2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO APPROVING THE DESTRUCTION OF CERTAIN
3 OBSOLETE RECORDS BY THE SAN BERNARDINO POLICE DEPARTMENT

5 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS:

7 SECTION 1. The Mayor and Common Council of the City of San Bernardino
8
approve the destruction of certain obsolete records by the San Bernardino Police Department.
9
Subject to written consent of the City Attorney, as provided in Sections 34090, 34090.5, and
10
11 34090.6 of the Government Code, the following city records, documents, instruments, books
12 or papers may be destroyed as of July 1, 2013:
13 (a) All Complaint and Internal Affairs files with dispositions dated prior to January 1, 2008;
14 (b) Pitchess Motion files dated prior to January 1, 2008;
15
(c) Police canine activity and apprehension reports dated prior to January 1, 2008;
16
17 (d) Employee grievances dated prior to January 1, 2008;
18 (e) Internal promotional tests and evaluations dated prior to January 1, 2008;
19 (f) Use of Force Reports dated prior to January 1, 2008.
20 (g) Pursuit Reports dated prior to January 1, 2008.

(h) Lawsuits and claims with adjudication dates prior to January 1, 2011.

23 (i) Accidental Discharges and Dog shooting files dated prior to January 1, 2008.
24 (j) Public Records Request files dated prior to January 1, 2008.
25 (k) Subpoena Duces Tecum files dated prior to January 1, 2008.
26 (1) Personnel Applicant files w/processing dates prior to January 1, 2008.

4 I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the Mayor and
