PARK RULES AND REGULATIONS Revised: 10/15/07 PACIFIC PALMS MOBILEHOME PARK Following are the Rules and Regulations of PACIFIC PALMS MOBILEHOME PARK. These Rules and Regulations are implemented pursuant to California Civil Code Section 798.25 and are applicable to all Residents, upon proper notice, on the effective date noted above, whether or not they are signed. Management reserves the right to supplement and amend these Rules as allowed by law. Although Management will take reasonable steps to enforce these Rules in a reasonable fashion from and after their effective date, the manner and method of enforcement lies solely within the discretion of Management, and there is no guarantee that these Rules will always be enforced to the exact satisfaction of any particular Resident. Since Management personnel and resources are limited, Residents should notify Management, in writing, of any Rules violation which Residents believe to require the attention of Management. 1. WORD USAGE: A. ANNUAL RECERTIFICATION: Any reference to Annual Recertification refers to an Annual Recertification of Tenant Eligibility form. The Annual Recertification of Tenant Eligibility form is available in the Park office. B. CERTIFICATION: Any reference to Certification refers to a Certification of Tenant Eligibility form. The Certification of Tenant Eligibility form is available in the Park office. C. GUESTS: Any reference to a Guest refers to a person who is present in the park at the invitation of Resident,but who has not signed a Rental Agreement nor have any other rights of tenancy. D. HIS,HER: Any reference to"his"or"her" is intended to include the other and is not limited to any particular gender. E. HOME, MOBILEHOME: Any reference to home or mobilehome refers to the Resident's mobilehome per the Rental Agreement or Lease. F. LOT, HOMESITE: Any reference to Lot or Homesite refers to the area upon which the Resident's mobilehome rests,which area is described by a specific number in the Rental Agreement. G. MANAGEMENT: Any reference to Management refers to the owners and operators of the Park, including the Resident Manager. H. MANAGER: Any reference to the Manager refers to the Resident Manager. I. PARK, COMMUNITY: Any reference to Park or Community refers to Pacific Palms Mobilehome Park. J. PROSPECTIVE RESIDENT, HOMEOWNER and RESIDENT: A Prospective Resident has no right to occupy any mobilehome or homesite in this Park until he or she has completed a current written application, and been approved in writing for tenancy by an authorized management representative. A Homeowner is a person who has a tenancy in the Park under a Rental Agreement or Lease. Resident refers to a Homeowner or other person who lawfully occupies the mobilehome which is subject to the Rental Agreement or Lease. K. RENTAL AGREEMENT: Any reference to "Rental Agreement" refers to the lease or rental agreement between Park and Resident.. 2. COMPLIANCE WITH LAWS: Residents shall comply with all laws, statutes, ordinances, rules and regulations of federal, state or municipal governments or authorities. Management will promptly, equally and impartially obtain the cooperation and compliance of all Residents with respect to the Rules and Regulations and other conditions of residency. 3. RENTAL AGREEMENT: A. These Rules and Regulations are an integral part of the Park's Rental Agreement. All Residents are required to sign a written Rental Agreement. B. Prospective Residents must fill out a Resident Application form, submit to Management's approval process and sign a rental agreement before they can be accepted as a Resident of this community. A prospective Resident who has already purchased a mobilehome in the Park is not a legal Resident of this community until and unless Management has received a completed application, approved that person as a Resident and a rental agreement has been signed. 4. FAIR HOUSING COMMUNITY: PACIFIC PALMS MOBILEHOME PARK is open to qualified Residents without regard to age, race, creed, color, national origin, religion, gender, marital status, or disability. Park Management is unable to undertake supervision of children, and it is the responsibility of parents and guardians to arrange for any necessary supervision. 5. INCOME CERTIFICATION REQUIREMENTS: In order to maintain the tax exempt status of the Park, all Residents must be income qualified and must remain income qualified throughout their tenancy at the Park. A. As a condition to tenancy at the Park, all Prospective Residents must complete a Certification and return the completed form and all requested income verification documentation to the Park office. A Prospective Resident's execution of a completed Certification shall be deemed a certification by the Prospective Resident that all of the information provided in the Certification is true and correct. B. All Residents must complete an Annual Recertification and return the completed form and all requested income verification documentation to the Park office on or before each anniversary of the Resident's tenancy at the Park. A Resident's execution of a completed Annual Recertification shall be deemed a certification by the Resident that all of the information provided in the Annual Recertification is true and correct. A Resident's failure or refusal to provide a completed Annual Recertification or to provide requested income verification documentation shall be deemed a violation of a substantial obligation of the Resident's tenancy in the Park. I have read and understand the foregoing income certification requirements and agree that my failure to complete an Annual Recertification and/or to provide to the Manager of the Park the income verification documentation requested will be a violation of a substantial