(#2440) Current Business Registration Certificate: Not Applicable Financial Impact: The total assessment of$2,208,153.76 pays the City's maintenance, operation and incidental costs for the various districts. If the assessments are not approved,the City will not be reimbursed for the costs. The general benefit amount of$27,943.54 from various districts as shown on the attached report,will not be reimbursed from the Assessment Districts for FY 2013/2014, as these amounts are determined to be general benefit and therefore not assessable, and will be paid for from the General Fund. Assessment deficits for sixteen Districts, as set forth below, total $118.752.49. Motion: Adopt the Resolution. OTF Q7 U Rf Q Packet Pg. 533 i RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2013/2014 ASSESSMENT ROLL FOR 3 ASSESSMENT DISTRICT NO. 1036, LANDSCAPING MAINTENANCE DISTRICT, 4 NORTHPARK BOULEVARD AND CAMPUS PARKWAY AREA. 5 WHEREAS, by Resolution No. 2005-59, the Mayor and Common Council found 6 that the public interest, convenience, and necessity required the formation of a landscaping 7 maintenance district; and 8 WHEREAS, by said Resolution No. 2005-59, the Mayor and Common Council 9 formed an assessment district known as Assessment District No. 1036 for the purpose of M 10 ° T providing landscaping maintenance in the Northpark Boulevard and Campus Parkway area, a 11 .. ° 12 pursuant to the provisions of Chapter 12.90 of the San Bernardino Municipal Code; and N 13 WHEREAS, by Resolution No, 2005-36, the Mayor and Common Council declared 14 that all the land included within the boundaries of said district receive a special benefit by the a 15 0 maintenance of said landscaping except for those portions set forth as a General Benefit in the 16 y 17 Engineer's Report approved by said Resolution No. 2005-59, on file in the Office of the City W w c 18 Clerk and the City Engineer of said City; and °' E s 19 WHEREAS, said Resolution No. 2005-36, declared that an annual assessment shall Q 20 be levied on all land within the district to provide funding for said landscaping maintenance 21 and the administration thereof, and 22 23 WHEREAS, an Assessment Roll has been prepared totaling $225,890.68, which sets 24 forth the individual assessments to be Ievied on each of the parcels of land within Assessment 25 District No. 1036 for the fiscal year 2013/2014; and 26 WHEREAS, the Assessment District was created pursuant to the provisions of 27 Article XIII D of the California Constitution,which provides for the levying of annual 28 i Packet Pg.534 i 5.BE.b 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2013/2014 ASSESSMENT ROLL FOR ASSESSMENT DISTRICT NO. 1036, LANDSCAPING MAINTENANCE DISTRICT, NORTHPARK BOULEVARD AND CAMPUS 2 PARKWAY AREA. 3 4 assessments without the necessity of following the assessment ballot procedures as long as 5 said assessments do not exceed any prior approved assessment or the methodology of 6 applying assessments is not changed or rates are not increased. 7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 8 CITY OF SAN BERNARDINO AS FOLLOWS. 9 SECTION 1. That the Mayor and Common Council do hereby find and determine that 10 the assessments as set forth on said Assessment Roll No. 1036 comply with the procedural a 11 .. requirements of Article XIII D of the California Constitution without the necessity of 12 N 13 following the assessment ballot procedures as set forth therein.
