Synopsis of Previous Council Action:
None.
Background:
The San Bernardino County Department of Public Works has received a Safe Route to Schools
(SR2S) grant from the State of California for the installation of pedestrian improvements on
Pacific Street between Perris Hill Park Road and Glasgow Avenue. This project will provide
infrastructure improvements for pedestrian walkways, assist with traffic control, and encompass
education and outreach. These measures are intended to improve pedestrian safety and reduce
pedestrian collisions in the vicinity of Pacific High School and Fairfax Elementary School. Since
the project area includes portions of the City of San Bernardino, a cooperative agreement is
needed for the project.
The County of San Bernardino will be the lead agency for design and construction of the project
described in the grant application (Attachment B). The work will consist of installing three in-
pavement flashing-lighted crosswalks, upgrading existing crosswalks with high visibility
markings, painting red curb, and installing or upgrading curb ramps on Pacific Street. These
improvements will occur within both the City of San Bernardino and unincorporated County
area. Work on this project will begin once this agreement is approved by both agencies. The
project will require approximately fifteen months to complete.
Financial Impact:
The total estimated cost of the project is $407,900, including contingencies. The local match of
10% of the grant amount is $40,800, and due to the City's financial situation, the County of San
Bernardino has agreed to fund the entire local match at no cost to the City of San Bernardino.

WHEREAS, the County of San Bernardino (hereinafter referred to as "COUNTY") and the a
City of San Bernardino (hereinafter referred to as "CITY") desire to cooperate and jointly participate
in a project to install pedestrian infrastructure improvements on Pacific Street between Perris Hill
Park Road and Glasgow Avenue (hereinafter referred to as "PROJECT'); and
WHEREAS, the PROJECT is partially in the unincorporated area of the COUNTY and
partially within the incorporated area of the CITY, and will be of mutual benefit to the COUNTY and
CITY; and
WHEREAS, the total project cost is estimated to be $407,900; and

WHEREAS, the PROJECT received a State Safe Routes to School grant in the amount of
$367,100; and
WHEREAS, the State Safe Routes to School grant requires a local match (MATCH) of
$40,800 as a condition of receiving grant funds; and
WHEREAS, PROJECT costs are partially (50%) in the unincorporated area of the COUNTY
and partially (50%) within the incorporated area of the CITY, and will be of mutual benefit to the
COUNTY and CITY; and
WHEREAS, the costs are proportioned based on work done in each parties'jurisdiction; and
WHEREAS, the COUNTY's contribution toward PROJECT MATCH is estimated at $20,400
(50% of MATCH) and the CITY's share of PROJECT MATCH is estimated at $20,400 (50% of 'o
MATCH), as more particularly set forth in Exhibit "A", attached hereto and incorporated herein by r,
reference. °c
WHEREAS, COUNTY desires to provide CITY with financial assistance in providing the c
CITY's share of MATCH in accordance with Streets & Highways Code section 1680, et seq., as m
there is a general COUNTY interest in the PROJECT; and

WHEREAS, Streets & Highways Code sections 1685 and 1803 authorize CITY to contract
with COUNTY for the maintenance, construction or repair of CITY streets and roads, if the 3
legislative body of CITY determines that it is necessary for the more efficient maintenance, 2
construction, or repair of streets and roads; and 0

WHEREAS, the legislative body of CITY determines that it is necessary for the more efficient w
maintenance, construction, or repair of streets and roads within CITY to contract with COUNTY for the
PROJECT; and c

WHEREAS, COUNTY and CITY desire to set forth responsibilities and obligations of each It
as they pertain to such participation and to the design, construction, and funding of the proposed

project.

