MCC Date: March 7, 2011 Synopsis of Previous Council Action: 02-16-10 The Mayor and Common Council adopted Resolution No. 2010-63 awarding a contract to All American Asphalt for Street Improvements on Cajon Boulevard related to Federal EDA Award No. 07-01-06147, per Project Plan Nos. 12155. 12-21-09 The Mayor and Common Council adopted Resolution No. 2009-375 approving a contract with RBF Consulting for Construction Management Services for Street Improvements on Cajon Boulevard related to the North San Bernardino Industrial Park/FedEx Project. 10-06-08 The Mayor and Common Council adopted Resolution No. 2008-379 approving a reimbursement agreement with Hillwood related to the North San Bernardino Industrial Park/FedEx Project. 05-05-08 The Mayor and Common Council authorized the Finance Director to create a new capital improvement project for the North San Bernardino Industrial Park/FedEx Project. 04-07-08 The Mayor and Common Council adopted Resolution No. 2008-115 accepting a grant from the Federal EDA. Description: Hillwood Reimbursement Finance: Council Notes: Agenda Item No. 03-07-�0�/ CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Authorize the Director of Public Works to execute Contract Change Order No. One with All American Asphalt for Street Improvements on Cajon Boulevard Related to Federal EDA Award No. 07-01-06147, per Project Plan No. 12155. Background: On April 7, 2008, the Mayor and Common Council adopted Resolution No. 2008-115, accepting a $1,500,000 Federal Economic Development Administration Grant for infrastructure improvements on Cajon Boulevard related to Hillwood FedEx project. As a condition of approval, Hillwood was required to construct approximately 5,452 linear feet of curb, gutter, sidewalk, street lights, and pavement rehabilitation to the street center line. The estimated cost of improvements was $3,750,000. After subtracting the grant amount, the remaining balance of $2,250,000 was the City's share. Hillwood has agreed to pay the City's share. On October 6, 2008, the Mayor and Common Council adopted Resolution No. 2008-379, which approved a Reimbursement Agreement with Hillwood for the City's share of the cost for the improvements. On April 5, 2010, the Mayor and Common Council adopted Resolution No. 2010- 63 to award a contract to All American Asphalt in the amount of$740,827.60 for construction of street improvements on Cajon Boulevard related to EDA Award No. 07-01-06147, per Project Plan No. 12155. Construction Change Order No. One: During construction, a revised Southern California Edison site plan was introduced in the field, requiring the contractor to install an additional conduit and a transformer pad for the project. In addition, the contractor was directed to perform additional removal of asphalt concrete along Cajon Boulevard to meet the structural pavement requirements, when it was discovered in the field that the existing pavement was inadequate and failing. This additional work was not included in the contractor's original bid. The last two items included in this change order were the additional striping work on the northeasterly side of the street, which is in the County, to accommodate adequate lane widths. The descriptions and justification of these items are detailed in the attached copy of Contract Change Order No. One. This change order results in an increase to the project by an amount of$18,612.66. I Financial Impact: i The revised estimated contract costs are as follows: TOTAL Original Contract Amount $ 740,827.60 Contract Change Order No. One $ 18,612.66 Total Construction Contract Amount $ 759,440.26 z 02/17/2011 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT—Continued This change order represents an increase of 2.51% of the original contract amount. The change order did not increase the total project cost, which was less than estimated in the original design phase for budget purposes. Therefore, no additional funds are needed for this project. In addition, the City will be reimbursed 40% of the final construction cost from Federal EDA, 1 including this change order amount and Hillwood will reimburse the remaining cost. Funds for this change order are appropriated in the Public Works Department budget, FY 10-11 (Account No. 242-160-5504-7802-0025) SS08-035 "Cajon Blvd. Street Widening from South of Glen Helen" as follows: Account No.: 242-160-5504-7802-0025 Budgeted Amount: $3,744,300 Balance as of 02/14/11: $2,859,061 Balance after the approval of this item: $2,840,448 Please note this balance does not indicate available funding. It does not include non-encumbered recurring expenses or expenses incurred but not yet processed. It reflects the amount allocated but not necessarily obligated and authorized by the US Department of Commerce (Federal EDA), which will only reimburse the City for actual costs incurred. Remove Existine Asphalt Concrete Pavement 1-2 The contractor was directed to perform additional asphalt concrete removal work when it was discovered in the field that the existing pavement did not meet structural requirements. This additional work was not included in the original contract bid.
