Resolution of the Mayor and Common Council of the City of San Bernardino Confirming the
2013/2014 Assessment Roll for Assessment District No. 962, Sewer Lift Station Maintenance
District, Pine Avenue Area. (#2405)

Financial Impact:
The total assessment of$2,208,153.76 pays the City's maintenance, operation and incidental
costs for the various districts. If the assessments are not approved, the City will not be
reimbursed for the costs. The general benefit amount of$27,943.54 from various districts as
shown on the attached report,will not be reimbursed from the Assessment Districts for FY
2013/2014, as these amounts are determined to be general benefit and therefore not assessable,
and will be paid for from the General Fund. Assessment deficits for sixteen Districts, as set forth
below,total$118.752.49.
Motion: Adopt the Resolution.

2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO CONFIRMING THE 2013/2014 ASSESSMENT ROLL FOR
3 ASSESSMENT DISTRICT NO. 962, SEWER LIFT STATION MAINTENANCE
4 DISTRICT,PINE AVENUE AREA.
5 WHEREAS, by Resolution No. 84-523, the Mayor and Common Council found that
6 the public interest, convenience, and necessity required the formation of a sewer lift station
7 maintenance district; and
8 WHEREAS, by said Resolution No. 84-523,the Mayor and Common Council formed
9
10 an assessment district known as Assessment District No. 962 for the purpose of providing R
11 maintenance of a sewer lift station in the Pine Avenue area, pursuant to the provisions of Q

12 Chapter 12.90 of the San Bernardino Municipal Code; and N
13 WHEREAS, by Resolution No. 84-487, the Mayor and Common Council declared
14 a
that all the land included within the boundaries of said district receive a special benefit by the
15 °
maintenance of a sewer lift station; and c

17 WHEREAS, said Resolution No. 84-487 declared that an annual assessment shall be

18 levied on all land within the district to provide funding for said maintenance of a sewer lift
w
19 station; and a
20 WHEREAS, by Resolution No. 87-7, the Mayor and Common Council declared that
21
the public interest and necessity required the amendment of the boundaries of the District by
22
23 expanding the boundaries thereof to include additional territory in the District; and
24 WHEREAS, an Assessment Roll has been prepared totaling $14,059.95, which sets
25 forth the individual assessments to be levied on each of the parcels of land within Assessment
26 District No. 962 for the fiscal year 2013/2014; and
27 WHEREAS,Article X1I1 D of the California Constitution requires that any and all

4 Assessment Districts existing on the effective date of said Article X111 D shall comply with the
5 procedural and approval process as set forth in Section 4 of said Article XIll D, except as set
6
forth in Section 5 therein.

8 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. That the Mayor and Common Council do hereby find and determine that
10
11 the assessments as set forth on said Assessment Roll No. 962, are hereby exempt from the LO

12 procedural and approval requirements of Article X111 D of the California Constitution, as N.

13 provided for under Section 5(a) of said Article X111 D, and that the assessment amounts as set
14 forth on said Assessment Roll are equal to or less than any prior approved assessments.

SECTION 2. That the Mayor and Common Council do hereby find and determine that 0

the proportionate costs to be levied against the parcels of land within Assessment District No.
17

18 962 are correctly set forth on Assessment Roll No. 962, for the fiscal year 2013/2014, on file in
19 the office of the City Clerk of the City of San Bernardino, and do hereby confirm said
20 assessments.
21 SECTION 3. That the City Clerk is directed to cause a copy of this Resolution to be
22
23 transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
24 request that the individual assessments be placed on the subject 2013/2014 property tax bills
25 for collection together with all other property taxes.