obligation of my tenancy in the Park and could result in termination of my tenancy at the Park. initials initials 6. CONTINUING REQUIREMENTS: Homeowner(s)and Residents are required to do each of the things listed below continually while they live at Pacific Palms Mobilehome Park: A. Maintain their space in a clean, weed-free, well-cared-for, litter-free condition, properly cut and trim all lawns, shrubs and trees so that they do not hang over lot lines and onto other spaces or streets and water grass on a regular basis; 2 i B. Maintain the mobilehome, awnings, storage buildings, skirting, pillars, fences and all other installations upon the space in a well-painted and clean condition. Any dents or scratches in paint will be repaired within thirty(30)days; C. A Homeowner who has a check returned by the bank shall be required to make payments for a period of six (6) months with a money order or cashier's check. No personal checks will be accepted in that time period; D. Comply with all terms, conditions, and provisions of the rental agreement in force between the Park and the Homeowner(s); E. Dispose of all trash, garbage, and debris of every kind in the Park, in a proper container and nowhere else; F. Maintain the drainage patterns on the space such that no puddles or puddling occur under the mobilehome or on the space; and G. Keep all utility connections accessible by an unobstructed passageway or no less that three (3) feet in width and six(6)feet in height; H. Each mobilehome/manufactured home which occupies a homesite in the Park must bear current registration decal insignia which is properly affixed to the side of the mobilehome which faces the street pursuant to California Health& Safety Code Section 18092. 7. PRIOR WRITTEN PERMISSION REQUIRED: Homeowner(s) and Residents may not do any of the following things without the prior written permission of Park Management: A. Change, install, delete or remove any landscaping, including trees located on Residents' lots, walkways or driveways; B. Replace the mobilehome currently upon the space with any other mobilehome; C. Erect any fence, carports, awnings, or other structures of any kind,whether permanent or temporary; D. Keep or maintain any furniture, furnishings, appliances, equipment, or anything else of any kind outside of the mobilehome, except regulation outdoor"patio-type"furniture; E. Use the Park's facilities for a private meeting except meetings open to all Park residents regarding mobilehome living, social or educational purposes,(see Rule#9 for further details); F. Engage in any business,whether for profit or otherwise at the space or in the Park; and G. Repair any automobile, truck, motorcycle, or other vehicle of any kind at all including the changing of oil or any fluids. 8. ABSOLUTE PROHIBITIONS: Homeowner(s) and Residents may not do any of the following things as long as these rules remain in effect: A. Allow any person whose name does not appear on an Application for Residency to live at the space of the Park on a permanent basis except guests as described in Section 798.34(b) and(c)of the California Civil Code. Permanent residents will be defined as those who live in the mobilehome for more than thirty(30)days whether consecutively or otherwise in any calendar year; 3 B. Hang laundry anywhere in the Park, except where provided by the Park. This includes, but is not limited to, the use of a permanent or temporary clothes line; clothes draped over railings, on hangers, on the awning supports, on the shed, or from a tree in the yard; C. Allow the number of occupants in the mobilehome to exceed the number which is two times the number of bedrooms in the mobilehome plus one(see Rule#15 for further details); D. Sublet or attempt to sublet the mobilehome or mobilehome space, or any portion thereof, except as allowed under the Mobilehome Residency Law; E. Park any camper, trailer, boat, water vehicle or any vehicle over one ton of any kind at Homeowner(s) space; F. Hold a yard sale or moving sale unless done so in cooperation with the Park as a whole; and G. There is no ball playing of any kind in the Park streets or on vacant lots. Baseball, football, soccer, kickball, catch, basketball, or any other type of ball playing is prohibited on the Park's streets. You may use the Playground area for this activity. 9. USE OF PARK RECREATIONAL FACILITIES: This rule may be changed on sixty (60) days' notice. Management reserves the right to restrict the use of the clubhouse as to hours,purpose and conduct. A. Recreational facilities are provided for the exclusive use of Residents and their accompanying guests. Residents agree to acquaint guest with Rules & Regulations. Residents must accompany their guests at all times when guests are using the recreational facilities. Residents and guests must sign the Recreational Facilities and Common Area Agreement before using the recreational facilities. All persons 14 years or younger must be accompanied by an adult resident at all times while using the recreational facilities. B. Hours for the recreational facilities and additional rules and regulations governing the use of the recreational facilities are posted in and about the facilities and are incorporated into these Rules and Regulations by reference. C. No drinking of alcoholic beverages or use of any other mood altering substance is allowed in or around the recreation area,buildings or common areas. D. Residents and guests must wear a shir[ or jacket at all times in the clubhouse and other Park buildings. Footwear must be worn in all Park facilities, including restrooms. E. Clubhouse: Residents wishing to reserve the clubhouse or other facilities for private parties,meetings or other functions must apply by filling out the