Penman, City Attorney FROM: Henry Empeno, Jr., Senior Deputy City Attorneyfl& DATE: November 2, 2012 RE: My Request for Reinstatement to Fulltime City Employment I respectfully request that the Mayor and Council approve my reinstatement to full-time City employment at my former position as Senior Deputy City Attorney at my previous salary range and step, including the 10% salary reduction, starting December 26, 2012. I very much appreciate that you and the Mayor and Council have allowed me to work as a temporary contract employee since my retirement on July 14, 2012. Under PERS regulations, I am limited in working as a temporary contract employee for the City to a maximum of 960 hours, which 1,M11 reach by the end of November 2012. CI understand that the City is in a desperate financial situation and that it is difficult, if not impossible, to find any competent experienced attorneys willing to work for the City given the fact that we do not know whether we can meet payroll, and because PERS has threatened to cancel its contract with the City. After working for the City for the past 24 years, I still very much care for this City and wish to help it overcome these current challenges. In order to assist the City, I am willing to rescind my retirement and be reinstated at my former position. However, I have one request to make concurrent with my reinstatement. The City Attorney's Office has gone from seven to only three full-time Legal Secretaries and we are unable to adequately and professionally handle our increased responsibilities and workload due to the additional work required of us as a result of the City's bankruptcy and the dissolution of the RDA. We have a highly skilled temporary Legal Secretary with extensive experience in litigation. She is presently doing the legal work for four of the attorneys in our office. Because her position is temporary, she is looking elsewhere for a permanent position. Just as it is difficult to find competent attorneys to work here under these circumstances, it is also unlikely that we can attract experienced legal secretaries. I strongly urge you to hire this person full-time as a Legal Secretary II, to enable the remaining attorneys (which have been reduced from ten full- time to seven full-time attorneys) to handle the additional workload all of us are experiencing.