NOW, THEREFORE, IT IS MUTUALLY AGREED as follows: m

1.0 COUNTY AGREES TO: E
1.1 Act as the Lead Agency in the design and construction of the PROJECT.
1.2 Provide plans and specifications, environmental documents, and all necessary construction a
engineering for the PROJECT for CITY's review and approval.
13 Obtain a no-cost permit from the CITY for work within the CITY's right-of-way.
1.4 Advertise, award, fund, and administer the contract for the PROJECT, in accordance with
the provisions of the California Public Contract Code applicable to counties.
1.5 Pay its proportionate share of the MATCH, not-to-exceed $20,400, which shall be 50% of
estimated MATCH (see Exhibit A).
1.6 Pay CITY's proportionate share of the MATCH, not-to-exceed $20,400, which shall be 50%
of estimated PROJECT MATCH (see Exhibit A).
1.7 Submit to the CITY, on a monthly basis, an itemized accounting of actual final design and
construction costs incurred by COUNTY to date and which have not already been paid by
the CITY.
1.8 Require all contractors and vendors working on the design and construction of the
PROJECT to have appropriate and adequate insurance coverage for the mutual protection
and benefit of COUNTY and CITY. Except for Workers' Compensation, Errors and

Omissions and Professional Liability policies, COUNTY shall require and ensure that all
COUNTY contractors/subcontractors for the PROJECT shall have insurance policies that
contain endorsements naming the CITY and its officers, employees, agents and volunteers
as additional insureds with respect to liabilities arising out of the performance of services
hereunder. The additional insured endorsements shall not limit the scope of coverage for
the CITY to vicarious liability but shall allow coverage for the CITY to the full extent provided
by the policy. Such additional insured coverage shall be at least as broad as Additional
Insured (Form 6) endorsement from ISO, CG 2010.11 85.
1.9 Require its Contractor to maintain and to comply throughout the term of any contract
awarded by COUNTY with the insurance requirements described in County Policy Numbers
11-07 and 11-07SP.
1.10 Include compliance with any applicable requirements of CEQA, as well as completing the
required CEQA documentation.

3.0 IT IS MUTUALLY AGREED: ni
3.1 COUNTY agrees to indemnify, defend (with counsel approved by CITY) and hold harmless
the CITY and its officers, employees, agents, volunteers from any and all claims, actions or 3
losses, damages, and/or liability resulting from the COUNTY's negligent acts or omissions
which arise from the COUNTY's performance of its obligations under this Agreement. t;
3.2 CITY agrees to indemnify, defend (with counsel approved by COUNTY) and hold harmless N
the COUNTY and its officers, employees, agents and volunteers from any and all claims, �
actions, losses, damages and/or liability resulting from the CITY's negligent acts or
omissions which arise from the CITY's performance of its obligations under this Agreement.

3.3 In the event the COUNTY and/or the CITY is found to be comparatively at fault for any
claim, action, loss or damage which results from their respective obligations under the N
Agreement, the COUNTY and/or CITY shall indemnify the other to the extent of its $
comparative fault. Furthermore, if the COUNTY or CITY attempts to seek recovery from the
other for Workers' Compensation benefits paid to an employee, the COUNTY and CITY o,
agree that any alleged negligence of the employee shall not be construed against the m
employer of that employee.
3.4 In the event of litigation arising from this Agreement, each party to the agreement shall bear E
its own costs, including attomey(s) fees. This paragraph shall not apply to the costs or v
attorney(s)fees relative to paragraphs 3.1, 3.2, and 3.3, indemnification. =°
3.5 COUNTY and CITY are authorized self-insured public entities for purposes of Professional c
Liability, Automobile Liability, General Liability and Workers' Compensation and warrant that
through their respective programs of self-insurance they have adequate coverage or
resources to protect against liabilities arising out of COUNTY and CITY's performance of the
terms, conditions or obligations of this Agreement.
3.6 If either COUNTY or CITY requests additional work that is beyond the scope of the original
PROJECT, and not considered by all parties to be a necessary part of the PROJECT, said
work, if approved by all parties, will be paid solely by the party requesting the work, unless
all parties agree by written amendment to allocate the cost in accordance with the
percentage allocation provided herein, or in some other mutually acceptable manner,
3.7 COUNTY shall notify CITY of the bids received and the amounts thereof. Within ten (10)
days thereafter, COUNTY and CITY shall determine the cost of the PROJECT. In the event
that either party intends to cancel this Agreement based upon the bids or amount thereof,
said party shall notify the other party at a reasonable time prior to the awarding of a contract

