2005.
January 9, 2006 - Amendment No. 2 to extend the Agreement for Use of Facilities between the
City and the School District through June 30, 2006.
Background:
An Agreement for Use of Facilities between the Parks, Recreation and Community Services
Department and the San Bernardino City Unified School District has existed for many years. The
Department Director executed such contracts in the past. The Department is requesting that the
Council review and approve a recommendation to continue the cooperative provision of adult
education classes to the San Bernardino community.
The Adult School has been operating in the San Bernardino City Unified School District since
1920. On February 21, 2001, an Agreement for Use of Facilities was generated by the San
Bernardino City Unified School District to conduct Adult Education classes in the City's
community centers and senior centers free of charge. The Director of Parks, Recreation and
Community Services Department and the San Bernardino Unified School District signed this
agreement for July 1, 2000 through July 1, 2001. Multiple sites were included for use in the
original Agreement; but, with the addition of the new S.A.G.E.S. facility by the School District,
the need for other City facilities has diminished. Since then, two additional amendments were
Updated: 12/12/2013 by Linda Sutherland B Packet Pg.414

approved, one to extend the Agreement an additional four years and the second to extend an
additional year through to June 30, 2006, ratifying both the original agreement and the First
Amendment.
This Agreement will allow the School District to continue offering classes at Perris Hill Senior
Center in particular with no fees to the School District and no cost to the participants. These
classes (senior wellness, brain fitness, writing your memories, line dancing, yoga/tai chi) are
offered during normal work hours and/or on work days of Department personnel (Attachment
No. 1). Adults and senior-age residents benefit greatly from the services offered through the San
Bernardino City Unified School District Adult Schools at the Perris Hill Senior Center. These
classes have been proven to be a benefit to the citizens of the City of San Bernardino at no
additional cost to the City.

AFFIRMATIVE ACTION PROGRAM FOR EQUAL EMPLOYMENT OPPORTUNITY
Statement of Policy
The Board of Education of the San Bernardino City Unified School District, in compliance with Title
VI and VII of the Civil Rights Act of 1964,Title IX of the Education Amendments of 1972, Sections
503 and 504 of the Rehabilitation Act of 1973,the Age Discrimination in Employment Act of 1967,
the Age Discrimination Act of 1975, the Americans with Disabilities Act of 1990, the federal Family N
and Medical Leave Act, California Family Rights Act and Fair Employment and Housing Act,
reaffirms its policy as an Equal Opportunity/Affirmative Action employer to ensure that all persons U
are provided equal opportunity in employment and education and to prohibit discrimination on the a
basis of race, color, sex, sexual orientation, gender(identity or expression), age, national origin, o
ancestry, marital status, physical disability, mental disability, medical condition, religion, family care
and medical leave entitlement, or veteran's status, and to make reasonable accommodations to the d
physical and mental limitations of qualified individuals with disabilities to the extent feasible.
d
L
The Board recognizes its legal and moral responsibility to society, in general, and specifically to 4)
ensure that progress is being made toward increasing the level of representation of minorities, D
women, and the disabled in the work force with their availability in the labor pool. Therefore, an d
Affirmative Action Employment Program was adopted in 1973 and institutionalized as an ongoing
commitment to ensure that all employment actions such as recruitment, hiring promotions and
placement decisions are made solely on the basis of an individual's merit and qualifications without 0
regard to race, color, sex, sexual orientation, gender(identity or expression), age, national origin, D
ancestry, marital status, physical disability, mental disability, medical condition, religion, family care y
leave entitlement or veteran's status, and all other personnel activities which include, but are not
limited to, benefits, transfers, demotions, training, and upward mobility programs. ti
N
Beyond complying with the letter of the law,the District recognizes that within our pluralistic
society the educational institution has an obligation to promote cultural, racial, and human 2
understanding within the communities it serves. An effective method of achieving this objective is a°
to provide students with a District staff which is reflective of both sexes,as well as multiethnic and 2
cultural characteristics of society. For these reasons, the District will continue to design and develop +
programs and activities to seek out and attract qualified members of"protected groups"which will °
provide us with a broader diversity of personnel and ultimately reach our desired Affirmative Action d
goals where they are underutilized. E
Note: A copy of the Affirmative Action Program Handbook is on file in the Affirmative Action a
Office.
