Recommended Motion:
I. That the City Engineer and the City Clerk be authorized to proceed with the proposed street
vacation of portions of 7th Street and Vine Street between Mountain View Avenue and Sierra
Way.
AND
2. That Plan No. 12705 showing the proposed street vacation of portions of 7th Street and Vine
Street between Mountain View Avenue and Sierra Way, be approved.

STAFF REPORT
SUBJECT:
Authorization to Proceed and Approval of Plan No. 12705 —Proposed street vacation of portions
of 7th Street and Vine Street between Mountain View Avenue and Sierra Way (New Lincoln II
Elementary School).
BACKGROUND:
On September 8, 2008, an application was received from the San Bernardino City Unified
School District(SBCUSD), requesting the vacation of 7th Street and Vine Street between
Mountain View Avenue and Sierra Way. This portion of 7th Street was dedicated as public
right-of-way on the Plan of the City of San Bernardino, thus the City does not own any portion in
fee. Vine Street(formerly Barton Street) was dedicated by separate documents from each of the
adjacent owners, and as determined in a title report from First American Title Company, Vine
Street is owned in fee by SBCUSD.
SBCUSD owns all the parcels directly adjacent to these portions of 7th Street and Vine Street,
and is planning to construct the new Lincoln II Elementary School where the streets currently
exist, and there will be no apparent future need for these streets as public right-of-way.
If authorization to proceed is given, all City departments, utility companies and affected property
owners will be notified to determine if any conflicts exist. The findings will need to be made by
the City Engineer that the proposed vacation of this portion of 7th Street and Vine Street between
Mountain View Avenue and Sierra Way are no longer needed for public right-of-way. A map
depicting the general vicinity and Plan No. 12705 showing the details of the proposed vacation
are attached.
FINANCIAL IMPACT:
There is no financial impact associated with this action. The petitioner has paid the first half of the
processing fee of$1,000. Once the investigative proceedings are complete, the second half of
the processing fee of$1,000 will be paid.
RECOMMENDATION:
Staff recommends that authorization to proceed with the proposed vacation be given and that
Plan No. 12705 be approved.

payable after the investigativc proceedings arc complete and prior to the commencement of the legal
proceedings 1 further understand that itaid fees are NOT payment for any real property or
improvements thereon, but for the costs of the vacation proceedings ONLY and that the City of San
Bernardino does NOT determine underlying ownership of the area to be vacated nor doer it guarantee
title to any property involved and I have been advised to consult a title company to determine such
ownership.
1 understand that at the conclusion of the investigative proceedings, the City will notify me of its
findings including and conflicts with City facilities now IOearcd in the area proposed to be vacated, or the
request by any utility company for the reservation of any existing casements and that such conflicts or
resurva.tions may affect the intended use of the proposed area, once vacated, and that I may elect to terminate or
continue the proceedings. If 1 elect to continue, the remaining unpaid fees shall he paid by me prior to the
continuance of said proceedings.
