Prior to the reductions in staff necessitated by the approaching bankruptcy the city had seven full-time, permanent legal secretaries. Given the increased work-load due to the pending bankruptcy case this position needs to be filled. Paul Williams The City currently has ten part-time City Attorney Investigators. Each is paid an hourly wage of $32.00 per hour, and they do not receive benefits. There is also one Supervising City Attorney Investigator, retired San Bernardino County Undersheriff Robert Peppler. These retired peace officers have temporary peace officer powers through Penal Code §836.5 and San Bernardino Municipal Code §9.90.010. Their duties include investigating violations of the San Bernardino Municipal Code, assisting in the preparation of the City's defense of lawsuits filed against the City, investigating suspected misconduct of City officials and employees at the request of, or upon assignment by, the appropriate City official; preparing cases for prosecution for violations of the Narcotics Abatement Act, the Nuisance Abatement Act and the Red Light Abatement Act; and investigating alleged violations of the California Political Reform Act pursuant to Government Code §91001.5. In addition, City Attorney Investigators staff the Transient Merchant Patrol seven days a week and provide security at City Council meetings. Finally, the City Attorney Investigators continue to be the City's primary enforcement arm on bank foreclosures and absentee landlords, thus serving as the backbone for the City's Administrative Civil Penalties ordinance. As of July 1, 2013, the total amount of Administrative Civil Penalties (ACPs) collected for fiscal year 2012/2013 was $887,803.20. City Attorney Investigators were responsible for$527,548.44 of that amount which was 59.42% of the total amount collected in ACPs from July 1, 2012 through June 30, 2013. Code Enforcement Officers brought in $282,074.92 of the $887,803.20 collected, which was 31.77% of the total collected, followed by Fire Department penalties of$64,463.65, which was 7.26% of the total collected through May 31. The remaining 1.55%was brought in from ACPs issued by Police Officers ($7,616.19), Public Works Inspectors ($5,000), Animal Control Officers ($770)and the City Clerk's Office ($330). See attachment. 3 � Mayor and Common Council July 26, 2013 Page two For the FY 2012/2013, wages paid out to the ten part-time City Attorney Investigators totaled $193,334.00 through June 30, 2013 (per Finance Department, 7/1/13). Given the $527,548.44 collected through June 30, 2013 as a result of ACPs issued by City Attorney Investigators the penalties actually received exceeded the wages actually paid out by $334,214.44. Currently, two City Attorney Investigators are on unpaid leave from their hourly wage positions. In order to meet the workload demand for these investigators, we respectfully request that the Mayor . . q y and Common Council authorize the hiring of two additional itional mdivi duals g as part-time City Attorney Investigators, bringing the total number of individuals authorized to twelve. Since these Investigators are only paid for hours actually worked, and since there is a current fiscal year budgeted amount for all of the part-time Investigators of$285,160.00, no additional funding is requested or required. The two additional Investigators will only be assigned to work as currently funded within the fiscal year 2013/2014 City Attorney budget. The first of the two additional Investigators for which we are requesting the approval of the Mayor and Common Council is retired San Bernardino Police Department Sgt. Michael Hudson. Sgt. Hudson retired after more than 28 years with the San Bernardino Police Department. His retirement was a regular one and was not a medical retirement. If approved, Mr. Hudson will be eligible for hourly assignments commencing August 6, 2013, and he will be paid the standard $32.00 per hour. He will not be paid benefits, except Unemployment and Medicare, as required by law. Again, no additional funding is requested or needed to hire Mr. Hudson as a part-time City Attorney Investigator. The Transient Merchant Patrol assignment on Fridays is currently from 7:30 a.m. until 8:00 p.m. and on Saturdays and Sundays from 12 noon until 8:00 p.m. If the two additional appointments are approved as requested, we plan to extend the Transient Merchant Patrol on Fridays from 7:30 a.m. until 10:00 p.m., and on Saturdays and Sundays from 12 noon until 10.00 p.m. This extension is in response to requests from citizens and Council Members who want to have Investigators available later hours than is presently feasible. The proposed extension will commence the weekend of Friday, August 30 through Sunday, September 1, 2013 and will continue for most weekends and holidays thereafter, subject to absences, special assignments, etc. R pectfully submitted, J es F.