Clubhouse Reservation Form and Rules. Should the date not conflict with any other applications, social events or planned use of the facilities and upon approval by management, the request will be granted. There will be no charge for the use of the clubhouse. However, except as limited by California Civil Code 798.5 1, Resident may be required to pay a security deposit of$100.00 to cover the cost of cleaning given the nature of the proposed event. This deposit will be applied to the cost of any additional cleaning that may be necessary after the function or to any damage that may occur. If in the event that this deposit does not cover the cost of all the cleaning and/or damages, the Resident will be charged for the difference. Those scheduling the function will be responsible for the normal cleanup afterwards. All functions in the clubhouse are for Residents only, except when approved by Management. All such functions must be carried on in full compliance with these Rules and Regulations and the other residency documents of the Park. Resident will, therefore, be required to provide Management with information relating to the function so that management may evaluate the function. Note: Alcoholic beverages and other mood altering substances are prohibited. 4 Any recreational devices provided by management, such as a Ping-Pong table, card tables, etc.., may be relocated at times at Management's discretion. F. Billiard Room: No food or drink is permitted. Abuse of furniture or equipment shall be charged to the Resident and can result in loss of playing privileges. Please use the trash can and help keep our clubhouse clean. G. Play round: Rules pertaining to the playground are posted at the facility. 10. LAUNDRY: Laundry room hours are posted at the facility. This facility may be closed from time to time at Park Management's discretion for cleaning and repairs. Automatic laundry is for Resident's use only. Please leave machines, dryers, and laundry room clean. Remove all clothes from machines as soon as they are finished. No dyeing or tinting permitted in machines. Persons 14 years and younger are not permitted in or around laundry facility unattended. 11. PETS: Residents may keep up to two "pets," as defined by Civil Code Section 798.33(c) and subject to Management's prior approval. Approved pets must be registered with the Management. No vicious breeds of dogs will be allowed. Dogs must be kept on a leash at all times when outside of Resident's mobilehome. Pets may not be tied up or chained up outside of the home on the space. Pets, which cause substantial annoyance to neighbors, must be removed from the Park. Pet droppings must be cleaned up daily. A separate pet agreement must be signed with Management before a pet can be approved. No pets are allowed in the recreational facilities, including the Playground area, Clubhouse deck and grass areas at both Pools. If any of the rules regarding pets are violated and such violation is noted by management or a valid complaint is made by another Resident, the Resident Owner of the pet will receive an official notice in writing stating that the right to keep a pet within the Park is terminated. Each pet must be licensed in accordance with local law,and proof of this filed with the Manager. 12. SWIMMING POOL AND SPA: The swimming pool and spa are open year round, however the swimming pool is not heated. The pool/spa is for the exclusive use of Residents and their guests. Guests must be accompanied by a Resident over the age of 18 at all times in the pool/spa areas. Persons under the age of 14 must be accompanied by a Resident over the age of 18.No glass containers or food is permitted in the pool/spa area. Please shower and remove all hair pins, clips, and ornaments before using the pool/spa. Due to limitations on facilities, Management may restrict the number of guests in the pool/ spa. NO LIFEGUARD IS PROVIDED. A separate pool/spa release agreement must be signed and on file prior to using the pool/spa area. 13. CONDUCT: Homeowner(s) agree that conduct which constitutes a substantial annoyance to other park residents within the meaning of California Civil Code Section 798.56(b), shall include, but not necessarily be limited to the following conduct or combinations thereof. A. Frequent arguments at your homesite (neighbor to neighbor disputes, domestic disputes, domestic violence, etc.)which are audible to a next door neighbor inside their home; B. Any terrorist threats or racial/ethnic insults made to others, including management staff or neighbors; C. Brandishing of any weapon and/or discharge of any explosive device including fireworks, or discharge of any gun including compressed air guns, `B-B" guns and paintball guns within the mobilehome park complex,whether intentional or accidental; D. Multiple responses (i.e. 3 times in any 12 months) to the park by the police for reported criminal and/or nuisance activity or disturbances of the peace at your homesite; E. Frequent late night and early morning social or business gatherings at your homesite; F. Frequent vehicular traffic to and from your homesite for short visits; 5 G. Frequent bicycle or foot traffic to and from your homesite for short visits; H. Frequent loud noises at your homesite, including music, television and more, night or day which is audible to a next door neighbor inside their home; I. Operation of electronic transmission devices (e.g. "Ham" or "CB" radios) which interfere with your neighbors radios, TVs or computers; J. Frequent open consumption of intoxicants whether at your homesite or in common areas; K. Unsafe driving within the park including speeding, failure to stop at stop signs or yield, endangerment to pedestrians,young people and pets; L. Loud motor vehicle noises