(#2415) Current Business Registration Certificate: Not Applicable Financial Impact: The total assessment of$2,208,153.76 pays the City's maintenance, operation and incidental costs for the various districts. If the assessments are not approved,the City will not be reimbursed for the costs. The general benefit amount of$27,943.54 from various districts as shown on the attached report, will not be reimbursed from the Assessment Districts for FY 2013/2014, as these amounts are determined to be general benefit and therefore not assessable, and will be paid for from the General Fund. Assessment deficits for sixteen Districts, as set forth below, total $118.752.49. Motion: Adopt the Resolution. W rl N N W m OJ \ zo 0 0 p W D 0 - - u A 9211' Q 82.35' T23'82.27' 8244' - 82.44' / n 2.16' ez. al' .3e' ez. .n' DISTRICT BOUNDARY 707.15' LINE mm m n co N pW W p ry Packet Pga 3$2 QRESOLUTION NO. � 1 a 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CONFIRMING THE 2013/2014 ASSESSMENT ROLL FOR 3 ASSESSMENT DISTRICT NO. 991, LANDSCAPING MAINTENANCE DISTRICT, 4 VERDEMONT DRIVE AND OLIVE AVENUE AREA. 5 WHEREAS, by Resolution No. 89-330, the Mayor and Common Council found that 6 the public interest, convenience, and necessity required the formation of a landscaping 7 maintenance district; and 8 WHEREAS, by said Resolution No. 89-330, the Mayor and Common Council 9 formed an assessment district known as Assessment District No. 991 for the purpose of M 10 providing landscaping maintenance in the Verdemont Drive and Olive Avenue area, pursuant a 11 •• Ln 12 to the provisions of Chapter 12.90 of the San Bernardino Municipal Code; and CD 13 WHEREAS, by Resolution No. 89-253, the Mayor and Common Council declared o i 14 that all the land included within the boundaries of said district receive a special benefit by the o 15 maintenance of said landscaping; and o 16 17 WHEREAS, said Resolution No. 89-253 declared that an annual assessment shall be as E 18 levied on all land within the district to provide funding for said landscaping maintenance and r 19 the administration thereof; and a 20 WHEREAS, an Assessment Roll has been prepared totaling $26,600.88, which sets 21 forth the individual assessments to be levied on each of the parcels of land within Assessment 22 23 District No. 991 for the fiscal year 2013/2014; and 24 WHEREAS, Article XIII D of the California Constitution requires that any and all 25 Assessment Districts existing on the effective date of said Article XIII D shall comply with 26 the procedural and approval process as set forth in Section 4 of said Article XIII D, except as 27 set forth in Section S therein. 28 i Packet Pg 383 1 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CONFIRMING THE 201312014 ASSESSMENT ROLL FOR 2 ASSESSMENT DISTRICT NO. 991, LANDSCAPING MAINTENANCE DISTRICT, VERDEMONT DRIVE AND OLIVE AVENUE AREA. 3 4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 SECTION 1. That the Mayor and Common Council do hereby find and determine that 7 the assessments as set forth on said Assessment Roll No. 991 are hereby exempt from the 8 procedural and approval requirements of Article XIII D of the California Constitution, as 9 provided for under Section 5(b) of said Article XIII D, and that the assessment amounts as set 10 forth on said Assessment Roll are equal to or less than any prior approved assessments. o Q 11 SECTION 2. That the Mayor and Common Council do hereby find and determine that T_ 12 N the proportionate costs to be levied against the parcels of land within Assessment District No. r 13 o 14 991 are correctly set forth on Assessment Roll No. 991, for the fiscal year 2013/2014, on file a 15 in the office of the City Clerk of the City of San Bernardino, and do hereby confirm said 16 assessments. d 17 SECTION 3.
