AMENDMENT- PERSONNEL POLICIES AND PROCEDURES FOR EMPLOYEES OF THE
CITY OF SAN BERNARDINO ECONOMIC DEVELOPMENT AGENCY
BACKGROUND:
On October 5, 1998, Section S.B., Working Hours, of the Personnel Policies and Procedures for
Employees of the City of San Bernardino Economic Development Agency ("Agency") was approved
establishing a 9/80 work schedule for Agency employees. The 9/80 work schedule requires working
hours for Agency Staff from 7:30 a.m. to 5:30 p.m. Monday through Thursday, and from 7:30 a.m. to
4:30 p.m. every other Friday for those staff members working the 9/80 work schedule. On October 22,
1998, Administrative Procedure#2 was amended and issued to Agency Staff authorizing the Executive
Director of the Agency to implement the 9/80 work week.
Alternate work schedules, including the 9/80, were first implemented to improve employee morale and
to promote the policies of the Air Quality Management District goals to reduce smog and traffic.
However, alternate work schedules were not to impact the efficiency or effectiveness of the workplace.
CURRENT ISSUE:
Agency management has reviewed the effect of the 9/80 work schedule on the efficiency and
effectiveness of the Agency's accomplishments and ability to serve the public. It has been determined
that due to the Agency's limited number of staff, a serious shortage of personnel frequently occurs on
Fridays. As a result, the Agency desires to terminate the 9/80 work schedule and return to a traditional
8/80 five-day work schedule for all Agency employees. In order to accomplish this, Section S.B.
Working Hours, of the Personnel Policies and Procedures for Employees of the Agency must be
amended. It currently reads as follows:
Alternate work schedules, other than eight (8) hour work days, such as compressed workweeks
and nine (9) or ten (10) hour workdays to improve employee morale or to promote the policies
of the Air Quality Management District goals to reduce smog and traffic, may be implemented
by management if the goals and mission of the Agency allow for such schedules.
Section S.B. will be amended to read as follows:
"The Executive Director shall determine the Working Days of the Agency. The Executive
Director shall set forth in a Memorandum to all Agency Employees the hours of operation of
the Agency on each Working Day and the hours during which the Agency shall be open to the
public on each Working Day.

The beginning and ending times of work for Agency Employees on a Working Day shall be
set by the Executive Director. However, the Executive Director shall by written
Memorandum: 1) place the Agency Employees on notice that, with the approval of the
Executive Director, the Agency Employees may adjust their individual beginning and ending
times of work on a Working Day, and 2) describe in the procedure by which the Agency
Employees may obtain such approval from the Executive Director, and 3) set forth the process
of approval by the Executive Director as to beginning and ending times of work which shall be
based on the need to maintain adequate staffing levels throughout the Working Day as
determined by the Executive Director. The Executive Director may, after timely notice,
modify a previously approved beginning and ending time of work to maintain adequate
staffing levels throughout the Working Day as determined by the Executive Director.
In the exercise of his or her discretion,the Executive Director may allow Agency Employees or
an Agency Employee to work on weekends and/or holidays as required to accomplish Agency
business".
In addition, this action authorizes the Executive Director of the Agency to update Administrative
Procedure #2 and issue to Agency Staff the appropriate procedures implementing this new policy
regarding work hours.
ENVIRONMENTAL IMPACT:
No impact under CEQA pursuant to Section 15301.
FISCAL IMPACT:
This action has no fiscal impact.
RECOMMENDATION:
That the Community Development Commission adopt the attached Resolution.

CITY OF SAN BERNARDINO ECONOMIC DEVELOPMENT AGENCY

7 WHEREAS, on October 5, 1998, Section 5.B., Working Hours, of the Personnel Policies
8 and Procedures (the "Personnel Policies") for Employees of the City of San Bernardino Economic
9 Development Agency ("Agency") was approved establishing a 9/80 work week schedule for

16 NOW, THEREFORE, THE COMMUNITY DEVELOPMENT COMMISSION OF THE
17 CITY OF SAN BERNARDINO DOES HEREBY RESOLVE, DETERMINE AND ORDER, AS
18 FOLLOWS:

Section 1. The Community Development Commission of the City of San Bernardino (the
20
"Commission") hereby finds and determines that the facts and circumstances set forth in the
21
Recitals hereof are true and correct in all respects.

23 Section 2. The Commission hereby approves the amendment to the Personnel Policies as set
24 forth in the recitals hereto and as further set forth in detail in the form as attached hereto as Exhibit
25 "A". The Commission further authorizes and directs the Interim Executive Director to issue such
26 directives or other Administrative Procedures to Agency staff consistent with this action of the
Commission to amend the Personnel Policies.

28 Section 3. This R•solution shall take of : from and after its date of adoption by this
Commission.

This Amendment to the Personnel Policies and Procedures for Employees of the City of
San Bernardino Economic Development Agency (this "Amendment') has been approved on
February 16,2010.
-RECITALS-
The Agency desires to amend Section 5.13., Working Hours, of the Personnel Policies
and Procedures for Employees of the Agency to read as follows:
"The Executive Director shall determine the Working Days of the Agency. The
Executive Director shall set forth in a Memorandum to all Agency Employees the hours
of operation of the Agency on each Working Day and the hours during which the
Agency shall be open to the public on each Working Day.