to construct the PROJECT to avoid any detrimental reliance by either contracting party,
contractor or potential contractor.
3.8 If, upon opening of bids, it is found that a cost overrun exceeding the estimated PROJECT
costs will occur, COUNTY shall not award any contracts for the PROJECT. Rather
COUNTY and CITY shall endeavor to agree upon an alternative course of action, including
re-bidding of the PROJECT. If, after thirty (30) working days, an alternative course of action
is not mutually agreed upon in writing, this Agreement shall be deemed to be terminated by
mutual consent.
3.9 In the event that change orders are required during the course of the PROJECT, said
change orders must be in form and substance as set forth in attached Exhibit "B" of this
Agreement and approved by both COUNTY and CITY. Contract Change Order forms will be
delivered by fax and must be returned within two (2) working days. The CITY shall not
unreasonably withhold approval of change orders. If a CITY disapproved or modified
change order is later found to be a cost of the PROJECT, then the CITY shall be 'o
responsible for any costs, awards, judgments or settlements associated with the U
disapproved or modified change order. °c
3.10 If this Agreement is funded in whole or in part with funds provided by the American
Recovery and Reinvestment Act of 2009, the COUNTY and CITY shall comply with the c
following provisions: m
c
Use of ARRA Funds and Requirements - This Contract may be funded in whole or in rn
part with funds provided by the American Recovery and Reinvestment Act of 2009 z
("ARRA"), signed into law on February 17, 2009. Section 1605 of ARRA prohibits the 3
use of recovery funds for a project for the construction, alteration, maintenance or repair
of a public building or public work (both as defined in 2 CFR 176.140) unless all of the c�
iron, steel and manufactured goods (as defined in 2 CFR 176.140) used in the project N
are produced in the United States. A waiver is available under three limited 0:
circumstances: (i) Iron, steel or relevant manufactured goods are not produced in the w
United States in sufficient and reasonable quantities and of a satisfactory quality; (ii) Ln
Inclusion of iron, steel or manufactured goods produced in the United States will o
increase the cost of the overall project by more than 25 percent; or (iii) Applying the V
domestic preference would be inconsistent with the public interest. This is referred to as N
the "Buy American" requirement. Request for a waiver must be made to the COUNTY
for an appropriate determination. a
Section 1606 of ARRA requires that laborers and mechanics employed by contractors a
and subcontractors on projects funded directly by or assisted in whole or in part by and E
through the Federal Government pursuant to ARRA shall be paid wages at rates not less v
than those prevailing on projects of a character similar in the locality as determined by °.
the Secretary of Labor in accordance with the Davis-Bacon Act (40 U.S.C. 31). This is a
referred to as the "wage rate" requirement.
The above described provisions constitute notice under ARRA of the Buy American and
wage rate requirements. Contractor must contact the COUNTY if it has any questions
regarding the applicability or implementation of the ARRA Buy American and wage rate
requirements. Contractor will also be required to provide detailed information regarding
compliance with the Buy American requirements, expenditure of funds and wages paid
to employees so that the COUNTY may fulfill any reporting requirements it has under
ARRA. The information may be required as frequently as monthly or quarterly.
Contractor agrees to fully cooperate in providing information or documents as requested
by the COUNTY pursuant to this provision. Failure to do so will be deemed a default
and may result in the withholding of payments and termination of this Contract.

Contractor may also be required to register in the Central Contractor Registration (CCR)
database at http://www.ccr.ciov and may be required to have its subcontractors also
register in the same database. Contractor must contact the COUNTY with any
questions regarding registration requirements.
Schedule of Expenditure of Federal Awards - In addition to the requirements
described in "Use of ARRA Funds and Requirements," proper accounting and reporting
of ARRA expenditures in single audits is required. Contractor agree to separately
identify the expenditures for each grant award funded under ARRA on the Schedule of
Expenditures of Federal Awards (SEFA) and the Data Collection Form (SF-SAC)
required by the Office of Management and Budget Circular A-133, "Audits of States,
Local Governments, and Nonprofit Organizations." This identification on the SEFA and
SF-SAC shall include the Federal award number, the Catalog of Federal Domestic c
Assistance (CFDA) number, and amount such that separate accountability and 'o
disclosure is provided for ARRA funds by Federal award number consistent with the L)
recipient reports required by ARRA Section 1512 (c). °
In addition, Contractor agrees to separately identify to each subcontractor and document
at the time of sub-contract and at the time of disbursement of funds, the Federal award m
number, any special CFDA number assigned for ARRA purposes, and amount of ARRA m
funds. w

