conclusion of each event, In addition, the supervisor will be responsible to choose checkpoint locations, as required by law and will monitor traffic through the checkpoints to verify that motorists are getting through the checkpoint in a reasonable amount of time. The detective/corporal assigned to work each grant event will patrol the streets looking for violations relevant to the event being worked and will also be present to assist with any additional paperwork needed for successful prosecution of each case. The detective will be responsible to send all in-custody reports to the district attorney's office and will be responsible to handle any follow-up work as requested by the district attorney's office during his normal working hours,not on grant funded overtime. Police officers working each grant event will patrol the streets looking for impaired drivers or other traffic violators. They will be responsible to contact drivers, conduct investigations, and complete all appropriate paperwork, whether that is as little as a citation, an arrest or investigation. Each officer will record his/her own stats and will report these stats to the supervisor working the event at the end of his/her shift. Community service officers, senior office assistants or other clerical staff working each grant event will gather all stats at the event, such as number of arrests, arrestees' names and date of births, etc. They will also be responsible to stat the citations issued and vehicle impound information as well as the number of vehicles screened at the checkpoints in the absence of volunteer staff At the saturation patrols, the civilian employee assigned to work will also do data entry of the CHP 180s into CLETS as well as our system. Our agency generally impounds between 15 and 30 vehicles at each of our grant funded events. One (1) non-sworn member of our staff will work each grant event, other than the AVOID saturations (which will be handled as noted below). He/she will be responsible to stat the number of vehicle impounds and the reasons for the impound. In addition, he/she will be responsible for doing all CLETS and other data entry required on each of the CHP 180s (vehicle impound report forms). They will be responsible for making the arrest when an impaired driver is located and will complete all preliminary DMV paperwork and arrest reports,required for successful prosecution of the impaired driver. Warrant Service Operation = One (1) sergeant x 9-hours @ $87 = $783 plus four(4) officers x 8-hours each @ $70=$2,240 for a total of$3,023 per event x 2 events= $6,046. Warrant Service operations will be comprised of one (1) sergeant and four(4) officers working an 8-hour shift. This will allow for the sergeant to be with the officers at each location in which a warrant is being served to supervise the activity and address any problems or complaints brought forward at each location. The request for funding in the category of Traffic Safety Educational Presentations will be used to fund 2 officers, each on a 5 hour shift, giving presentations on impaired driving at a minimum of 4 community type events. We have been asked to participate in an event at Cal State San Bernardino 12 2014-49 STATE OF CALIFORNIA • OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (New 12/13) several years in a row known as the Delta Sigma Chi Against Drunk Driving. This would be the type of event we would fund with this money. We are also asked to speak on impaired driving at the Citizen Police Academy and at several schools within our jurisdiction. Speed Enforcement Operation=Two (2) sergeants x 9-hours each @ $87 = $1,566.00 plus one (1) detective/corporal x 8-hours @ $76 = $608 plus nine (9) officers @ 8-hours each at$70 =5,040 plus one (1) community service officer II x 8-hours @$33 =$256 for a total of$7,470 per event x 10 events =$74,700. 2. TRAVEL EXPENSE In State—Costs are included for appropriate staff to attend conferences and training events supporting the grant goals and objectives and/or traffic safety. Local mileage for grant activities and meetings is included. Anticipated travel may include the Vehicular Homicide Seminar,and OTS Leadership and Training Seminar, All conferences, seminars or training not specifically identified in the Schedule B-I (Budget Narrative) will be approved by OTS prior to the event. All travel claimed will be at the agency approved rate, Per Diem will not be claimed for meals provided at conferences when registration fees are paid with OTS grant funds. 3. CONTRACTUAL SERVICES None 4. EQUIPMENT($5,000 OR MORE PER UNIT) Robotic Total Station - $29,000.00. This is a piece of surveying equipment used for diagraming. The San Bernardino Police Department Traffic Unit utilizes this type of equipment when diagraming the scenes on all fatal and many near-fatal traffic collisions. In 2013, we investigated and created such a detailed diagram on over 20 collisions scenes. A Total Station gives detailed and accurate information as to measurements, to include elevations in a collision scene. These diagrams are required for successful prosecution of Vehicular Manslaughter cases and murder cases. The price noted above includes the Robotic Station, which is estimated to be approximately $18,500; the Robotic Accessory Kit ($6,000); the Data Collection Software for Crash Zone, which is required to transfer the information from the Robotic Station to the computer($600); Installation of the software and training for traffic personnel, who will be using the equipment ($1,500). This is all necessary equipment for start-up in use of this Robotic Total Station. 13 2014-49 STATE OF CALIFORNIA • OFFICE OF TRAFFIC SAFETY OTS-136a Grant Application-Selective Traffic Enforcement Program(STEP) (New 12/13) 5. OTHER DIRECT COSTS Phlebotomist—to draw and collect blood samples from suspected DUI drivers on scene as evidence in support of DUI convictions in a court of law. OTS funds will not be used for"testing" of the evidence. We have already utilized the monies we were awarded in our current 2013-2014 STEP grant so we are asking to increase this funding in the 2014-2015 grant year. Copier/Printer/Fax machine- to be housed in the traffic office at the San Bernardino Police Department. This will be used by all traffic personnel to process DUI arrests, which have to be printed, copied,and sent to the district attorney's office for review and prosecution. This will also be used to process grant documents. The copy machine currently in the traffic office is approximately 6 years old. It is used almost continuously throughout the work week and has been in need of repairs on a regular basis. Office Supplies Used for standard office supplies to support grant related activities, grant monitoring and reporting. Costs may include paper, toner, ink cartridges, CDs/DVDs and desk top supplies such as pens, pencils, binders, folders, flip charts, easels and clips. PAS (Preliminary Alcohol Screening) devices and supplies—To be used in the field to detect impaired drivers. These will be used at all grant funded DUI/CDL checkpoints, and saturation patrols. Along with the PAS devices, we will purchase gas necessary for calibrating the devices and mouthpieces used with the device. This money will fund 3 PAS devices along with the necessary accessories such as carrying cases, warranty, and mouth pieces. Each PAS device costs approximately $425 each. Lidar— I am requesting to purchase 2 Lidar units, which are a handheld device used to determine the speed of a vehicle. By reducing the speed that motorists are travelling on our roadways we can reduce the number of traffic collisions and more importantly the number of people seriously injured in these collisions. Studies show that collisions that occur at greater speeds more times than not result in more severe injuries when a collision occurs, As you can see by our department stats above, speed is the#I cause of collisions in our city. The cost of each Lidar unit is approximately $4,800 plus tax and shipping. This price covers the Lidar unit, a high capacity battery handle, desktop charger, soft storage bag, operator's manual, compact shipping container with foam for Lidar, and a 24-month warranty. In addition to the Lidar units we would like to purchase 2 holsters, which are needed to mount the Lidar unit onto our police motorcycles. These holsters cost approximately$400 each. Our agency currently has 8 motorcycle officers enforcing traffic violations, to include speed, but we presently have only 3 Lidar units. 6.
