Motion: Adopt the Resolution. Synopsis of Previous Council Action: None. Background: The County of San Bernardino Economic Development Agency is preparing an application to become the lead agency to administer the expiring Agua Mansa Recycling Market Development Zone(RMDZ). The current administrator, County of Riverside EDA, will not pursue renewal and has asked San Bernardino County to assume the administrator role. The Recycling Market Development Zone (RMDZ) program through the California Department of Resources Recycling and Recovery (CalRecycle) combines recycling with economic development to fuel new businesses, expand existing ones, create jobs, and divert waste from landfills. This program provides attractive loans, technical assistance, and free product marketing to businesses that use materials from the waste stream to manufacture their products and are located in a zone. The zones cover roughly 88,000 square miles of California from the Oregon border to San Diego. Local government incentives may include relaxed building codes and zoning laws, streamlined local permit processes, reduced taxes and licensing, and increased and consistent secondary material feedstock supply. Local incentives vary from jurisdiction to jurisdiction. Analysis The County of Riverside Economic Development Agency created the Agua Mansa Recycling Market Development Zone in 1993 to attract businesses that can process mixed waste paper, glass, tires and rubber, plastic, yard waste, and inert solids. The Agua Mansa Recycling Market Development Zone (AMRMDZ) is composed of a multijurisdictional team of Riverside and San Bernardino Counties and the cities of Colton, Rialto, and San Bernardino. This zone also serves as an Enterprise Zone, as designated by the State Department of Commerce. The zone is centrally located in the Western Riverside/San Bernardino County area and encompasses 26,422 acres. The Agua Mansa RMDZ will expire March 2013. The County of Riverside indicated to the County of San Bernardino Economic Development Agency their intention to not renew and to focus on an RMDZ solely serving the County of Riverside. To assist in business attraction, retention, and expansion efforts, the County of San Bernardino Economic Development Agency wishes to preserve the RMDZ status and assume the administrator role. Both CalRecycle and cities in the County of San Bernardino currently not part of an existing RMDZ were notified and have approved of the County of San Bernardino Economic Development Agency's intent to renew the RMDZ designation, assume the administrator role, expand its boundaries, and change the name to the San Bernardino County RMDZ. The following cities intend to join, along with the unincorporated areas, the San Bernardino County RMDZ: Big Bear Lake, Colton, Grand Terrace,Montclair,Needles, Ontario,Rancho Cucamonga, Rialto, San Bernardino,and Yucaipa. This may change pending approval from the respective city councils and/or renewed interest by eligible cities currently not listed. The following cities already participate in the existing Chino Valley, Hesperia and High Desert RMDZs: Apple Valley, Barstow, Chino, Chino Hills, Hesperia, Twentynine Palms, Victorville, and Yucca Valley. In 2011, there were five existing businesses operating in the Agua Mansa RMDZ that process mixed waste paper, glass, tires and rubber, plastic, yard waste, and inert solids. From the start of the program, four loans were granted to these businesses, at least 13,750 tons of waste was diverted from landfills, and at least 25 jobs were created. The RMDZ provides another economic development resource for cities to attract or retain © recycling-based manufacturing businesses. Cities may participate at no cost. No additional funding will be provided to cities. The County of San Bernardino EDA will be the main point of contact for technical assistance, marketing, and reporting to CalRecycle. Cities will be asked to provide the County EDA a list of potential recycling-based manufacturing businesses, as well as contact businesses to obtain data necessary to complete the annual report. In speaking with other RMDZ administrators, San Bernardino County does not anticipate that this program will unduly burden cities. As the City of San Bernardino Development Code allows recycling facilities in all commercial and industrial land use districts (subject to the development requirements set forth in Chapter 19.06), it is recommended that the RMDZ encompass all commercial and industrial land use districts in the City. The RMDZ is an economic tool, similar in nature to an enterprise zone and does not change or supersede local zoning. Therefore, no changes to the Development Code are proposed in conjunction with this request. RMDZ eligible businesses can only operate in permitted areas, subject to the standards set forth in Development Code Chapter 19.06.. and c N 20 21 WHEREAS, the reconstituted San Bernardino County RMDZ shall exclude all r 22 communities and cities located in Riverside County; and a 23 24 WHEREAS, the San Bernardino County RMDZ shall exclude communities currently 25 participating in the Chino Valley, Hesperia and High Desert RMDZs, which includes the 26 municipalities of Apple Valley, Barstow, Chino, Chino Hills, Hesperia, Twentynine Palms, 27 Victorville and Yucca Valley; and Q 28 1 Pa ckatPg.',124"r 'SE.a 1 WHEREAS, cities and counties must meet a 50 percent reduction in landfill waste 2 disposal as mandated in the California Integrated Waste Management Act; and 3 WHEREAS, the San Bernardino County RMDZ is dedicated to establishing, 4 sustaining, and expanding recycling-based manufacturing businesses, which is essential for 5 market development and to assist local jurisdictions to meeting the established landfill 6 reduction goals; and 'm 7 n0 8 WHEREAS, the Agua Mansa RMDZ (soon to be the San Bernardino County RMDZ) E 9 designation will expire in March 2013 unless re-designated by CalRecycle; and o m 10 0 WHEREAS, the City of San Bernardino still desires existing and new recycling-based s 11 manufacturing businesses locating within the region to be eligible for the technical and 2 12 financial incentives associated with the RMDZ program; and U 13 d 14 WHEREAS, the renewal of the San Bernardino County RMDZ is still necessary to 15 facilitate local and regional planning, coordination, and support of existing recycling-based N 16 manufacturing businesses, as well as attract private sector recycling business investments to 17 the region; and 0 y d 18 0 19 WHEREAS, the current and proposed waste management practices and conditions are Cl) 0 20 favorable to the development of post-consumer and secondary waste materials markets; and Y 21 d WHEREAS, the City of San Bernardino will assist the San Bernardino County RMDZ cE, r 22 R Administrator market and promote RMDZ benefits, contact prospective businesses, and 23 provide data to complete annual and other reporting documents within their local jurisdiction; 24 and 25 26 WHEREAS, the San Bernardino County RMDZ does not supersede nor attempt to 27 change local land use, planning and zoning regulations as enforced by the City of San 28 Bernardino; and 2 Pack®1.i?g:X125 5.E.a i 1 WHEREAS, the City of San Bernardino shall inform economic development and solid 2 waste professionals in their jurisdiction of the benefits of the San Bernardino County RMDZ; and 3 4 5 WHEREAS, the California Legislature has defined environmental justice as "the fair treatment of people of all races, cultures, and incomes with respect to the development, 6 adoption, implementation, and enforcement of environmental laws, regulations, and policies" 7 [ N Government Code section 65040.12(e)], and has directed the California Environmental Y C 8 Protection Agency to conduct its programs, policies, and activities that substantially affect E 0. 9 human health or the environment in a manner that ensures the fair treatment of people of all d 10 races, cultures, and income levels, including minority populations and low-income a 11 populations of the state [Public Resources Code section 71110(a)]; and 12 WHEREAS, CalRecycle has adopted a goal to continuously integrate environmental T 13 d justice concerns into all of its programs and activities; and 0 14 a 15 WHEREAS, the County of San Bernardino as Lead Agency under the California 16 Environmental Quality Act, has prepared, or caused to be prepared, and adopted a Negative o c 17 Declaration for this zone renewal project that finds that the project will not have a significant 18 impact on the environment; and 0 19 N O 20 WHEREAS, the City of San Bernardino intends to review and consider the d information in the Negative Declaration adopted by the County of San Bernardino that finds r 21 that the zone renewal project will not have a significant impact on the environment.