including modified muffler systems, car stereos and motorcycles going to and from your homesite; M. Frequent and continuing improper street parking; N. Continuing failure to maintain the mobilehome and homesite— including landscaping- according to the park rules and regulations and general park standards. This includes, but is not necessarily limited to improper open storage of personal property, hazardous materials, inoperative vehicles, unregistered vehicles, unsightly vehicles and vehicle repair at the homesite; O. Frequent or continuing accumulations of litter,rubbish or debris at the homesite; P. Causing any open fires,whether intentional or accidental; Q. Residents and their guests shall not encroach or trespass on any other Resident's homesite or upon any area that is not open for general use by the Residents and their guests. All Park property, including, but not limited to, gas, electric, water and sewer connections and other equipment connected with utility services and tools and equipment of Manager, shall not be used, tampered with or interfered with in any way by Residents or their guests. R. The violation of any law, regulation or ordinance of the city, county, state or federal government will not be tolerated. No acts or demeanor shall be permitted which would place the Management in violation of any law,regulation or ordinance. Engaging in the conduct identified above, or any other conduct deemed by the Management to be a substantial annoyance to other Park Residents shall be grounds for a termination of tenancy and if necessary, formal eviction proceedings IMPORTANT! Homeowners are cautioned to control the behavior of their guests and co-residents. Homeowner is responsible for the conduct of all guests and co-residents at the homesite. If the behavior or actions of a Homeowner's guest or co-resident causes damage to another resident's space, property or a Park facility, the Homeowner will be responsible for incurring all costs associated with the repair of the damage. 14. MOBILEHOME STANDARDS: All homes to be placed in the Park must meet all local, state, and federal standards, except where otherwise permitted by law. All homes to be moved into this community must have the written approval of Management. Manager will designate size and placement of each home and all improvement requirements incorporated in these rules must be completed within 60 days of movein, including, but not limited to, all exterior accessories, awnings, skirting, steps, complete lot landscape, etc. Management requires that the Resident maintain in good condition and repair the mobilehome and all accessory equipment, structures and appliances which are presently installed or may be installed on the Homesite. This obligation includes the replacement of any such items, which are missing or are damaged to the point that they cannot be reasonably repaired. This obligation also includes the repainting of the mobilehome, accessory equipment, structures and appliances when they are in need of repainting. In addition, all electrical, water, sewer, and gas connections must be kept in a good and leak-proof condition at all times and in compliance with all state and municipal laws or 6 regulations. Any additions to the home(porches, screen rooms, cabanas, etc,)must be approved by Management in writing, and then submitted to the proper regulatory agency for the necessary permit. Use of spray guns or heavy equipment requires Management approval. Any mobilehome, accessory equipment or structure or appliance installed or changed which does not conform to the Park's residency documents shall be removed by Resident at Resident's cost. The following accessory and equipment rules must be adhered to: A. Skirting and Awnings: Awnings are required. All textured materials and color must coordinate with the Mobilehome. All awnings must be of anodized aluminum or steel and must be of an approved manufactured type. Skirting may be of masonite or masonry, or other approved material, which matches the siding and color of the Mobilehome. All supports for the awning must be vertical and in good repair at all times. B. Porches and Patios: Porches and patios are required and must be constructed under permit and meet city and state building codes. Porches must be of an approved size and material matching the exterior material of the Mobilehome. All steps must be of good manufactured quality and sidefaced to match the Mobilehome. Steps must have approved handrails, as required by law. Unless made of masonry or treated wood, step surfaces must be covered with carpet or other approved material. The temporary steps provided by the Mobilehome dealer must be removed from the Homesite no later than sixty(60) days from the time the Mobilehome is moved into the Park. C. Storage Sheds: Written approval of Management must be obtained before a shed is installed. One or two storage sheds, up to a combined total of 120 square feet may be placed on the Homesite at the rear of the home. Storage sheds must be made of a material previously approved by Management. Electrical service to the shed requires a State permit. Sheds must be at least three feet from utility pedestal to allow for maintenance and reading of meters. D. Fences: All fences may be constructed of only masonry, wrought iron, cedar or redwood or vinyl and may not exceed six (6) feet in height. No chain link is allowed. Cedar and/or redwood fencing must be treated with a water resistant sealer and must be maintained in good repair at all times. Material, style and locations of any new fences must be approved in writing by Management prior to installation. Fencing not to exceed six(6) feet in height will be allowed along the side lot lines with a three (3) foot setback from the