Synopsis of Previous Council Action:
04/19/10 Resolution No. 2010-076 was adopted approving a Consultant Services
Agreement with Willdan for design of a Traffic Signal at Route 210 westbound
Waterman Avenue off-ramp at 30th Street (TC08-09).
05/20/13 Resolution No. 2013-093 adopted awarding a contract to Siemens Industry, Inc.
for Traffic Signal installation at 30th Street and the 210 Freeway(Westbound Exit
Ramp for Waterman Avenue),per Plan No. 12894 (TC08-009).
Background:
On April 19, 2010, the Mayor and Common Council adopted a resolution approving a Consultant
Services Agreement with Willdan for design of a traffic signal at Route 210 westbound
Waterman Avenue off-ramp at 30th Street (TC08-09).
The design was completed and the traffic signal was advertised for bids. A contract for the work
was awarded to the lowest bidder, Siemens Industry, Inc., in the amount of$159,995.00 on May
20, 2013. Construction is expected to begin in June 2013 and be completed by the end of
December 2013.
Staff is recommending that Willdan be retained for design support through the end of

construction. Willdan has submitted the attached proposal, dated May 22, 2013, offering to
provide on-call design support during construction and concurring with an extension of time
through December 31, 2013. This support will consist of assistance with change orders,
interpretation of plans, recommendations regarding equipment/materials and advice regarding
testing/operation. Correction of errors or omissions to the plans and specifications will not be an
allowed cost. The cost of these services is estimated to be less than $5,000.00.
Please note that the entire amount of the cost for this project, including these services, will be
reimbursed by SANBAG under the Local Stimulus Program (LSP).

C. WHEREAS, on May 20, 2013 a construction contract was awarded to Siemens 3
Industry, Inc. for installation of the traffic signal at Route 210 westbound waterman Avenue
off-ramp at 30th Street(TC08-009); and

D. WHEREAS, said Services Agreement with Consultant as approved on April 19,
2010 expired on December 31, 2011; and
E. WHEREAS, City wishes to retain Consultant's services to provide design support
during construction; and F

F. WHEREAS, Consultant represents that it has that degree of specialized expertise
contemplated within California Government Code, Section 37103, and holds all necessary o
licenses to practice and perform the services herein contemplated; and w

G. WHEREAS, City and Consultant desire to contract for specific services in connection
with the project and desire to set forth their rights, duties and liabilities in connection with a

H. WHEREAS, no official or employee of City has a financial interest, within the
provisions of California Government Code, Sections 1090-1092, in the subject matter of this '

2.0. COMPENSATION AND BILLING

Section 2.1. "Compensation" is hereby amended to add the following: Consultant
shall be compensated for on-call support during construction on a time and material basis, o
based on Consultant's current rate schedule, a copy of which is attached hereto as 2
Attachment "B" and made a part hereof. Cost of correcting the plans due to errors or
omissions by the Consultant shall not be billable. The total reimbursement for this additional w
service shall not exceed $5,000.00

Section 4.1. "Term" is hereby amended to add the following: The term of said
Consultant Services Agreement is hereby extended retroactively from December 31, 2011 to 0
December 31,2013.

Industry, Inc. under a Caltrans Encroachment Permit. Willdan will provide the City of San
Bernardino assistance during the construction process, to include but not limited to, inquiries, Q
