Penman City Attorney Subject: Request for Four Additional City Attorney Investigators Date: January 18, 2013 CC: City Clerk, City Manager, Chief of Police, Sr. Assistant City Attorney, Supervising City Attorney Investigator The decision to request additional City Attorney Investigators is not one upon which we easily arrived. We are well aware of the criticisms of some, that the acknowledged excellent work performed by these Investigators should be accomplished by the City's Code Enforcement Officers. Throughout the years this Office has provided training for Code Enforcement, including"ride-alongs" for our Code Officers with our Investigators,where in-the-field training has been achieved. As a result, we have seen some gradual improvement in the effectiveness of that City department. We also believe the reassignment of Code Enforcement to the Police Department will result in improved training, supervision, effectiveness and other efficiencies. However, there are certain areas where a retired police officer will continue to be more effective. The employment of Hearing Officers and the Administrative Civil Penalties program,both spear- headed by the Office of the City Attorney, have also produced some efficiencies and a number of examples of what can be accomplished by a successful application of these tools to combat the blight and its partner, crime, that now permeates so much of this community. Given the blighted conditions that prevail throughout much of the City, considering the City's limited resources, rising crime and the umbrella of bankruptcy which hangs over our every endeavor, it is incumbent upon us to strengthen, improve and employ,without hesitation, those resources that have been proven to be the most effective in achieving positive change to our neighborhoods. The appearance, property values and the safety of our residents compel us to expand upon every cost-effective successful program and/or weapon in our arsenal. All six of our current, part-time City Attorney Investigators are currently retired San Bernardino City Police Officers. They have the education, training, experience and knowledge of this City, its neighborhoods and its people to aggressively attack the problem of blight in an effort to counter the blight that few others have been able to impact successfully. AIW4 City Attorney Memorandum Additional Investigators January 18, 2013 Page two Unfortunately,because these individuals are retirees in the CALPERS system, they are limited to working for our City for no more than 960 hours per fiscal year. Some of our Investigators are now near"capping out" even though we have just finished the first six months of the current 2012-2013 fiscal year. We have sufficient funds budgeted for ten Investigators to work the full twelve months of this fiscal year,but do not currently have enough time remaining for each of the current six Investigators to continue working through June 30, 2013, which is the conclusion of fiscal year 2012-2013. Normally an Investigator works two days a week from 7:30 to 4:30. Our one weekend Investigator works from approximately 10:00 a.m. to 6:00 p.m., Saturday and Sunday. No one works on holidays except in special circumstances. Because of the increased activity of panhandlers, unlicensed transient merchants, and complaints from residents, the business community, Council members and other public officials, it has been necessary for some Investigators to work longer periods over the past six months, thus depleting their 960 available hours much more rapidly than in some previous years. Anticipating this occurrence, and responding to the urging of the City Manager and other City officials for the Investigators to do more to reduce blight, issue ACPs to more blighted properties than has been done in previous years and to increase the collection of the ACP penalties imposed by the City's Hearing Officer, some Investigators have worked twice as many hours as they would normally have worked by the end of December. In addition to the preceding, we need to increase the weekend coverage from one Investigator to two, and we need to increase the hourly time-span the Investigators are able to be in the field by two hours, until at least 8:00 p.m. instead of the current 6:00 p.m. end of shift. Transient food vendor-merchants have established out door cooking venues throughout the City, most notably in the Mt. Vernon area, but in other parts of the City as well. Tacos,burritos, barbeques, soft-drinks and other products are sold, usually commencing shortly after sunset. These people have no city licenses or permits and no County Health Department permits. Code enforcement, already over-worked and ill-equipped by training to encounter suspects, many of whom have active warrants, has not been able to adequately address some of the above issues. In discussing the matter with Chief Handy and our City prosecutors, Senior Assistant City Attorney Jolena Grider and Deputy City Attorney Cynthia Underwood, I am informed that our Code Enforcement Officers are not trained or prepared to deal with suspects with outstanding arrest warrants. City Attorney Memorandum Additional Investigators January 18, 2013 Page three It is incumbent upon us to continue the successful application of ACPs to diminish blight, improve property values and successfully attack the unlicensed businesses and the prevailing climate of panhandling that occurs daily,through all hours, in almost every business area and commercial parking lot in our City. Why is this necessary? Because it has proven to be effective. In order to continue this accomplishment, we are requesting the Mayor and Common Council to designate four more retired peace officers to perform the City Attorney Investigator functions. In calendar year 2012, 97 out of 129 properties were brought up to City Property Maintenance Code standards by six part-time City Attorney Investigators through the use of Administrative Civil Penalties (ACPs). The total amount collected on these 129 properties in 2012 was $689,713.12. The majority of ACP effort by the City Attorney Investigators was focused on the blighted, foreclosed properties in our city. Thus banks, mortgage companies and out of town lenders constituted most of the offenders with whom this Office dealt in 2012. During the same period, 30 out of 37 properties