Synopsis of Previous Council Action: On October 21, 2013, the Common Council set February 4, 2014, as the date for a special election to fill the unexpired term for the Ward Five Council Seat. Background: At the October 21, 2013 Common Council meeting,the MCC was presented with the option of making the special election an all-mail ballot. At that time, Council Member Jenkins asked that the City Clerk investigate the option of a mail ballot,with limited polling places. After conferring with the San Bernardino County Registrar of Voters (ROV), it has become clear to the City Clerk that the city's options are to call a mail-ballot-only election, or a traditional polling place election. If the Council's choice is to conduct a mail-ballot-only election,residents would have the option of mailing their ballot, or dropping it off at City Hall,the Baker Family Learning Center, at 2818 N. Macy Street, or the San Bernardino County ROV, 777 E. Rialto Avenue, San Bernardino. This is consistent with the options that vote-by-mail voters have in the election scheduled for November 5, 2013. This cost was not included in the estimate for the mail-only-ballot election. City Attorney Review: Supporting Documents: Reso A-Special Election Conducted by mail procedure and payment reso 10-30-13 (DOCM) Reso B -Special Election Conducted by polling place procedure and payment reso 10-30-13 (DOOM) I i s 3 Updated: 10/31/2013 by Georgeann"Gigi"Hanna 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 3 BERNARDINO ESTABLISHING THE PROCEDURE FOR CONDUCTING THE 4 SPECIAL ELECTION TO FILL THE VACANCY IN THE FIFTH WARD COUNCIL SEAT FOR TUESDAY, FEBRUARY 4, 2014 AND AUTHORIZING THE 5 PREPAYMENT OF THE COSTS ESTIMATED FOR SAID ELECTION TO THE 6 COUNTY OF SAN BERNARDINO. 7 WHEREAS, on October 21, 2013 the Mayor and Common Council adopted Resolution No. 2013-302 calling a special election to fill the vacancy in the fifth Ward council seat; s 9 WHEREAS, the conduct of the special election conducted as a traditional polling place election combined with any run-off election has been estimated by the San Bernardino County to Registrar of Voters to cost an estimated $250,000; and 11 WHEREAS, the conduct of the special election conducted wholly by mail combined 12 with any run-off election held wholly by mail has been estimated by the San Bernardino County Registrar of Voters to cost an estimated $235,000; 13 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON 14 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 15 SECTION 1. Conduct of Election. The special election called by the Mayor and 16 17 Common Council by Resolution No. 2013-302 shall be held as a traditional polling place 18 election, within such precincts and at such polling places as shall be determined by the City 19 Clerk; The City Clerk is hereby requested to issue instructions to the Registrar of Voters to take 20 all steps necessary for the holding of the special election. The ballots to be used at the election 21 22 shall be in form and content as required by law. 23 SECTION 2. Prepayment of Invoice to County of San Bernardino 24 The City Clerk is hereby authorized to prepay the invoice received from the County of 25 San Bernardino for the services necessary for conducting the special election in an amount not 26 to exceed $250,000. 27 28 4 1 1 SECTION 3. Filing of Resolution.
