No.) Finance: Council Notes: Eso Z &,//!2 Agenda Item No.— 14 1I .2-0q STAFF REPORT SUBJECT Resolution authorizing the City of San Bernardino Fire Department to enter into a mutual aid protection agreement with the State of California, Department of Forestry and Fire Protection for the purpose of receiving a Federal Strip number to purchase products through the General Services Administration. BACKGROUND The Fire Department is requesting authorization to enter into a mutual fire protection aid agreement with the State of California, Department of Forestry and Fire Protection. The agreement is to provide efficient use and coordination of fire service resources for wildland fire protection incidents that are beyond the control of either party and to provide quickest appropriate initial response regardless of jurisdictional boundaries. The necessities of the agreement shall not impose an unconditional obligation on any party to provide aid and assistance per the request from another party. Each party's authorized designee will determine if needs within their jurisdiction are being addressed prior to committing resources to jurisdictions beyond their boundaries. In addition, the agreement will authorize the Fire Department to obtain a Federal Standard Requisition and Issue Procedure number (known as FedStrip number) to purchase equipment from the General Services Administration Wildfire Protection Equipment and Supplies Catalog (GSA). GSA is a Federal purchasing agent that allows State Forestry to purchase equipment, supplies, and services at the Federal government rate. In order to realize this benefit, the City of San Bernardino must sign a Mutual Aid Agreement with the State of California Department of Forestry, similar to the agreement signed under the California State Master Mutual System already in effect. The process will take approximately 8 to 12 months for the State to release a FedStrip number to the City authorizing purchases from the GSA system. The term of this mutual fire protection aid agreement is for five years from the date of last signature on the agreement. Also, both parties have the right to terminate their participation under the agreement by providing thirty (30) days written notice to the other party. FINANCIAL IMPACT There is no cost to the city. There is language contained within the agreement that neither party shall be obligated to reimburse the other for any action taken or aid rendered in the course of fire protection assistance. That the State of California, Department of Forestry and City of San 9 Bernardino Fire Department wish to enter into a mutual aid protection agreement for the 10 purpose of obtaining a Federal Standard Requisition and Issue Procedure number (known as 11 FedStrip number). The FedStrip number will authorize the Fire Department to order from 12 the U.S. General Services Administration to realize government pricing on all procurement 13 products; and 14 SECTION 2. The City Manager or his designee is hereby authorized and directed to 15 execute said Agreement, a copy of which is attached and incorporated herein as Attachment 16 "A"; and 17 SECTION 3. Said Agreement will be for each party providing to the other a 18 reasonable and reciprocal exchange of fire protection services as may be necessary to 19 suppress fires of a size beyond the control of either of the parties. Each party agrees to 20 undertake this reciprocal exchange of services under the terms, provisions, and conditions 21 22 listed in Attachment A, for the term of five years. 23 SECTION 4. Such mutual aid shall be provided within the limits of the County of San Bernardino; provided however, that neither party hereto shall be required to reduce its own fire protection resources, personnel, services and facilities to the detriment of its normal fire protection capability. 3. No response to a mutual aid request provided for in this agreement will be made by the parties hereto unless such request is made and received through the established communication channels common to each party by a responsible fire official of the party requesting such aid. 4. That certain specialized types of fire protection resources may not be made available subject to the provisions of this agreement and that such resources will be available only on a reimbursement basis. 7. This agreement shall remain in full force and effect for a period of five (5) years from the date hereinabove written unless terminated by either of the parties hereto giving thirty (30) days prior written notice of such early termination. That any mutual aid extended under this agreement will be extended with the express understanding that the fire official in charge, in whose jurisdiction an incident requiring mutual aid occurs, shall remain in charge at such incident including the direction of personnel and equipment provided through operation of this mutual aid agreement. Except as may be provided by separate agreement between the parties hereto, the assurance of mutual aid set forth shall constitute the sole consideration for the performance herein provided. That certain specialized types of fire protection resources may not be made available subject to the provisions of this agreement and that such resources will be available only on a reimbursement basis. 7. This agreement shall remain in full force and effect for a period of five (5) years from the date hereinabove written unless terminated by either of the parties hereto giving thirty (30) days prior written notice of such early termination. BACKGROUND The Fire Department is requesting authorization to enter into a mutual fire protection aid agreement with the State of California, Department of Forestry and Fire Protection. The agreement is to provide efficient use and coordination of fire service resources for wildland fire protection incidents that are beyond the control of either party and to provide quickest appropriate initial response regardless of jurisdictional boundaries. The necessities of the agreement shall not impose an unconditional obligation on any party to provide aid and assistance per the request from another party. Each party's authorized designee will determine if needs within their jurisdiction are being addressed prior to committing resources to jurisdictions beyond their boundaries. In addition, the agreement will authorize the Fire Department to obtain a Federal Standard Requisition and Issue Procedure number (known as FedStrip number) to purchase equipment from the General Services Administration Wildfire Protection Equipment and Supplies Catalog (GSA). GSA is a Federal purchasing agent that allows State Forestry to purchase equipment, supplies, and services at the Federal government rate. In order to realize this benefit, the City of San Bernardino must sign a Mutual Aid Agreement with the State of California Department of Forestry, similar to the agreement signed under the California State Master Mutual System already in effect. The process will take approximately 8 to 12 months for the State to release a FedStrip number to the City authorizing purchases from the GSA system. The term of this mutual fire protection aid agreement is for five years from the date of last signature on the agreement. Also, both parties have the right to terminate their participation under the agreement by providing thirty (30) days written notice to the other ply. FINANCIAL IMPACT There is no cost to the city. There is language contained within the agreement that neither party shall be obligated to reimburse the other for any action taken or aid rendered in the course of fire protection assistance. RECOMMENDATION Adopt resolution. 1
