Funds for the purpose will be included in the Department's 2013-2014 Budget in Account Number 001-380-000-5502. Motion: Authorize the City Manager's Office to issue a Request for Qualifications/Bids for Maintenance of the City's Park System. Synopsis of Previous Council Action: This item was first considered on October 15,2012 to address park and maintenance cost issues contained in the August 29, 2012, Pre-Pendency Plan. At that time, the City Council was not able to authorize issuance of the Request for Proposals because the bid process was considered not specific enough to the City's landscape maintenance needs. The City Manager's Office reviewed Public Works'proposed process and consulted extensively with the Park Division and determined that a two step procurement process where in the City pre-qualifies potential firms and then engages those firms in a detailed bid process will return the most accurate bid costs. Background: The annual contract for parks and landscape maintenance for the City of San Bernardino has been prepared for maintenance of all parks, medians and parkway. The City has 38 parks and 57 lawn area it maintains, approximately 500 acres of open space. Key Personnel for the Prospective Bidder shall be committed to the Project for the entire term of the contract and have the ability to make adjustments to the maintenance operation on-site. 3. Prospective Bidder must be able to receive e-mails from the City and respond with 48 hours. 4. The City reserves the right not to award a contract as a result of this request. Transmittal Letter Transmittal Letter shall name the proposed Prime Contractor, its legal structure (i.e., corporation, partnership, limited partnership, joint venture). If a joint venture or partnership is proposed, Prospective Bidder shall identify partners and/or members of the joint venture and their roles and responsibilities. Prospective Bidder shall state that the Key Personnel listed in the SOQ will be used for the Project and that no substitutions will be allowed without the City's consent. 2. Table of Contents Prospective Bidder shall provide a table of contents for its SOO submission, identifying the entire contents of its SOO submission. The SOO submission shall be stapled or otherwise bound and clearly labeled and shall contain labeled dividers for each component of the SOO submission. The SOQ should not exceed 30 pages excluding dividers. The SOO need not be overly ornate in design or presentation, Prospective Bidder should use the most effective method for conveying the merits of its firm. 3. Questionnaire The completed Statement of Qualification Questionnaire (attached hereto) is a requirement for the SOO package. Any submission which does not include a completed Statement of Qualification Questionnaire will be considered incomplete. Prospective Bidder will not be given additional time the deadline to complete any component of this process. Prospective Bidder is required to ensure its answers are accurate and thorough. Prospective Bidder shall include any documents necessary to support the questionnaire. 4. Resume of Proposed Key Personnel Prospective bidder shall provide resumes for each of the Key Personnel (supervisor and irrigation technicians and higher) that will be committed to the Project for the entire term of the contract. Capability to Provide Required Performance and Payment Bonds Prospective Bidder shall include a letter from a surety duly licensed to do business in the State of California, having a financial rating from A.M. Best Company of A-, VII or better that the surety has agreed to provide Prospective Bidder with the required performance and labor and materials payment bonds in accordance with the Invitation for Bids. Prospective Bidder shall include a statement authorizing the City to contact the named City of Suisun surety and verify that the surety will, based upon the estimated construction costs contained herein, issue the required bonds under the conditions stated. 6. Ability to Provide the Required Insurance Prospective Bidder shall provide a letter from its insurance broker/agent or underwriter and/or certificates of insurance, confirming that Prospective Bidder can obtain the required insurance coverages and amounts specified in section "Insurance" from insurer(s) having a financial rating from A.M. Best Company of A-, VII or better. Prospective Bidder may redact renewal dates from certificates of insurance submitted for the SOQ. However, renewal dates may not be redacted from certificates of insurance provided by the successful Bidder upon award of the contract for the Project. 7. Litigation History Description of Prospective Bidder's litigation history for the past five (5) years, including names of involved parties, nature of dispute, and disposition for each instance. Furnish all labor, materials, tools, equipment, supervision, and transportation required to maintain the Parks in an attractive condition throughout all seasons of the year. This includes the formal Park grounds, all amenities in the Park, the slope easements, and trail entrances into the Park. 2. Ball Fields shall be raked and clean at all times. Irrigation system is to irrigate all areas properly to care for all areas. 3. The contractor shall have full control over ensuring water requirements are met. All main water line repairs are included in the contract price and no additional compensation shall be allowed. 