Contractor may be required to provide detailed information regarding expenditures so 3
that the COUNTY may fulfill any reporting requirements under ARRA described in this
section. The information may be required as frequently as monthly or quarterly. 2

Whistleblower Protection - Contractor agrees that both it and its subcontractors shall
N
comply with Section 1553 of the ARRA, which prohibits all non-Federal contractors, q
including the State, and all contractors of the State, from discharging, demoting or N
otherwise discriminating against an employee for disclosures by the employee that the
employee reasonably believes are evidence of: (1) gross mismanagement of a contract
relating to ARRA funds; (2) a gross waste of ARRA funds; (3) a substantial and specific
danger to public health or safety related to the implementation or use of ARRA funds; (4)
an abuse of authority related to the implementation or use of recovery funds; or (5) a E
violation of law, rule, or regulation related to an agency contract (including the v
competition for or negotiation of a contract) awarded or issued relating to ARRA funds. a
Contractor agrees that it and its subcontractors shall post notice of the rights and
remedies available to employees under Section 1553 of Division A, Title XV of the
ARRA.
3.11 This Agreement shall be for a term of three (3) years and shall terminate upon project
completion as described in Paragraph 3.12 or December 31, 2015 (whichever occurs first),
but may be cancelled upon thirty (30) days advance written notice of either party, provided
however, that neither party may cancel this Agreement after COUNTY awards a contract to
construct the PROJECT.
3.12 Except with respect to the Parties' operation, maintenance and indemnification obligations
contained herein, this Agreement shall terminate upon completion of the PROJECT.
3.13 This Agreement contains the entire agreement of the Parties with respect to subject matter
hereof, and supersedes all prior negotiations, understandings or agreements. No

supplement, modification, or amendment of this Agreement shall be binding unless
executed in writing and signed by both parties.
3.14 This Agreement shall be governed by the laws of the State of California. Any action or
proceeding between CITY and COUNTY concerning the interpretation or enforcement of
this Agreement, or which arises out of or is in any way connected with this Agreement or the
PROJECT, shall be instituted and tried in the appropriate state court, located in the County
of San Bernardino, California.
3.15 Time is of the essence for each and every provision of this Agreement.
3.16 Since the Parties or their agents have participated fully in the preparation of this Agreement,
the language of this Agreement shall be construed simply, according to its fair meaning, and
not strictly for any or against any party. Any term referencing time, days or period for
performance shall be deemed work days. The captions of the various articles and
paragraphs are for convenience and ease or reference only, and do not define, limit,
augment, or describe the scope, content, or intent of this Agreement.
3.17 No waiver of any default shall constitute a waiver of any other default or breach, whether of V
the same or other covenant or condition. No waiver, benefit, privilege, or service voluntarily °c
given or performed by a party shall give the other party any contractual rights by custom, TO
estoppel, or otherwise. c
3.18 If a court of competent jurisdiction declares any portion of this Agreement invalid, illegal, or m
otherwise unenforceable, the remaining provisions shall continue in full force and effect, c
unless the purpose of this Agreement is frustrated. in
3.19 This Agreement may be signed in counterparts, each of which shall constitute an original. r
3.20 The Recitals are incorporated into the body of this Agreement. 3

OProject Selection:San Bernardino County Department of Public Works collects data from CHP Form 555(Traffic Collision Report)
provided to the County to tabulate traffic collisions on roads under the County's jurisdiction.These reports provide information y
regarding weather,lighting,and road conditions,vehicle code violations,number of vehicles and pedistrians involved,types of r
collisions,and other factors.The County enters these reports to an Accident Detail Report database.Details of collisions over the 3
past 10 years with a focus on pedestrian/bicycle/vehicle collisions were identified by specific locations using GIS capability,Streets
in the County Maintained Road System(CMRS)with high pedestrian/bicycle/vehicle collision data were evaluated for proximity to
school locations.Schools were also evaluated for number of students with socioeconomic disadvantaged status,number of English 0
Learners,and percentage of students receiving free or reduced lunch.Based on objective collision data and the proximity of N
multiple collisions near one high school and one elementary school,San Bernardino County identifled safety improvements on m