street. However, all cross fencing on the space must not exceed past 50% from the rear lot line. Access must be available to the utility pedestals at all times therefore no cross fencing is allowed in front of the utilities, it must be behind them. "Mixed-material" fencing is strictly prohibited (i.e. part wood and part masonry on the same space.) Fencing in the front of the home and/or space is also strictly prohibited. E. Exterior Painting: The exterior paint on the Resident's mobilehome, accessory structures and equipment shall be properly maintained. Proper maintenance shall include, but not be limited to, the repainting of the exterior whenever the paint begins to fade, peel, flake, chip or deteriorate in any other manner that detracts from the appearance of the Park. All colors must by approved by the Manager. F. Antennas: Before installation of any type of Antenna, written permission by management must be received. Satellite Disc Antennas may not exceed one (1) meter in diameter unless approved by Management. Satellite Disc antennas must be placed behind the home or to the extreme rear of the home in a location previously approved by management. Approval must be in writing and counter- signed by the resident evidencing a mutual understanding of where the,Antenna is to be installed. A copy of the approval will be provided to the resident and the original will be placed in the resident's file. Satellite Disc Antennas must be provided and installed by a commercial, reputable and financially responsible company. No home manufactured or"pirated" satellite antennas will be allowed. G. Proper Drainage: It is the Resident's responsibility to assist Management in assuring the natural flow and drainage of water on the homesite. This requires that the Residents do no act in any way which 7 would impede the natural flow and drainage of water, or assist in the buildup of water. Residents are required to use proper irrigation techniques. Additionally, it is suggested that Residents level the Mobilehome on a consistent basis as suggested by the manufacturer and install rain gutters and down spouts. 15. PERMISSIBLE USE OF LOT: The homesite shall be used for a home, approved by Management, to be used solely as a residence and shall house only those Persons approved in writing by Management, and no others. Occupancy is limited to no more than two persons per the number of bedrooms, plus one. A "bedroom" is defined as sleeping quarters, as intended by the original manufacturer of the home. Any room converted from another use, or added onto the home, shall not be considered a "bedroom" without the express written approval of Park Management. Resident agrees not to change the home on said homesite without first obtaining Lessor's written consent, and all necessary permits. The Homesite shall remain accessible to Management at all times in order to facilitate repairs of equipment, installation of new equipment, maintaining landscaping in proper condition and other emergencies that may arise. No commercial business shall be conducted in the Park unless previously approved by Management in writing. Park Management shall have a right of entry upon the Homesite for maintenance of utilities, for maintenance of the Homesite where the Resident fails to maintain the homesite, and for the protection of the Park at any reasonable time. 16. GUESTS: A. Guests should be made aware of the community Rules and Regulations in order to prevent any embarrassment to the guests. Residents are responsible for the conduct and actions of their guests and any damages done by the guest is the responsibility of the Resident. B. Guests may stay with a Resident for twenty(20) consecutive days or thirty (30) days in a calendar year without registering. Thereafter guests must register at the Park office. Management reserves the right to determine whether the Park facilities can accommodate all the Residents and guests in the park, and, therefore, may at its sole discretion refuse a guest permission to stay in accordance with Civil Code provisions. Management agrees that it will not unreasonably withhold its consent to allow additional people to move in with Resident. 17. LANDSCAPING: Residents shall maintain their Homesites in a clean, well-kept and attractive fashion, including the front, sides, and back. If a homesite is neglected, after reasonable written notice,Management reserves the right,but is not obligated to,take over its care and bill the Resident at the rate being charged by or to Management for the work. Resident may use any combination of lawn, shrub, flowers,trees, and rocks;however the minimum landscaping allowed is black plastic with rocks laid on top, completely covering the plastic so none is visible. Any landscaping that would require excavation or digging greater than six(6) inches, including irrigation canals, must have the prior written approval of Management,to avoid damage to underground cables and pipes. Resident may not plant any tree without the prior written approval of the Park Management. Prior Management approval may be granted on condition that the Resident signs a written agreement regarding maintenance and trimming of any tree in question. Management may remove any tree if, in Management's judgement,removal is necessary. The removal of any tree by Management is not a reduction in services and there shall be no deduction, offset, discount or other adjustment to the monthly rent or other charges of the Park. Resident must regularly maintain and trim all trees on their homesite in order to prevent trees from becoming a hazard to persons or property or from becoming a Health& Safety Code violation. If a Resident contends that a tree presents a specific hazard or Health& Safety Code violation, it shall be the Resident's obligation to contact the appropriate authorities and arrange an inspection of the condition in question.Any plant, shrub or tree that dies or falls down must be removed by the Resident of that homesite, at Resident's expense. 