HomeMy WebLinkAbout2013-189 RESOLUTION NO. 2013-189 2 RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AMENDMENT NO. 1 TO A CONSULTANT SERVICES AGREEMENT WITH 3 WILLDAN FOR DESIGN OF A TRAFFIC SIGNAL AT ROUTE 210 WESTBOUND 4 WATERMAN AVENUE OFF-RAMP AT 30TH STREET (TC08-09). 5 WHEREAS, on April 19, 2010 the Mayor and Common Council adopted Resolution 6 No. 2010-076 approving a Consultant Services Agreement with Willdan for design of a traffic 7 signal at Route 210 westbound waterman Avenue off-ramp at 30th Street(TC08-009). 8 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 9 CITY OF SAN BERNARDINO AS FOLLOWS: 10 SECTION 1. The City Manager is hereby authorized and directed to execute 11 Amendment No. 1 to Consultant Services Agreement on behalf of the City, said Amendment 12 being attached and incorporated herein as Exhibit"A". 13 14 SECTION 2. WITNESSETH : A. WHEREAS, on April 19, 2010 the Mayor and Common Council adopted Resolution No. 2010-076 approving a Consultant Services Avenue offtramp at 310t�Street (TC08-0 9); traffic signal at Route 210 westbound w aterman and B. WHEREAS, Consultant has completed all work associated with the design of a traffic signal at Route 210 westbound waterman Avenue off-ramp at 30th Street(TC08-009); and C. WHEREAS, on May 20he traffic signal construction Route 210 westbound waterman Avenue Industry, Inc. for installation of g nal at off-ramp at 30th Street (TC08-009); and D. WHEREAS, said Services Agreement with Consultant as approved on April 19, 2010 expired on December 31, 2011; and E. WHEREAS, City wishes to retain Consultant's services to provide design support during construction; and F. WHEREAS, Consultant represents that it has that degree of specialized expertise contemplated within California Government Code, Section 37103, and holds all necessary licenses to practice and perform the services herein contemplated; and G. WHEREAS, City and Consultant desire to contract for specific services in connection with the project and desire to set forth their rights, duties and liabilities in connection with the services to be performed; and H. WHEREAS, no official or employee of City has a financial interest, within the provisions of California Government Code, Sections 1090-1092, in the subject matter of this Agreement. NOW, THEREFORE, for and in consideration of the mutual covenants and conditions contained herein, the parties hereby agree as follows: 1.0. SERVICES PROVIDED BY CONSULTANT Section 1.1. COMPENSATION AND BILLING Section 2.1. "Compensation" is hereby amended to add the following: Consultant shall be compensated for on-call support during construction on a time and material basis, based on Consultant's current rate schedule, a copy of which is attached hereto as errors or Attachment "B" and made ant shall not be billable. The total reimbursement for this additional omissions by the Consultant shall not exceed $5,000.00 4.0 TERM Section 4.1. This traffic signal is being constructed by Siemans Industry, Inc. under a Caltrans Encroachment Permit. Willdan will provide the City of San Bernardino assistance during the construction process, to include but not limited to, inquiries, change orders, material approval, interpretation of plans and specifications, and meetings. Willdan concurs with extending the terms of the original Agreement to December 31,2013. Willdan will provide the above services on a time-and-materials basis, not-to-exceed $5,000 based on the attached Billing Rate Schedule.
