Synopsis of Previous Council Action:
07-06-09 The Mayor and Common Council signed Cooperative Agreement with San
Bernardino County Transportation Authority (SANBAG) for I-215 Freeway
Widening Segments 1, 2 and 5 Sewer Relocation Design Work.
07-06-09 The Mayor and Common Council adopted a Resolution awarding a contract to
Weka, Inc. for Sewer and Street Improvements(SW09-03).
03-16-09 The Mayor and Common Council signed Utility Agreements with Caltrans for
sewer relocations reimbursement related to the I-215 Freeway Widening Project.
Recommended Motion:
Authorize the Director of Development Services to execute Contract Change Order No. One
with Weka, Inc. for the Sanitary Sewer Improvement Relocations for the I-215 Freeway

Subject:
Authorize the Director of Development Services to execute Contract Change Order No. One with
Weka, Inc. for Sanitary Sewer Improvement Relocations for the I-215 Freeway Widening,
Segments 1, 2 and 5 (SW09-03)per Project Plan No. 12574.
Background:
In March of 2009, the California Department of Transportation (Caltrans) and the City of San
Bernardino entered into Utility Agreements as part of the realignment and widening of the I-215
Freeway. The agreement, which required Caltrans to reimburse the City for all engineering,
inspection and construction costs associated with the relocation of conflicting sewer facilities
within Segments No. 1 and No. 2, was signed by the Mayor on March 16, 2009. A similar
Utility Agreement between Caltrans and the City for sewer relocations relative to Segment No. 5
was also signed by the Mayor on March 16, 2009. The sewer relocation project involves the
following three freeway segments:
• Segment No. 1 between Rialto Avenue and 8t' Street, which includes City sewer
relocations at 2"d Street, Main Street, 3rd Street, Kingman Street, alley north of 5th Street,
Spruce Street, Victoria Street, 7th Street, and 8d' Street. This has been identified as Phase
3 of the freeway improvements.
• Segment No. 2 between 8t' Street and Massachusetts Avenue, which includes City sewer
relocations at Temple Street, IOth Street, Olive Street, I Ith Street, Orange Street, Baseline
Street, Virginia Street, and 17th Street. This has been identified as Phase 3 of the freeway
improvements.
• Segment No. 5 between Massachusetts Avenue at 19t Street, which includes City sewer
relocation at Massachusetts Avenue. This has been identified as Phase 4 of the freeway
improvements.
On July 6, 2009, the Mayor and Common Council approved a Resolution to award a contract to
Weka, Inc. for construction of Sanitary Sewer Improvement Relocations for State Route 215,
Segments 1, 2 & 5 (SW09-03), per Project Plan No. 12574.
Under the utility agreements, Caltrans will reimburse the City for all associated costs with the
relocation of conflicting sewers regarding the I-215 Freeway Widening project up to
$4,204,275.00 for Segments No. 1 and No. 2 and up to $286,418 for Segement No. 5, both of
which reflect the estimated cost of construction with contingencies based upon the approved
plans and specifications. In addition to this contract there were two other contracts awarded for
sewer relocation work. All contracts related to this project are below the estimated cost of
construction.

Construction Change Order No. One:
During construction of the sanitary sewer improvement relocations for State Route 215,
Segments 1, 2 and 5, the contractor was directed to complete additional work and/or encountered
unforeseen conditions, such as discovery of abandoned railroad ties buried in the existing
roadways, discovery of unsuitable material in 11 th Street, Olive Street, Kingman Street, Orange
Street, Spruce Street and others that had to be removed and disposed of, removal and
replacement of sewer line, storm drain line, relocation of undocumented conflicting utilities, and
other tasks including additional survey, and design revisions adjusting sewer alignment per the
field condition. These additional tasks were not identified on the plans prepared by Caltrans or
included in the contractor's original bid. The descriptions and justification of these items are
detailed in the attached copy of Contract Change Order No. One.
Financial Impact:
The revised estimated project costs are as follows:
TOTAL
Original Contract Amount $1,364,058.00
Contract Change Order No. One $ 212,896.00
Total Project Cost $1,576,954.00
This change order represents a net increase of 15.6% of the original contract amount. Sufficient
funds are available in Acct. No. 242-362-5504-7848.
Caltrans will reimburse the total cost of the project, including change orders, upon completion of
the work.
Recommendation:
Authorize the Director of Development Services to execute Contract Change Order No. One with
Weka, Inc. for the Sanitary Sewer Improvement Relocations for the I-215 Freeway Widening,
Segments 1, 2 and 5 (SW09-03), per Project Plan No. 12574.

JUSTIFICATION:
Remove and Recondition Unsuitable Material and Recompact it between August
24,2009 and October 7,2009 on Various Streets
The contractor was required to rc-excavate and recondition unsuitable materials on
Item 1-1 Virginia Street Orange Street, 11th Street, Olive Street, 10d' Street, Temple Street 8d'
No, Street, Vine Street, 7d' Street, Victoria Street, Spruce Street, Kingman Street, 3rd Street,
Main Street and 2"d Street in order to meet the compaction requirements since the
materials were too saturated with moisture.
Sawcut and Remove 5 feet of Moe within Caltrans'Right-of-Way
1-2 The contractor was required to sawcut and remove an additional 5 feet of pipe to clear
Caltrans' right-of-way at several locations.
Remove and Replace Sewer Laterals
The contractor was required to remove and replace existing sewer laterals not shown on
1-3 the approved plans on 8d' Street and l e Street. In addition,the contractor was directed
to video the above sewer laterals, which were not a part of the original contract bid
item.
Extra Work on Virginia Street to Remove Asphalt Concrete around Two New
Manholes
1-4 The contractor was required to remove existing asphalt around manholes and replace it
with 6" thick Portland cement concrete on Virginia Street. This additional work was
not included in the original contract bid item.
Remove Unknown Utilities on 2° Street
The contractor was required to cut and remove an unknown 4"steel structure around an
1-5 8"sewer main. In addition,the contractor was directed to stand by due to the unknown
1"and 2"steel structures on 2nd Street not shown on the approved plans.
Remove Unknown/Abandoned Railroad Ties on Various Streets
During construction, it was discovered that there were unknown/abandoned railroad tics
1-6 approximately F deep spaced 3' feet apart on Yd Street and Kingman Street that needed
to be disposed of This additional work was not shown on the approved plans and not a
art of the original contract bid item.
Design Changes on Spruce Street due to Utility Conflict
During construction, it was discovered that there were conflicts between an existing 3"
gas line, a %" water service line, an unmarked 11/2" electrical conduit and a 2" steel
structure; and the proposed 24"jack and bore sewer line on Spruce Street. The gas line
1-7 crossed over the center of the proposed sewer line. The contractor was directed to
pothole said utilities while the design engineer was looking into an alternative
alignment of the proposed sewer and bore pit location. In addition, it was necessary for
the contractor to standby for the design changes and wait for an approval from Caltrans
at the same time. These changes were not originally anticipated and were not included
in the original contract bid.
Potholing for Sewer Line on Kingman Street
1-8 The contractor was directed to pothole the existing sewer line on Kingman Street,which
was not shown on the approved plans. In addition, this additional work was not
included in the original contract bid item.

1-9 Segment 5
During construction, it was discovered that an existing 4" sewer line collapsed
and had to removed and replaced due to void.
Relocate Fences to Caltrans' Right-of-Wav, since there is no Construction
1-10 Easement Secured for the Project along Baseline
The contractor was required to relocate the fences outside the unsecured construction
easement,which had not yet been acquired for the project.

Main Street and 2nd Street in order to meet the compaction requirements since the