were brought up to Code by approximately sixteen to twenty, full-time Code Enforcement Officers through the use of ACPs. The total amount collected on these 37 properties in 2012 was $221,279.56. This was a substantial improvement by Code Enforcement using ACPs to gain compliance, rather than the much less effective Administrative Citation process. Throughout our City, blighted properties continue to lower property values, contribute to turning owner-occupied homes into rentals, attract non-taxpaying individuals to our communities and, in accordance with the "broken window syndrome,"attract criminals to not only commit crimes, but to actually reside in our residential neighborhoods. This progression has also contributed to the decision by many home-owners to place their homes on the market. Out of town purchasers frequently rent these properties out, rather than make improvements to them and resell them for higher amounts. Such absentee landlords often fail to monitor the activities of their renters and many decline to re-invest even modest portions of the rent they collect into property maintenance. This further adds to the blight and deterioration as well as to the on-going negative cycle in so many of our neighborhoods. If we are to make a change in the neighborhoods of this City, we must become more effective in addressing blighted properties. ACPs continue to be the most successful tool for accomplishing that result. City Attorney Investigators continue to be the most successful in the investigation, issuing of ACPs and the bringing of blighted foreclosures up to code standards. Yesterday, Supervising City Attorney Investigator Robert Peppler and I met with San Bernardino County Sheriff John McMahon. Among the issues we discussed was the possibility of the City Attorney's Office obtaining civil injunctions against career panhandlers. City Attorney Memorandum Additional Investigators January 13, 2013 Page four In support of, and in collaboration with, Chief Rob Handy's initiative to address the homeless and panhandler issues, he,police officials and the City Attorney's Office have had several discussions about attempting to obtain panhandler injunctions, over the past several months. We intend to identify the five or six most aggressive panhandlers in our City and seek injunctions from the Superior Court to prohibit them from panhandling in the City of San Bernardino. Violation of such injunctions would constitute a misdemeanor offense under State Law, punishable by up to six months in County jail and/or a fine of$1,000. Similar injunctions, obtained in the past by the City Attorney's Office have proven to be effective tools in assisting the police to fight gangs and prostitution. Crucial to our decision as to whether or not we seek such an injunction is the ability of the Sheriff to house a person committed by the Court for violating the injunction. Panhandling is a non-violent offense and the o ill C unty jail system is currently filled with persons arrested or convicted for violent crimes. Sheriff McMahon laid out the problem he faces due to the State prison inmates being released to the Counties pursuant to AB 109. However, he does have a facility coming on-line at the end of February that will provide more than 300 additional beds. He also informed us that the Adelanto prison facility should be open by the end of 2013,providing more than 1000 additional beds. Therefore, he said the situation should improve. Sheriff McMahon indicated he is willing to work with us, as well as other cities in the County to address the aggressive panhandling issue. He indicated that while determinations are made on a day-to-day basis as to which prisoners have to be kept in County jail facilities and which ones must be released to maintain the incarceration of prisoners arrested for/committed for the more violent offenses, he would be willing to work with us to the extent possible in housing those sentenced by the Superior Court for violating panhandler injunctions. We understood that if, at any time he has one bed and two prisoners, one in custody for a violent offense and the other for a non-violent offense (such as panhandling), he will have no choice but to release the prisoner who is in custody for the non-violent offense. Of course we agree with, and support the Sheriff in this position. Chief Handy and I conferred yesterday after the meeting with the Sheriff and we agreed that we believe this is a step forward. We intend to move ahead with the prosecution of a panhandler injunction. Obtaining such an injunction and enforcing it will be labor intensive for the City Attorney's office. Additional Investigator time will be required to research the background of each defendant, their arrests and convictions. Additional work by our Investigators will also be required to enforce these injunctions. City Attorney Memorandum Additional Investigators January 13, 2013 Page five 3 we also intend to increase our transient merchant/panhandler enforcement patrol program by placing an additional Investigator on a staggered shift with the one Investigator currently assigned. That will enable us to extend our enforcement activity period into the early evening hours of each day of the week, including weekends. i This comes with no request for a budget augmentation because we have sufficient funds in the City Attorney's budget for these four additional individuals for this fiscal year. Finally, I have discussed this proposal with the City Manager and the Chief of Police. Both told me they have no objections to the request. As is our practice, I advised the Chief of the identities of the four individuals whose employment I am recommending to the City Council. The Chief informed me that he has no objection to any of the three former San Bernardino Police Officers. (If the Chief of Police had any objection I would decline to recommend the person objected to, per the practice of this Office.) The one retired Deputy Sheriff is well-known to Supervising City Attorney Investigator Robert Peppler who, as you recall, served as Undersheriff for a number of years and supervised the retired Deputy Sheriff whose employment will be on your agenda for the Tuesday, January 22, 2013 Council meeting. g All four of these individuals had excellent records of performance durin g their years as peace officers.
