(#2447) Current Business Registration Certificate: Not Applicable Financial Impact: The total assessment of$2,208,153.76 pays the City's maintenance, operation and incidental costs for the various districts. If the assessments are not approved,the City will not be reimbursed for the costs. The general benefit amount of$27,943.54 from various districts as shown on the attached report, will not be reimbursed from the Assessment Districts for FY 2013/2014, as these amounts are determined to be general benefit and therefore not assessable, and will be paid for from the General Fund. Assessment deficits for sixteen Districts, as set forth below, total $118.752.49. I RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2013/2014 ASSESSMENT ROLL FOR 3 ASSESSMENT DISTRICT NO. 1043, ZONE 1 AND ZONE 2, LANDSCAPING 4 MAINTENANCE DISTRICT, PALM AVENUE AND IRVINGTON AVENUE AREA. 5 WHEREAS, by Resolution No. 2005-409, the Mayor and Common Council found 6 that the public interest, convenience, and necessity required the formation of a landscaping 7 maintenance district; and 8 WHEREAS, by said Resolution No. 2005-409, the Mayor and Common Council 9 formed an assessment district known as Assessment District No. 1043,Zone 1 and Zone 2, for M 10 0 11 the purpose of providing landscaping maintenance in the Palm Avenue and Irvington Avenue Q 12 area pursuant to the provisions of Chapter 12.90 of the San Bernardino Municipal Code; and V N 13 WHEREAS,by Resolution No. 2005-340,the Mayor and Common Council declared 0 14 that all the land included within the boundaries of said district receive a special benefit by the a MOW 15 maintenance of said landscaping except for those portions, if any, set forth as a General 16 0 17 Benefit in the Engineer's Report approved by said Resolution No. 2005-409, on file in the w 18 Office of the City Clerk and the City Engineer of said City; and E 19 WHEREAS, said Resolution No. 2005-340, declared that an annual assessment shall w 20 a be levied on all land within the district to provide funding for said landscaping and 21 maintenance and the administration thereof; and 22 23 WHEREAS, an Assessment Roll has been prepared totaling $3,059.42 for Zone 1 24 and$11,667.28 for Zone 2,which sets forth the individual assessments to be levied on each of 25 the parcels of land within Assessment District No. 1043, Zone 1 and Zone 2, for the fiscal 26 year 2013/2014; and 27 28 1 0acket-ft.569 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 1 CONFIRMING THE 2013/2014 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1043, ZONE 1 AND ZONE 2, LANDSCAPING MAINTENANCE DISTRICT, PALM AVENUE AND 2 IRVINGTON AVENUE AREA. 3 4 WHEREAS, the Assessment District was created pursuant to the provisions of 5 Article XIII D of the California Constitution, which provides for the levying of annual 6 assessments without the necessity of following the assessment ballot procedures as long as 7 said assessments do not exceed any prior approved assessment or the methodology of 8 applying assessments is not changed or rates are not increased. 9 _ BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE M 10 � CITY OF SAN BERNARDINO AS FOLLOWS: 11 a 12 SECTION 1. That the Mayor and Common Council do hereby find and determine that N_ 13 the assessments as set forth on said Assessment Roll No. 1043, Zone 1 and Zone 2, comply M 0 (aw 14 with the procedural requirements of Article XIII D of the California Constitution without the a 15 necessity of following the assessment ballot procedures as set forth therein, o w 3 16 SECTION 2. That the Mayor and Common Council do hereby find and determine that 17 the proportionate costs to be levied against the parcels of land within Assessment District 18 19 No.1043,Zone 1 and Zone 2, are correctly set forth on Assessment Roll No. 1043, Zone 1 and r a 20 Zone 2, for the fiscal year 2013/2014, on file in the office of the City Clerk of the City of San 21 Bernardino, and do hereby confirm said assessments. 22 SECTION 3.
