That Plan No. 12707 showing the proposed street vacation of a portion of Irwin Street south of Rialto Avenue, west of Waterman Avenue, be approved. Description: N/A Finance: Council Notes: Agenda Item No. I CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Authorization to Proceed and Approval of Plan No. 12707 —Proposed street vacation of a portion of Irwin Street south of Rialto Avenue, west of Waterman Avenue (New Burbank 1I Elementary School). BACKGROUND: On October 12, 2009, an application was received from the San Bernardino City Unified School District(SBCUSD), requesting the vacation of Irwin Street south of Rialto Avenue, west of Waterman Avenue. Irwin Street was dedicated as public right-of-way on The Map of the Hearsh Subdivision, thus the City does not own any portion in fee. SBCUSD owns or has an Order of Possession on all the parcels directly adjacent to the east and west of this portion of Irwin Street and is planning to construct the new Burbank I1 Elementary School where the street currently exists. Victory Outreach owns several parcels adjacent to the southerly terminus of Irwin Street, however they have indicated they have no conflict with the proposed vacation and are currently in the process of combining all their properties,therefore no parcels will be land locked. The street is not-used as access to any of the adjacent properties to the south and since SBCUSD plans to construct the new proposed elementary school over Irwin Street,there is no apparent future need for this street as public right-of-way. Staff has informed SBCUSD that the City does not determine the underlying ownership of the area proposed to be vacated nor does it guarantee title to any property involved and they should consult a title company to determine the owner of the area to be vacated. If authorization to proceed is given, all City departments, utility companies and affected property owners will be notified to determine if any conflicts exist. The findings will need to be made by the City Engineer that the proposed vacation of this portion of Irwin Street south of Rialto Avenue, west of Waterman Avenue is no longer needed for public right-of-way. A map depicting the general vicinity and Plan No. 12707 showing the details of the proposed vacation are attached. FINANCIAL IMPACT: There is no financial impact associated with this action. The petitioner has paid the first half of the processing fee of$1,000. Once the investigative proceedings are complete, the second half of the processing fee of$1,000 will be paid. RECOMMENDATION: Staff recommends that authorization to proceed with the proposed vacation be given and that Plan No. 12707 be approved.