4. Contractor shall be responsible for maintaining and repairing the entire irrigation system starting at the meter connection. This coverage applies to all controllers, backflows, remote control valves, gate valves, main and lateral lines, sprinkler heads, and moisture sensing devices. The maintenance and repair work described in this Scope of Work shall be performed as a continuous and constant program throughout the term of the contract. This includes spring and fall soil aeration and over-seeding as well as seasonal grub control. 5. All weeds shall be removed. 6. Nutrient care standards within parks are as required to promote good growth with not less than the following: ground cover areas three applications per year at appropriate spread rate and trees and shrubs one application per year for areas outside ground cover area. 7. Lawn care standards are not less than the following: aeration once per year, mowing weekly to height at 2 and '/Z inches to 3 inches removing excess clippings, be courteous and mindful of park users, edging twice monthly, blown free of all clippings, raking leaves as needed, trim trees once during term of contract and pruning following ISA pruning standards, spraying and weeding to control weeds and disease. 8. Contractor is to provide complete and continuous control and/or eradication of all rodents in an appropriate manner, in accordance with all laws and regualtions. 9. With regard to general maintenance within parking areas (e.g., Metrolink facility), contractor is expected to keep areas free and clear of litter, broken glass, or other debris. Parking lot areas shall be cleaned twice a week. 10.All trash containers shall be inspected weekly and emptied. No trash cans shall have foul odors. 11.Sidewalks and pathways and surfaces shall be policed and cleaned once each week. 12.Restrooms shall be cleaned daily, water closets scrubbed, and graffiti removed. 13.Tissue and paper products shall be checked and refilled daily. 14.Contractor is to maintain all equipment and supplies required to maintain restrooms in clean and orderly manner. 15.Contractor shall keep toilets, sinks, and drinking fountains clean and operational 16.at all times. This shall include unplugging of toilets, sinks and drinking fountains. 17.Restrooms are to be open and closed daily, pursuant to the hours established by the Mayor and Common Council. 18.All graffiti in park areas or parking areas is to be abated by the Contractor. 19.Tot Lots and Play areas are to be cared for by the Contractor. 20.Playground areas, and skate areas shall be kept free of weeds, graffiti, litter and debris, such as broken glass or any other objects on a daily basis. Repairs to play equipment above under $500 shall be the responsibility of the Contractor. 21.Tables, benches, BBQ grills, gazebos, or pits shall be maintained in safe manner by the contractor. Sports fields including tennis courts, volleyball courts, soccer fields, horseshoe pits, handball, and tetherball courts shall be maintained and repaired by the Contractor. 22.Contractor is responsible for graffiti abatement on courts. Flower beds, shrubs, and ground cover shall be healthy and trimmed, pruned, or otherwise to maintain healthy and attractive landscape. 29.Contractor is to monitor and maintain Seccombe Lake pH levels and add chemicals and/or nutrients to keep lake in proper pH balance. 30.Trail areas shall be kept weed-free. Trail surfaces shall be maintained so that the surface is smooth with no depressions or ruts. Trail surfaces shall be leveled as needed to remove soil depression or erosion areas created by weather conditions and public use. 31. Baseball fields at Perris Hill Park where California State University San Bernardino baseball team plays its home games must be cared, maintained, and prepared to NCAA rule standards. 32.Turf, edging, mound height, and all aspects of field must be maintained in order to comply with all rules related to field maintenance during the regular baseball season and into playoffs if necessary. 33.The cemetery requires two full time staff dedicated to maintenance at the site. In the event of a burial service, two additional staff will be required as needed at the site. 34.Any additional work not described in this Scope of Work shall be performed by the Contractor upon written notice from and at the expense of the City of San Bernardino. Best Rating: **END OF QUESTIONAIRE** Denial of Pre-Qualification A Prospective Bidder who is denied pre-qualification may appeal the City for reconsideration as follows: Upon request of the Prospective Bidder, the public entity shall provide notification to the Prospective Bidder in writing of the basis for the Prospective Bidder's disqualification and any supporting evidence that has been received from others or derived as a result of examinations by the City. The Prospective Bidder shall be given five (5) calendar days to rebut any evidence used as a basis for disqualification and to present written evidence to the City as to why the Prospective Bidder should be found qualified. The Prospective Bidder may request in writing, with the submission of written rebuttal in paragraph 4 above, to request an informal hearing with the Public Works Superintendent. The Public Works Superintendent will consider all evidence presented and render a determination on the disposition of the Prospective Bidder's pre-qualification status. The Public Works Superintendent's determination on the appeal will be final.
