Morris Council Members: Virginia Marquez Jason Desjardins Tobin Brinker Fred Shorelt Chos Kelley Rikke Van Johnson Wendy McCammack ~ MINUTES MAYOR AND COMMON COUNCIL AND COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO JOINT ADJOURNED REGULAR MEETING TUESDAY, MAY 25,2010 ECONOMIC DEVELOPMENT AGENCY BOARDROOM 201 NORTH OlE" STREET SAN BERNARDINO, CALIFORNIA This is the time and place designated for a joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino from the joint regular meeting of the Mayor and Common Council and Community Development Commission held at 1:30 p,m., Monday, May 17, 2010, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino was called to order by Mayor Pro Tempore Brinker at 5:13 p.m. on Tuesday, May 25,2010, in the Economic Development Agency Boardroom, 201 North "E" Street, San Bernardino, California. Roll Call Present: Mayor Pro Tempore Brinker; Council Members/Commissioners Marquez, Desjardins, Shorett, Kelley, Johnson, McCammack; City Attorney Penman; City Manager McNeely; City Clerk Clark, Absent: Mayor/Chairman Morris. 1. Closed Session Pursuant to Government Code Section(s): 1 OS/25/2010 A. Conference with legal counsel - existing litigation - pursuant to Government Code Section 54956.9(a). B. Conference with legal counsel - anticipated litigation - significant exposure to litigation - pursuant to subdivision (b) (I), (2), (3) (A-F) of Government Code Section 54956.9, C. Conference with legal counsel - anticipated litigation - initiation of litigation - pursuant to subdivision (c) of Government Code Section 54956.9. D. Closed Session - personnel - pursuant to Government Code Section 54957, E. Closed session with Chief of Police on matters posing a threat to the security of public buildings or threat to the public's right of access to public services or public facilities - pursuant to Government Code Section 54957. F. Conference with labor negotiator - pursuant to Government Code Section 54957.6. G. Conference with real property negotiator - pursuant to Government Code Section 54956.8. The Mayor and Common Council did not recess to closed session during this meeting. 2. Follow-up to Mayor and Common Council RetreatlWorkshop Mayor Pro Tempore Brinker stated that the purpose of the workshop is to develop operational guidelines which include developing agenda guidelines, creating a code of conduct for the Mayor and Council, staff and the public, and creation of guidelines for standing Council and Ad Hoc Committees. Mayor Pro Tempore Brinker welcomed the facilitator, Dr. Bill Mathis, who holds a doctorate in Clinical and Industrial Psychology from the University of North Dakota at Grand Forks. City Manager McNeely introduced Dr. Mathis who specializes in working with City Councils and staff on effective governance as well as Code of Ethics and Code of Conduct. Dr. Mathis stated that currently he is working with 29 cities, seven counties and ten water districts and has numerous publications, He indicated that the workshop would be informal and they would begin by reviewing the proposed Code of Conduct Guidelines. 2 OS/25/20 I 0 ( City Manager McNeely stated that he had met with City Attorney Penman who has reviewed the proposed guidelines, Changes suggested by Mr. Penman have been included in the proposed topic areas for a Code of Conduct/Guidelines. Lengthy discussion ensued as the Council members reviewed each of the the 17 topic areas listed in the proposed guidelines. In addition to the changes proposed by Mr. Penman, the members of the City Council requested that under item 16, Communication with City Manager and Staff, the seventh bullet should read The Mayor and Common Council should not criticize staff in public. Dr. Mathis took an informal poll of the Council members trying to determine the optimal time to get Council agendas and backup delivered to them and they responded as follows: Council member Marquez: Council member Desjardins: Mayor Pro Tempore Brinker: Council member Shorett: Council member Kelley: Council member Johnson Council member McCarnmack: Wednesday before the Council meeting Wednesday before the Council meeting Five days before the Council meeting (Wednesday) Wednesday or Thursday before the Council meeting Three days before the Council meeting Wednesday before the Council meeting Recommended leaving everything as it is now; however, she requested more detail in the staff reports, Additionally, it was the consensus of the Common Council that the last paragraph under item 17, Compliance and Enforcement, be deleted. Due to the lateness of the workshop and the time needed to review the remaining topics on the agenda; i.e., Proposed Agenda Guidelines and Council Committees, the members of the City Council agreed that within the next two weeks they would review these two items and bring back any proposed changes to the next workshop scheduled to take place on Tuesday, June 8, 2010. It was the consensus of the Council members that the City Manager and the City Attorney will work to fmalize the Operational Guidelines and bring them back to the Mayor and Council for their approval. 3.
