The proposed agreement will provide approximately$22,296 in projected rental revenue during
the year. This reflects a $773 reduction in the annual rental revenue. The anticipated revenue
has been included in the FY 2013-2014 budget.

Synopsis of Previous Council Action:
5/21/2012 Resolution No. 2012-88 adopted, authorizing the City Manager to execute a second
amendment to Lease Agreement with the County of San Bernardino for the lease of a
portion of the Delmann Heights Community Center to be used for the Head Start
Program.
10/3/2011 Resolution No. 2011-274 adopted, authorizing the City Manager to execute a first
amended Lease Agreement with the County of San Bernardino for the lease of a
portion of the Delmann Heights Community Center to be used for the Head Start
Program.
9/8/2009 Resolution No. 2009-314, rescinding Resolution No. 2009-300 and authorizing the
City Manager to execute a revised Lease Agreement with the County of San
Bernardino for the lease of a portion of the Delmann Heights Community Center to
be used for the Head Start Program.

Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the
City Manager to execute the Third Amendment to the FAS Standard Contract with the County of
San Bernardino for the lease of a portion of the Delmann Heights Community Center to be used
for the Head Start Program.
At the May 21, 2012, meeting of the Mayor and Common Council, Resolution No. 2012-88 was
adopted authorizing the City Manager to execute a second amended Lease Agreement with the
County of San Bernardino for the lease of a portion of the Delmann Heights Community Center
to be used for the Head Start Program. Under the terms of the revised Lease Agreement, the
County leased 2,160 square feet of classroom and office space at a cost of$0.89 per square foot.
September 1, 2013, marks the fourth year of the lease agreement and the third of five single-year
options to extend. The County and Head Start staff members have been integral partners in
providing exceptional programs and services to the Delmann Heights Community. The original
agreement allowed the Head Start Program to transition from City control to County oversight,
while safeguarding positions, enhancing service delivery, and creating a new revenue stream to
help mitigate Departmental budget reductions. The attached agreement(Exhibit 1) authorizes
execution of the third amendment to the Lease Agreement with the County of San Bernardino.
The County has proposed amendments to the Lease Agreement as outlined in their request letter
"Exercise Option to Extend Term &Proposal" attached hereto.
Pursuant to the amended Lease Agreement, the County is proposing to pay an annual rental fee
of$22,296, or$0.86 per square foot which reflects a reduction of$0.04 per square foot or
$773 per year. The County proposes to continue to fund 36% of the cost of utilities at the
Delmann Heights facility(water, electric,natural gas, refuse and building maintenance). The
estimated amount of utilities reimbursement is $13,900 annually. Staff has also identified
periodic in-kind services such as general facility/grounds maintenance that would be provided by
the County, which will more than offset the $773 lease reduction. As such, the Lease
Agreement, as amended, is of mutual benefit to both the City and the County and is
recommended for approval.

The purpose of.this letter is to formally notify the City of San Bernardino (herein referred tows cc
"LANDLORD") of the County of San Bernardino's intention to exercise one of the three one- -
year options extending the lease term from September 1, 2013 to August 31, 201, for the
above referenced location, while retailing the remaining two one-year option periods.

As reflected in the original Lease Agreement No. 09-830, Paragraph 6, OPTION TO EXTEND
TERM states: "CITY gives COUNTY the option to extend the term of the Lease on the same
provisions and conditions, except for the monthly rent, for five (5)one-year periods ("extended V
terms') following expiration of the Initial Term, by COUNTY giving notice of its intention to
exercise the option to CITY prior to the expiration of the preceding term or during any holding =
over pursuant to Paragraph 8, HOLDING OVER. The rent for each extended term shall be 0
adjusted by good faith negotiation of the parties to the fair market rental rate then prevailing
based upon the rental rates of comparable leased property in San Bernardino County." a

Based on the above, CITY and COUNTY are required to negotiate a new lease rate based on o
the fair market rental rate then prevailing in San Bernardino County. o

In reviewing our files, the County of San Bernardino leases 2,160 square feet of classroom ;,
and office space and 256 square feet of playground area on behalf of the Preschool Services o
Department ("PSD"). PSD administers the Federal Head Start and Early Head Start
programs, California Department of Education State Preschool program, as well as the Child

and Adult Care Food Program in 43 locations throughout the County of San Bernardino. All E

Due to the sequestration that went into effect on March 1, 2013, PSD is experiencing
budgetary challenges. Nevertheless, PSD has a need to continue to provide services in the
San Bernardino area.

Based on Amendment No. 2 to Lease Agreement No. 09-830, the current monthly rental rates M
through August 31, 2013 is $1,922.00 ($0.89 per square foot/Modified Gross)for 2,160 square
feet of classroom and office space.

Based on comparables, the COUNTY is requesting that the LANDLORD approve reducing the
monthly rate effective September 1, 2013 to $1,858.00 ($0.86 per square foot/Modified Gross)