Pacifc Street as a priority project for Its Safe Routes to School Program submission.
SPacific Street Collision Data:The collision data reveal that,during the ten-year period,there were 14 pedestrian/vehicle or bicycle/ N
vehicle collisions on Pacific Street between Perris Hill Park Road and Glasgow Avenue,a distance of O.S9 miles.of these 14
collisions,l 1 involved students of school age and three involved adults.Most of the pedestrian/vehicle collisions occurred while the c
pedestrians were in the crosswalk.San Bernardino County Public Works conducted a field review of the project location.This field o
review involved direct observation,linear measurements,sign inventory,traffic counts,speed of vehicles,and diagramming.Both to
Pacific High School and Fairfax Elementary School are well signed,alerting motorists to the presence of students.As observed, 2
motorists routinely violate traffic laws during the morning and afternoon pick up and drop off periods.In addition,given the time of c
day and the fall and winter occurance of the majority of the pedestrian/vehicle collisions,the morning and afternoon sun may play C
a contributing factor in whether motorists are able to see pedestrians. A
ECommunity Input/Public Participation:County staff met with administrators from both schools,district police,and conducted
three meetings with parent groups associated with the schools,including one for the Spanish-speaking community.Parents and
stakeholders were presented with the traffic issues and concerns on Pacific Street and presented with possible solutions developed m
in consultation with county engineers and analysts.With input by parents,school staff,and district police,the County incorporated,
where possible,needs and suggestions into the development of this proposal. s

Yes,the planning process is developing into a future school travel plan.Based on discussions with the school principals and district °'
police,student pedestrian and bicycle travel routes were identified within school attendance boundaries and those routes were
used to evaluate locations for safety improvements.Neither Pacific High School nor Fairfax Elementary School currently has a m
school travel plan and both principals expressed the need for school travel plan development.Principals and key staff will be Q
provided material from the California Safe Routes to School Technical Assistance Resource Center on developing a school travel
plan including utilization and Inclusion of parent group and other community resources.San Bernardino County will also offer
assistance and collaboration to both schools in developing a school travel plan.As an encouraging first step,Pacific High School has
agreed to Incorporate safe walking and biking rules for students in their student handbook.

3.Existing Safety Hazards and Demonstrated Needs of the Applicant.Describe each safety risk/hazard that has been
encountered at the project location when walking or bicycling to school and the extent and severity of each. Discuss how each
item was determined to be a risk/hazard.(e.g. cite data such as accident reports,community observations,surveys,reports,

Pacific Street,primary access for Pacific High School and Fairfax Elementary School,Is a 4-lane secondary highway with an Average
Daily Traffic of 9,832 vehicles in the project area.During morning drop-off and afternoon pick-up periods,county staff observed and
videotaped numerous traffic violations occurring among motorists and pedestrians,particularly at Pacific's intersection with Barton
Street near the high school and at the intersection with Fairfax St near Fairfax Elementary School.Over the last 10 years,14
pedestrian/vehicle or bicycle/vehicle collisions on Pack St in the project area occurred predominantly while the pedestrians were i,
in existing crosswalks.Based on CHP 555 collision reports analysis covering a 10-year period,associated vehicle code violations,and
confirmed by county staff observation,the three highest occurring hazards identified on Pacific St are:Vehicles making unsafe turns 0
or U-turns(23 out of 64 violations),Speeding(16 out of 64 violations),and failure to yield to pedestrians/jaywalking(10 out of 64 0
violations).Nine feeder streets serve as the principal paths of student travel to Pacific St and the two schools.Analysis of the c
pedestrian/bicycle/vehicle collisions on Pacific St revealed the following:four pedestrians were hit in or near the crosswalk at Barton 0
St,two pedestrians were hit in the crosswalk at Tippecanoe Ave,one pedestrian was hit at Garden St(no crosswalk),two bicyclists
were hit at Conejo Or(no crosswalk),one bicyclist and one pedestrian were hit at Dwight Way,and three pedestrians were hit in the m
crosswalk at Glasgow Ave.Of the 14 collisions,12 were Injury collisions,one was severe injury,and one was a fatality.When the
county held community meetings with parents and staff at the two schools,attendees were offered comment cards to provide the
county with feedback and suggestions.Repeatedly,responders stated that vehicles fall to yield to pedestrians or disregard traffic L
rules(speeding and U-turns).The CHP 555 reports indicate that six of the 14 collisions involved motorists that stated that they did .3
not see the pedestrians before the collision.Given the time of day,time of year,and direction of travel of motorists involved in the
collisions,solar glare may be afactor in some collisions.
4.Potential of the Proposal for Reducing Child injuries and Fatalities.Describe how the proposed project addresses each y
identified safety risk/hazard and how the project will improve bicycle and pedestrian safety and calm traffic. Explain why this proposed "

