Background:
Various agencies within the City of San Bernardino issue parking citations for vehicle code and
municipal code violations to include section 5204 of the California Vehicle Code (CVC), which
mandates a current registration year tab be displayed on the rear plate of all vehicles. These
citations are issued by employees of the police department, fire department, code enforcement,
and city attorney investigators. Parking citations are processed through the city, rather than

through the courts, like a regular moving violation citation.
In 2012 the Phoenix Group, which currently processes our parking citations, reported that San
Bernardino city employees issued 9,235 citations for the violation of CVC 5204. This indicates
that there are a large number of vehicles parked on our city streets that are not currently
registered through the California Department of Motor Vehicles (DMV). Often times, people
fail to register their vehicles in an attempt to avoid paying the yearly registration fees or the state
taxes, which are required when a vehicle changes ownership. Unregistered vehicles are
commonly associated with blight in our residential neighborhoods. Citations issued for the
violation of CVC 5204 are handled similarly to a "fix-it" ticket, which means the registered
owner of the vehicle is afforded the opportunity to pay a reduced fine if he/she corrects the
violation,which,in this case, entails obtaining current vehicle registration through the DMV.
The fine currently charged by the City of San Bernardino for this violation is set at$58.00. This
fine was increased from $55.00 under Resolution 2010-373, which was adopted 11/17/10. Of
the 9,235 parking citations issued in 2012 for CVC 5204, only 5,072 have been paid as of
05/31/13; see Exhibit "D". There are still 4,163 citations open, all of which have had liens
placed on the registration of the vehicles to which they were issued. These fees will be collected
by the DMV when the registered owner pays his/her required annual vehicle registration. 1,303
of these citations were reduced to a fine of $10 because the payment was accompanied with
proof of correction. Because there were also late fees assessed on many of these citations, the
city collected $14,491 on these corrected citations. 3,769 citations issued for CVC 5204 were
paid at full fine amount, some of which had late fees assessed, resulting in a total collection of
$277,425.
A survey of local agencies revealed that San Bernardino has one of the lowest fine amounts for
the violation of CVC 5204 in this area. See attached Exhibit "A" for a list of local agency fees
for this violation and Exhibit "B" for copies of local agencies' parking citations. CVC 40203.5
requires the schedule for parking penalties for parking violations and late payment penalties be
established by the governing body of the jurisdiction where the notice of violation is issued, and
to the extent possible, issuing agencies in the same county are to standardize penalty amounts.
The bail schedule for the violation of CVC 5204 set by the San Bernardino County Superior
Court is currently$197.
Bail amounts are preprinted on our parking citations in duplicate form. The police department
currently has a low stock of parking citations and needs to place an order for more citations in
the near future. If the fine amount for CVC 5204 violations is raised, staff recommends an
increase to the fee schedule on all parking violations in order to remain consistent, as well as to
combat blight on our city streets. It would be financially beneficial to make any necessary fee
changes to the parking citations prior to placing an order so that all employees that issue these
citations do so with accuracy.
The City of Redlands recently raised all fines for parking violations due to the large amount of
repeat offenders. They found that violators chose to park their vehicles in violation of state and
local ordinances because it was more convenient to pay the low fine than to find a lawful place to
park. Current fines for several violations in the City of San Bernardino are on the lower end
compared to the City of Redlands and other cities. Staff recommends an increase to the fine for
CVC 5204 of 42%, from the current fine amount of $58 to $90, while raising fines on the
remaining parking violations by only 25%. The current fine for most other parking violations is
currently set at $43. A 25% increase would raise that fine amount to $54, which is below the

fine schedule recently adopted by the City of Redlands; see attached Exhibit "C" for San
Bernardino's current fine schedule. These increases would be well within the boundaries as
required by law under CVC 40203.5.
When a vehicle is issued a parking citation for violation of CVC 5204 or CVC 5200, the vehicle
owner, or his/her designee, is given 21 days to provide proof of correction for that particular
violation. If the owner provides proof of correction within 21 calendar days, the fine is reduced
to $10. This fine will remain the same as required by CVC 40225(c). This means the only
people affected by the increase in the fine for CVC 5204 or CVC 5200 are those cited that fail to
correct the violation within 21 days of receiving the citation.
Financial Impact:
The exact financial impact for this proposal cannot be determined because we do not know the
number of citations that will be issued nor can we forecast which of the issued citations will be
paid in full, at a reduced amount, or with late penalties assessed. Many citations are not paid in a
timely manner and are collected by the DMV at a later time when the vehicle owner registers
his/her vehicle. When parking citations are not paid within 45 days, there is an additional fee
added to the fine for a late charge. Based on the statistics noted above for citations issued in
2012 for the violation of CVC 5204, if city personnel issue the same number of citations for this
violation and the same number of people fail to provide proof of correction to reduce the fine,the
city will see an approximate increase in revenue of $253,824 annually. This amount was
calculated based on 9,235 citations issued and 7,932 failing to correct the violation and pay fees
within the required 21 days.