18. LOT MAINTENANCE&APPEARANCE: All homesites must be maintained in a neat, clean, attractive and well-kept manner by Resident at his or her own expense at all times. Improper storage of items will be handled per California Civil Code Section 798.36. 8 A. Storage: Wheels, hitches and other items permitted by law are the only things which may by store under the mobilehome. Storage of anything behind or on the outside of the mobilehome is prohibited. This includes, but is not limited to, storage of boxes, trunks, pipe, bottles, garden tools, mops, ladders, paint cans or any item which is unsightly in appearance. No combustible materials may be stored outside the home at any time. 1. Only outdoor patio furniture and manufactured barbecues approved by Management may be used on the patio, porch,yard or other portions of the homesite. 2. No towels, rugs, wearing apparel, or laundry of any description may be hung outside of the mobilehome at any time. B. Dangerous Materials: Anything which created a threat to health and safety shall not be permitted on the homesite. No flammable, combustible or explosive fluid, material, chemical or substance (except those customarily used for normal household purposes, which shall be properly stored within the mobilehome and/or storage shed)may be stored on the homesite and then only in quantities reasonably necessary for normal household purposes. C. Damage: If any portion of the exterior of the mobilehome or its accessory equipment, structures and/or the homesite is significantly damaged, the damage must be repaired or replaced within thirty (30) days. This includes, but is not limited to, damage to the siding, awning supports, down spouts, skirting, porch or storage shed. If a Resident's mobilehome has not been repaired, reconstructed or restored within a reasonable time after work has been commenced on it, but in no event later than thirty(30) days from commencement of the work,the Resident shall be in violation of these park rules. In the event that a mobilehome within the Park is substantially destroyed, (i.e. a total loss)the Resident shall remove the mobilehome from the Park at his expense. If the Resident fails or refuses to move the substantially destroyed mobilehome, the management may remove the mobilehome and the actual costs of the removal of the destroyed mobilehome shall be immediately due and payable to the management. The intent of this Rule is to avoid the situation where a substantially destroyed mobilehome continues to occupy a space in the Park and becomes a health and safety hazard. In the event that a substantially destroyed mobilehome is removed from the Park, the mutual obligations under the Rental Agreement shall terminate, unless the Resident gives Management written notice of Resident's intent to replace the substantially destroyed mobilehome and continue occupancy of the homesite pursuant to the Rental Agreement. Any such replacement mobilehome shall comply with these rules and regulations. D. Driveway: Management is responsible for repair, replacement, paving and sealing of the driveways installed by Management at Resident's Homesite, except when the damage is caused by the Resident. Resident is responsible for maintenance, repair, replacement, paving and sealing of any driveway or portion thereof, or other hardscape surface which Resident has installed at Resident's homesite. Resident may be charged for all expenses for any damage to the driveway caused by acts or omission of the Resident, or breach of the Resident's obligations under the existing Park Rules & Regulations. Resident is responsible for keeping the driveway surface clean and free from accumulations of corrosive substances such as auto fluids, cleaning fluids, etc. Toxic fluids must be vacuumed into a secure container and lawfully disposed of. Do not wash toxic fluids into the gutters or stormdrains. 19. VEHICLE REPAIR: No car repair, servicing or painting will be allowed in the Park. Any car dripping gasoline or oil must be repaired to avoid damage to the pavement. Drip pans may be used if kept clean. Car washing is permitted at the Homesite. All vehicles parked at Homesites must be fully operational, and capable of being moved in case of emergency. 20. GARBAGE AND TRASH DISPOSAL: Garbage shall be placed in the designated trash containers. All trash containers must be kept from public view and lids must fit and be closed at all times,they may only be set out for pick-up the evening before and the morning of the pick-up and shall be taken back at the end of the day. Materials, which will not dissolve in the sewer system, such as lard, grease, facial tissue, paper towels, sanitary napkins, diapers or metal must not be flushed down the toilets or poured into sink drains. Residents are required to 9 dispose of all rubbish, garbage and other waste in a clean sanitary manner. If and when the Park provides central dumpsters, they are to be used by Residents for excessive dry trash only. Throwing garbage which is not in "drip proof wrap" in dumpsters is prohibited. Dumping of petroleum products or acid in trash receptacles or Park drains is prohibited. All rubbish, trash and garbage shall be regularly removed from the space and Park, and shall not be allowed to accumulate thereon. 21. SUBLETTING: A. No subletting, subleasing, or renting of homes is allowed, except as provided under the Mobilehome Residency Law. At all times, at least one full-time park-approved resident must be listed as the Registered Owner of the home occupied, according to HCD or County tax records. B. A resident wishing to have someone use his home during the Resident's absence must obtain written permission from Management if the Resident plans to be absent for more than two weeks. 