Synopsis of Previous Council Action: No previous Council Action. Background: The current provisions for the carry over of Holiday hours for General Unit employees is capped at 40 hours per fiscal year; any holiday hours over 40 that are unused by June 30th are forfeited. As a result of the City's current financial situation, many departments are short-staffed and employees are occasionally denied leave time, which could result in their losing banked holiday time that is accrued over the current 40 hour cap. As part of the City Team's and International Union of Operating Engineers' (IUOE) ongoing discussions to establish a comprehensive memorandum of understanding (MOU), IUOE has requested the City to consider increasing the amount of banked Holiday hours that Unit members can carry over per fiscal year from 40 hours to 96 hours. This increase will have no impact on the cash-out cap for separating employees. As such, the unfunded liability in this area would not change. Human Resources is in support of this increase through June 30, 2014, due to the reason stated above, as well as the fact that in January 2013 Unit employees came to agreement on all of the requested economic concessions. A comprehensive MOU is currently being initiated and will soon be presented to the Mayor and Common Council for approval. L 11 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON o 12 COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 13 SECTION 1. The following terms and conditions of employment for General s 14 Unit members represented by the International Union of Operating Engineers 15 ("IUOE") are approved for immediate implementation: a 16 17 "Effective June 17, 2013, General Unit employees may carry over up to ninety- 18 to six (96) hours of accrued holiday through June 30, 2014. L V ARTICLE V - LEAVES, SECTION 2 - HOLIDAYS, SUBSECTION (B) L d "Effective January 1, 2006, unit employees will receive eighteen (18) hours in their Holiday 0 Account (formerly known as Floating Holidays). Employees may maintain a balance of more than eighteen(18) hours in their holiday account during the fiscal year. t) N 7 Effective January 1, 2013, unit employees may carry over ninety-six (96) hours of accrued = holiday leave each June 30th. Any Holiday bank hours over ninety-six (96) at June 301h will be forfeited. - 6 X Effective January 1, 2006, if a holiday falls on a ten (10) hour workday, the employee will be paid nine (9) hours holiday pay. The employee may supplement the holiday with accrued _ vacation,holiday account time, compensatory time, or no pay. at Each Department Head shall consider employees' requests for scheduling the eighteen (18) �? holiday account hours per calendar year, provided however, the final right to allot the hours to be LO observed is reserved exclusively to the Department Head.
