2013/2014 Assessment Roll for Assessment District No. 959, Zone 1 and Zone 2, Landscaping
Maintenance Assessment District, Shandin Hills Area. (#2404)

Financial Impact:
The total assessment of$2,208,153.76 pays the City's maintenance, operation and incidental
costs for the various districts. If the assessments are not approved, the City will not be
reimbursed for the costs. The general benefit amount of$27,943.54 from various districts as
shown on the attached report,will not be reimbursed from the Assessment Districts for FY
2013/2014, as these amounts are determined to be general benefit and therefore not assessable,
and will be paid for from the General Fund. Assessment deficits for sixteen Districts, as set forth
below, total $118.752.49.
Motion: Adopt the Resolution.

Q1 RESOLUTION NO.
2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO CONFIRMING THE 2013/2014 ASSESSMENT ROLL FOR
3 ASSESSMENT DISTRICT NO. 959, ZONE 1 AND ZONE 2, LANDSCAPING
4 MAINTENANCE ASSESSMENT DISTRICT, SHANDIN HILLS AREA.
5 WHEREAS, by Resolution No. 84-448, the Mayor and Common Council found that
6 the public interest, convenience, and necessity required the formation of a landscaping
7 maintenance district; and
8
WHEREAS, by said Resolution No. 84-448, the Mayor and Common Council formed
9
an assessment district known as Assessment District No. 959, Zone I and Zone 2, for the
10

11 purpose of providing landscaping maintenance in the Shandin Hills area, pursuant to the a
12 provisions of Chapter 12.90 of the San Bernardino Municipal Code; and

13 WHEREAS, by Resolution No. 84-335, the Mayor and Common Council declared Ln;

that all the land included within the boundaries of said district receive a special benefit by the Q
15 0
maintenance of said landscaping; and

17 WHEREAS, said Resolution No. 84-335 declared that an annual assessment shall be W
18 levied on all land within the district to provide funding for said landscaping maintenance and
19 the administration thereof, and w
a
20 WHEREAS, an Assessment Roll has been prepared totaling $122,043.17 for Zone 1,
21
and $0.00 for Zone 2, which sets forth the individual assessments to be levied on each of the
22
23 parcels of land within Assessment District No. 959, for the fiscal year 2013/2014; and
24 WHEREAS, Article XIII D of the California Constitution requires that any and all
25 Assessment Districts existing on the effective date of said Article XIII D shall comply with the
26 procedural and approval process as set forth in Section 4 of said Article XIII D, except as set
27
forth in Section 5 therein.

4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. That the Mayor and Common Council do hereby find and determine that
6
7 the assessments as set forth on said Assessment Roll No. 959, Zone 1 and Zone 2, are hereby
8 exempt from the procedural and approval requirements of Article XIII D of the California
9 Constitution, as provided for under Section 5(b) of said Article X11I D, and that the assessment
10 amounts as set forth on said Assessment Roll are equal to or less than any prior approved a
11 a
assessments.

SECTION 2. That the Mayor and Common Council do hereby find and determine that

the proportionate costs to be levied against the parcels of land within Assessment District °

15 No.959, Zone I and Zone 2, are correctly set forth on Assessment Roll No. 959, Zone 1 and
16 Zone 2, for the fiscal year 2013/2014, on file in the office of the City Clerk of the City of San 0,
17 Bernardino, and do hereby confirm said assessments. _

SECTION 3. That the City Clerk is directed to cause a copy of this Resolution to be
19 a
20 transmitted to the Office of the Auditor-Controller for the County of San Bernardino with the
21 request that the individual assessments be placed on the subject 2013/2014 property tax bills
22 for collection together with all other property taxes.