22. MOBILEHOME RESALE: A. Resident may sell his mobilehome at any time pursuant to the rights and obligations of Resident and the Park under the Mobilehome Residency Law and other applicable law. Residents must, however, notify Management in writing sixty (60) days prior to the intended date of sale. At that time, Management will notify Resident in writing of any conditions of sale for homes which are to remain in the Park. Management reserves the right to require removal of a home upon resale in order to upgrade the Park, in conformance with the California Civil Code. B Before the sale has been completed, the prospective Resident (Buyer) must do the following: (1) complete an Application for Residency; (2) be accepted by the Park; (3) execute a Rental Agreement or other agreement for the occupancy of the Homesite; and (4) execute and deliver to the Park a copy of the Park's then effective Rules and Regulations and other residency documents. If the purchaser fails to execute the Park's Rental Agreement, he shall have no rights of residency. C. Except for guests,the requirements in paragraph 22B for completion of an application, approval by the Park, and the execution of documents shall also apply before any additional person other than the ones listed on the last page of this Agreement shall be permitted to become a Resident of the Park or reside with a Resident on a semi-permanent or long term basis. 23. ADVERTISING AND COMMERCIAL ACTIVITY• A. Any sign advertising the sale or exchange of a Resident's mobilehome shall be limited in size as presently provided in the Mobilehome Residency Law. No more than one (1) such sign shall be displayed and it shall be displayed only as described in Civil Code Section 798.70. B. Except for the sale of a Resident's mobilehome, no "auction," "moving sale," or"garage sale"will be permitted if it involves advertising or other announcements inviting members of the general public to come into the Park,unless prior approval from Management has been obtained. 24. SAFE DRIVING: Due to heavy pedestrian traffic in the Park, everyone is urged to drive SLOWLY and CAREFULLY at all times within the Park. All traffic signs and all California Vehicle Code "Rules of the Road" must be obeyed. 25. PARKING: Most homesites have parking facilities to accommodate up to three vehicles in the carport area ONLY. The third vehicle may be parked in the carport as long as the vehicle does not extend past the front of the space. Some homesites, however, have parking facilities to accommodate only one or two vehicles. Only those vehicles that fit into your driveway are allowed. Residents must park their vehicles(s) in their driveway first. Residents parking on the street that is not designated as a fire lane is allowed only if the resident does not have room for the vehicles(s) in their driveway. All vehicles parked at the curb must be parked "going with traffic." Vehicles parks at the curb may not block the driveway or front entrance to homesites. Vehicles in violation are 10 II; subject to towing at the vehicle owner's expense. Motor homes, buses,trucks in excess of one ton, campers,travel trailers, boats,boat trailers, and other similar recreational type vehicles may not be parked on Resident's Homesite. All such prohibited vehicles will be parked outside of the Park. Any such prohibited vehicle belonging to a guest may not be parked overnight in guest parking or on the Homesite. These limitations do not apply to service E vehicles of contractors or other persons performing services for Residents during the time the service is being performed. Street parking is allowed only on the side of the street that is not designated as a Fire Lane. Therefore, any Resident or guest of a Resident parked on the side of the street that is designated as a Fire lane is subject to having their vehicle towed away at the owner's expense. Resident parking is ONLY permitted in their designated parking spaces on their homesites. Guest parking areas are ONLY for guests. No inoperable vehicles are allowed to be "stored" on the Homesite or in any guest parking areas. Vehicles are not permitted in the Park unless they are regularly maintained in normal operating condition and are neat and clean in appearance. All vehicles must display evidence of current registration as well as be registered with the Park office. Parking on the vacant lots is not allowed at any time. Vehicles parked on the vacant lots or in other prohibited areas will be towed at owner's ' expense. Parking will be enforced as outlined in California Civil Code Section 798.28.5. 26. MOTORCYCLES MINI-BIKES MOPEDS SKATEBOARDS AND SCOOTERS: Motorcycles, mini- s bikes, mopeds and electric scooters may not be operated within the Park at any time, except directly to and from the Park entrance and Resident's space in such a way that does not cause excessive noise. The use of roller blades, _3 skateboards, roller skates and non-motorized scooters is allowed only in the Park streets, however they must be ridden in such a way as to not impede the flow of traffic. No riding, hopping,jumping speed bumps or rail sliding of skateboards will be allowed in the Park. The use of go-carts and pocket bikes in Park is strictly forbidden. No ramps are allowed anywhere in the Park, including in driveways. Bicycles may only be driven on the roadways y and not on grass, vacant homesites, or any other paved area. Bicycles must obey the same traffic regulations as vehicles. If driven at night or at dusk on the park's premises, bicycles MUST be equipped with a light on the front and a reflector in the rear. However, these items, as well as other similar wheeled modes of transportation are considered vehicles and must be operated in a safe manner(i.e.: individuals may not sit on the skateboard and ride down the street on the skateboard, must wear the proper safety equipment, etc.) so that the risk of injury to rider as well as by-standers is minimized. 