■Engineering:The proposed project will Install in-ground lighted crosswalks on Pacific St at Barton St,Tippecanoe Ave,and Fairfax
�. St.Existing red curb on both sides of the street will be freshly painted so as to become more noticeable,and an existing gap in the N
red curb marking between Barton St and Perris Hill Rd will be red-painted.ADA ramps will be Installed at the upgraded in-ground
lighted crosswalks.During field reviews of the project area,it was noted that the existed painted crosswalks are beginning to fade. 0
To improve visibility,the county and city propose to repaint the existing crosswalk at Perris Hill Park Rd and upgrade the existing
painted crosswalks at Perris Hill Rd and Glasgow Ave to ladder style painted crosswalks.The in-ground lighted crosswalks will —
provide earlier warning for drivers that a pedestrian will be crossing the street.Closing the red curb gap is Intended to reduce C
pedestrian/vehicle conflicts at the heavily traveled Barton St crossing by pushing stopped traffic farther east.Upgrading the painted
crosswalks to the ladder style will serve to increase visibility of these crosswalks to motorists.I•Education:Due to reduced class r
time due to the current budget crisis,the principals have expressed reluctance to take class time for safety workshops.However,the
principals have agreed to put up posters provided by these grant funds around the school campuses to illustrate and remind
students of safe walking and biking practices.This grant will also provide brochures to hand out to parents and students at both m
schools to explain safe walking and biking.In addition,both schools have agreed to incorporate safe walking and biking rules for

students in their student handbooks.I•Enforcement:The City and County of San Bernardino share jurisdiction over Pacific St.City E
police have jurisdiction over traffic law enforcement on the north side of the street and the California Highway Patrol has
jurisdiction over traffic law enforcement on the south side of the street.San Bernardino City Police and the Highway Patrol have :°•
provided letters indicating that they will monitor Pacific Street for increased enforcement of traffic laws during the morning drop Q
off and afternoon pick up periods in the project area.Increased enforcement in the area will serve to ensure motorists and
pedestrians comply with traffic laws,thereby increasing safety for pedestrians on Pacific St and their feeders.EThe Best Alternative:
Traffic Studies were conducted in the project area and it was determined that warrants were not met for pedestrian or traffic signals r
in the project area.The best alternative for calming traffic and alerting motorists is the installation of the in-ground lighted
to
crosswalks and upgrading painted crosswalks.Both schools agreed this is the best alternative. 4
5.Potential of the Proposal for Encouraging Increased Walking and Bicycling Among Students. Describe how
increased walking and bicycling among students will be encouraged and sustained afterthe project is completed.(e.g.partnership

improvements are completed.Each school's safety procedures communicated each school year to students regarding entering or
exiting school grounds,procedures reinforced dally through school staff monitoring during the morning and afternoon drop off
and pick up periods.Engineering,Education,Encouragement and Enforcement provide an integrated approach to address the
safety concerns regarding students walking or biking.

Fairfax Elementary School,also located within the project area,has an enrollment of 343 students.According to data from the c
California Department of Education,99%of these students are categorized as socioeconomically disadvantaged and 95%are n
eligible for the Free and Reduced Meals Program.English Learners comprise 47%of the student population.The latest data from
the United States Census Bureau indicate that 24.2%of families living In the zip code served by these two schools live below the

The principal of Pacific High School estimates that approximately 80%of the high school students walk or bike to school.The
