Synopsis of Previous Council Action:
Background:
The Premises located south of Sixth Street between "E" Street and"F" Street in the City
of San Bernardino (the "Premises") is owned by the City of San Bernardino and has a long
history of being used for public purposes, including as a City public park, and most recently has
been known as "Pioneer Park." In addition to being known as "Pioneer Park,"the City's Norman
F. Feldheym Central Library has been located on the Premises since 1985. Due to many factors,
the Premises has become overridden with crime and uisance activity, creating a threat to the
health and safety of City residents. This action comes at the request of the Library Board of
Trustees,through work with the police department, in an effort to combat those crime and
nuisance activities that have plagued the Feldheym Library patrons and staff for many years.

SECTION 1: Any and all previous actions by the Mayor and Common Council

San Bernardino as "Pioneer Park"or as a City park are hereby rescinded. The Premises shall no =

longer be known as "Pioneer Park" and shall no longer be open to the public for use as a public o

SECTION 2: The City Manager is hereby authorized and directed to remove any and v

all references to "Pioneer Park" from any signs, maps, lists, rosters, brochures, pamphlets, etc.

The Police Department has worked with the Library staff over the last several years to Y
deal with problems associated with the property outside of the Feldhym Library. The
problems mainly center around issues created by the homeless population who tend to a
congregate on the grounds. Problems include many nuisance type issues such as o
urinating/defecating in public, vandalism, panhandling, harassing customers, etc. There o
have been several efforts to clean up the area; to include physical changes such as the
removal of the fountain structure in front of the building and transferal of the security aM
contract form Public Works to the Police Department. Although there has been some o
improvement,the problems persist at an unacceptable level. o
Over the years, one hindrance to our effort has been the ability to move the transient
population away from the shady grass areas that surround the building. The area around N
the library has been designated as a City Park. Therefore, we have been unable to °o
enforce loitering or trespassing codes and people refuse to leave the area. It is not illegal Ni
to sit in a park or lay on a blanket etcetera. Our experience has shown those people who
take advantage of the area and congregate in the grass often commit low level crimes that °
greatly affect the users and staff of the library. The Police Department believes we can o
be more effective keeping people out of those areas to begin with which will result in a E
reduction of the issues affecting the guests and staff.
Our recommendation is to remove the legal designation as a City Park so we can post a
signs and ultimately keep people from congregating in the areas where we are having
problems. We would use the private security officers supported by our police officers to
enforce the loitering code and move people away from the library. t