3 27. COMPLAINTS: All resident's complaints, except emergencies, must be presented to management during office hours or in the drop box, and be in writing, dated and signed. 28. WAIVER OF DEFAULT: No delay by Management of Management's right to enforce any provision hereof after any default on the part of the Resident, shall be deemed a waiver of Management's rights to enforce each and all of the provisions hereof upon any further or other default on the part of the Resident. The acceptance of rent hereunder shall not be, or become construed to be, a waiver of any breach of any term, covenant or condition of the party's lease or these Rules and Regulations, or shall it reinstate, continue or extend the term of the party's lease or affect any notice, demand, or suit thereunder. 29. WRITTEN APPROVAL: References to "approval", "permission" or "authorization" of the Management shall be construed as written approval prior to taking action. 30. SPECIAL RULES INCORPORATED BY REFERENCE: Other rules of conduct concerning the use of the Park's facilities are posted throughout the Park and by this reference are incorporated herein as though set forth in full. Residents must read and follow the posted rules. ''. 31. Management, as its sole discretion,has the right to disallow a resident from keeping a pet who has dangerous tendencies or who is unable to abide by the Park rules and regulations. 1. Pets will not be allowed to cause any disturbance which might annoy neighbors, including but not limited to,barking, growling,biting, or any other unusual noises or damage. 2. Other than on Resident's own homesite,pets may not be walked on the Park streets at any time without a leash. Pets are not permitted on any other Resident's homesite at any time. Resident is responsible for timely pick up and proper disposal of any pet droppings on Resident's space or anywhere inside the Park or on its perimeter. 3. Animal Control will be called regarding pets running loose in the Park. Recurring violations of this rule will lead to the loss of the privilege to maintain a pet. 4. Pets may not be tied up or chained up outside of the home on the space. 5. No pets are permitted in the clubhouse, recreation area, or other such designated areas or Park common areas. 6. If a Resident loses a pet,he must acquire written permission from Management to keep another pet prior to getting the new pet. 7. Guests and visitors with pets must abide by pet rules. 8. There is a maximum of two(2)pets allowed on each space,unless written approval is obtained. 9. The pet owner is responsible to see that each pet has all the required immunization shots and is licensed in accordance with all governmental agencies. The owner must also supply copies of such documents to Management. 10. Pet food is not to be left outside as to attract stray dogs, cats,mice, flies, etc. We realize these rules seem demanding,but in fairness to others,they must be adhered to: (Title 25,Chapter 5 (Regulations)Article 1 (General Provisions) Section 18601 provides that Dogs and other animals shall not be permitted to run at large in any mobilehome park.) The swimming pool is open to resident according to the times specified in the Rules and Regulations or otherwise posted by management. 2. Person under the age of fourteen(14)may use the swimming pool but ONLY IF they are accompanied by a RESIDENT over the age of eight(18). 3. ALL guests must be accompanied by a RESIDENT who is at least eighteen(18)years old and must sign a release. 4. Resident may have not more than two(2)guests per household with them. Management reserves the right to restrict the number of guests if it interferes with use by other residents. 5. Persons who cannot control their bladder and/or bowels(i.e. children in diapers, incontinent adults,etc.) MAY NOT use the pool or spa at any time. 6. Do not swim alone. THERE IS NO LIFE GUARD ON DUTY. 7. Every one MUST shower before entering the pool or the spa. 8. DO NOT enter the pool or spa with suntan oil or similar products on the body. 9. ONLY manufactured swimwear in good condition may be worn. NO cutoffs, gym shorts or similar attire is permitted. 10. DO NOT take bobby pins,hairpins and other foreign objects in the pool. 11. All personal belongings must be removed from the pool area when leaving. Park owners and managers are NOT responsible for lost or stolen items. 12. NO alcoholic beverages or other mood altering substances of any kind are allowed. 13. NO eating of any kind of food or snack is allowed in the pool area or on the clubhouse deck. 14. Smoking is allowed on the pool deck ONLY. Cigarette butts must be deposited in the proper containers. 15. NO radios are allowed in the pool area EXCEPT those with earphones,which cannot be heard by other people in the area. 16. DO NOT sit in the pool or spa and talk on your cell phone, listen to your walkman,I-Pod,etc. 17. Screaming,running, loud noise of any kind,horseplay, etc. is NOT allowed. 18. Diving, flipping, cannon balls,twists or jumping off hand rails or edges of pool are not allowed at any time. 19. Glass containers and any other breakable objects are NOT allowed. 20. Trash and refuse MUST be deposited in proper containers. 21. Chairs, lunges, and other furniture are NOT to be removed from poolside. 22. NO pets are allowed in the pool area or on clubhouse deck.
