2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO RESCINDING ANY AND ALL PREVIOUS ACTIONS DESIGNATING
3 THE PREMISES LOCATED SOUTH OF SIXTH STREET BETWEEN "E" STREET
4 AND "F" STREET IN THE CITY OF SAN BERNARDINO AS "PIONEER PARK" AND
AUTHORIZING THE CITY MANAGER TO TAKE ALL ACTIONS TO REMOVE
5 REFERENCES TO THE PREMISES AS "PIONEER PARK," AND TO TAKE ACTION
6 TO NOTIFY THE PUBLIC THAT THE PREMISES SHALL NO LONGER BE KNOWN
AS PIONEER PARK AND SHALL NO LONGER BE OPEN TO THE PUBLIC FOR
7 USE AS A PUBLIC PARK, EXCEPT THE LIBRARY BUILDING AND THE PARKING
LOTS WHICH SHALL REMAIN OPEN TO THE PUBLIC FOR LIBRARY USE.

WHEREAS, the premises located south of Sixth Street between "E" Street and "F"

Street in the City of San Bernardino (the "Premises") is owned by the City of San Bernardino
10
and has a long history of being used for public purposes, including as a City public park, and
11
most recently has been known as "Pioneer Park"; and
12
WHEREAS, in addition to being known as "Pioneer Park," the City's Norman F.
13
Feldheym Central Library has been located on the Premises since 1985; and
14
WHEREAS, due to many factors, the Premises known as "Pioneer Park" has become
15
overridden with crime and nuisance activity, creating a threat to the health and safety of City
16
residents;

18 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:
19 SECTION 1: Any and all previous actions by the Mayor and Common Council
20 designating the premises south of Sixth Street between "E" Street and "F" Street in the City of
21 San Bernardino as "Pioneer Park" or as a City park are hereby rescinded. The Premises shall no
22
longer be known as "Pioneer Park" and shall no longer be open to the public for use as a public
23 park, except for the library building and parking lots which shall remain open to the public for
24
library use.
25 SECTION 2: The City Manager is hereby authorized and directed to remove any and
26 all references to "Pioneer Park" from any signs, maps, lists, rosters, brochures, pamphlets, etc.
27
of City parks and to update any information, including but not limited to the City's Website,
28 necessary to reflect that, as of the effective date of this Resolution, the Premises shall no longer

1 be known as "Pioneer Park" and shall no longer be open to the public for use as a public park,
2 except for the library building and parking lots which shall remain open to the public for library
3 use.
4 SECTION 3: The City Manager is further authorized and directed to inform the public
5 of the de-designation of the Premises as "Pioneer Park" and that the Premises is no longer open
6 to the public for use as a public park, except for the library building and parking lots which shall
7 remain open to the public for library use, by posting sufficient signs throughout the Premises.
