Funding for the purchase order is included in the Fire Department's FY 2013-2014 Adopted I Budget, account number 001-200-0050-5173 (Outside Vehicle Maintenance) in the amount of $43,820. Funds will need to be transferred from account number 001-200-0050-5173 to account number 001-200-0050-5172 (Equipment Maintenance) in the amount of$43,900 (rounded) for the issuance of a purchase order to Johnson Power Systems. Account Number: 001-200-0050-5172 Budgeted Amount: $16,500 Balance (as of August 7, 2013): $10,880 Balance (after approval of this item): $10,960 (with budget amendment) Please note this balance does not indicate available funding. Synopsis of Previous Council Action: 08/06/07 Resolution #2007-319 authorizing the execution of an Agreement with and purchase order to Pierce Manufacturing Inc. for seven (7) new Pierce fire engines; solicit bids to purchase one utility truck, ancillary equipment and emergency medical services equipment; and authorizing the Finance Director or designee to solicit lease-purchase rate quotes and award a lease-purchase to the lowest responsible leasing company. Background: Updated: 8/15/2013 by Norma Camarena Packet Pg.26 5.d 2641 The Fire Department is requesting authorization to purchase extended service coverage for seven (7) 2008 Pierce Arrow XT fire engines. In 2007, the City purchased seven (7) Pierce Arrow XT fire engines which were equipped with the Caterpillar C-13 Diesel Particulate Filter (DPF) motor. These Caterpillar C-13 DPF diesel motors were provided with a five (5) year warranty which covers all internal and some external engine components as well as fuel injectors and diesel particulate filter after-treatment components. These seven Pierce Arrow XT fire engines are used as frontline fire apparatus for the San Bernardino City Fire Department that incurs a high call volume annually: the high call volume places a high performance demand on the fire apparatus. This translates to excessive wear and tear of the EPA Emissions equipment, which has been effectively covered under the original warranty. The realized savings from the original warranty is approximately $154,558 for all seven(7) engines. The warranty on one (1) of the 2008 Pierce Arrow XT fire engine expired in May 2013 and warranties on five (5) others will expire September 2013. The last one (1) is due to expire March 2014. Johnson Power Systems has agreed to allow extensions on all seven (7) of the warranties, even though one has already expired. The purchase price for the seven (7) warranties was originally quoted for $50,820. However, Johnson Power Systems has agreed to discount $1,000 per fire engine if all seven (7) warranties are purchased at one-time, making the actual cost for the warranties $43,820, with a $250 deductible per vehicle. The extended warranties will cover the seven (7) 2008 Pierce Arrow XT fire engines for an additional seven (7) years or 150,000 miles whichever comes first. Johnson Power Systems is located in Riverside, California and is the San Bernardino/Riverside County authorized dealer of original Caterpillar Corporation parts and service. The next closest Caterpillar dealer, Quinn Company, is in the City of Industry, California; this added distance would result in increased costs for repairs and extend out of service time for the fire apparatus. The extended warranty will allow the necessary means to service the engines and reduce repair costs. Without the extended warranty, the repair cost for parts and labor would exceed the cost of an extended warranty for the fire engines. ("VENDOR") y and the City of San Bernardino ("CITY" or"San Bernardino"). The duration of this Agreement may be extended with the written consent of both parties. 4. INDEMNITY. As part of the foregoing indemnity, Vendor agrees to protect and defend at its own expense, including attorney's fees, the City, its elected officials, employees, agents or E representatives from any and all legal actions based upon such actual or alleged acts or N omissions. Vendor hereby waives any and all rights to any types of express or implied cn indemnity against the City, its elected officials, employees, agents or representatives, with 3 respect to third party claims against the Vendor relating to or in any way connected with the a0 accomplishment of the work or performance of services under this Agreement. _ 0 N 5. INSURANCE. 0 While not restricting or limiting the foregoing, during the term of this Agreement, o VENDOR shall maintain in effect policies of comprehensive public, general and automobile liability insurance, in the amount of$1,000,000.00 combined single limit, and statutory worker's compensation coverage, and shall file copies of said policies with the CITY's Risk Manager o CD prior to undertaking any work under this Agreement. CITY shall be set forth as an additional named insured in each policy of insurance provided hereunder. In the performance of this Agreement and in the hiring and recruitment of employees, d VENDOR shall not engage in, nor permit its officers, employees or agents to engage in, E discrimination in employment of persons because of their race, religion, color, national origin, L ancestry, age, mental or physical disability, medical condition, marital status, sexual gender or Q sexual orientation, or any other status protected by law. as 7.
