2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
3 BERNARDINO AUTHORIZING THE EXECUTION OF A FIRST AMENDMENT TO
4 SAN MANUEL POLICING DISTRICT SERVICES AGREEMENT BETWEEN THE
5 CITY OF SAN BERNARDINO AND THE SAN MANUEL BAND OF MISSION INDIANS
6
7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
8 OF SAN BERNARDINO AS FOLLOWS:
9 SECTION 1. The City Manager of the City of San Bernardino is hereby authorized and
10 directed to execute on behalf of said City a First Amendment to San Manuel Policing District
' 11 Services Agreement, a copy of which is attached hereto marked Exhibit"A" and incorporated
12 herein by reference as fully as though set forth at length.
13 SECTION 2. The authorization granted hereunder shall expire and be void and of no
14
further effect if the agreement is not executed by both parties and returned to the Office oft the
15
City Clerk within sixty (60) days following the effective date of the Resolution.

FIRST AMENDMENT TO SAN MANUEL POLICING DISTRICT SERVICES
1 AGREEMENT BETWEEN THE CITY OF SAN BERNARDINO AND THE SAN
2 MANUEL BAND OF MISSION INDIANS
3 THIS FIRST AMENDMENT is made and entered into as of July 1, 2013 by and between
4 the CITY OF SAN BERNARDINO, a charter city ("CITY") and SAN MANUEL BAND OF
5 MISSION INDIANS ("SMBMI"). In consideration of the mutual covenants and conditions set
6 forth herein,the parties agree as follows:
7 1. This Amendment is made with respect to the following facts and purposes:
8 a. On September 30, 2010, CITY and SMBMI entered into that certain
9 agreement entitled "San Manuel Policing District Services Agreement"
10 ("Agreement").
11 2. Section 1 of the Agreement is hereby amended to omit the words "and crossing guard
12 services for Belvedere Elementary School and Serrano Middle School."
13 3. Section 2 of the Agreement is hereby amended to omit the sentence "Crossing guard
14 services are to be provided at the intersections of Lynwood Drive and Victoria
15 Avenue and Lynwood Drive and Belvedere Avenue."
16 4. Section 3 of the Agreement is hereby amended to extend the term of the agreement
17 for three (3) years: Fiscal years 2013/2014, 2014/2015, and 2015/2016, concluding on
18 June 30, 2016.
19 5. Section 4 of the agreement is hereby amended to omit Section 4E in its entirety.
20 6. Section 5 of the Agreement is hereby amended with a new Attachment 2, attached
21 hereto this First Amendment and incorporated herein in the following amounts:
22 For fiscal year 2013/2014 $937,592.88
23 For fiscal year 2014/2015 $900,837.27
24 For fiscal year 2015/2016 $918,395.05.
25 7. Except for the changes specifically set forth herein, all other terms and conditions of
26 the Agreement shall remain in full force and effect.
