Financial Impact: There is no financial impact associated with this action. The petitioner has paid the total amount of$2,000 for the completion of the vacation proceedings. Mayor to open the hearing... Motion 1: Close hearing and adopt the Findings of Fact, as set forth in the staff report from the Public Works Director, as to why the portion of Spruce Street between Mt. Vernon Avenue and a north-south alley approximately 150 feet west of Mt. Vernon Avenue is no longer necessary for public street purposes; and Motion 2: Adopt Resolution. Synopsis of Previous Council Action: 08/15/11 - Authorization was given to proceed with the proposed vacation of a portion of Spruce Street between Mt. Vernon Avenue and a north-south alley approximately 150 feet west of Mt. Vernon Avenue; and Plan No. 12798 showing the proposed vacation, was approved. 11/21/11 - Resolution No. 2011-304 was adopted, declaring the intention to vacate a portion of Spruce Street between Mt. Vernon Avenue and a north-south alley approximately 150 feet west of Mt. Vernon Avenue, and setting a public hearing for December 19,2011. Background: On June 13, 2011, an application was received from the Redevelopment Agency of the City of San Bernardino (now known as San Bernardino Economic Development Corporation (SBEDC) requesting the vacation of Spruce Street between Mt. Vernon Avenue and a north-south alley approximately 150 feet west of Mt. Vernon Avenue. This portion of Spruce Street was dedicated as public right-of-way on the map of the Tompkins Subdivision, thus the City does not own any portion in fee. SBEDC owns the parcels directly adjacent to this portion of Spruce Street, and is Qplanning to use this portion for future development, which will also include the current gas Updated: 12/15/2011 by Mayra Ochiqui A PacketPg. 193 1401 station. On August 15, 2011, authorization to proceed with the proposed vacation was given and Plan No. 12798 was approved. City departments, utility companies and other government entities were notified of the proposal and were given the opportunity to submit easement reservations and any comments or conflicts. Several responses were received and all were favorable of the vacation. There were requests to reserve utility easements for existing facilities from the City of San Bernardino (sewer), San Bernardino Municipal Water Department, Southern California Edison, Southern California Gas Company and Verizon,which will need to be reserved as required by law. i On November 21, 2011, Resolution No. 2011-304 was adopted declaring the City's intention to order the vacation of a portion of Spruce Street between Mt. Vernon Avenue and a north-south alley approximately 150 feet west of Mt. Vernon Avenue, and set a public hearing for December 19, 2011. The Resolution was published in The Sun newspaper, and those portions of the streets proposed to be vacated were posted. The applicant requesting the street vacation and all affected property owners in the area were notified of the public hearing. There appears to be no further necessity for the area proposed for vacation for public street purposes, and staff recommends the vacation based on the following facts: 1. The Public Works Director has determined that the proposed vacation is of no further necessity to the general public, except for easements to be reserved as stated herein. 2. The proposed vacation does not conflict with the General Plan. 3. There have been no objections by any adjoining property owners. 4. All of the City departments and public utility companies were notified of the proposal. Responses were received and no conflicts were noted. 5. There were requests to reserve easements from the City of San Bernardino (sewer), San Bernardino Municipal Water Department, Southern California Edison, Southern California Gas Company and Verizon. The easements will be reserved as required by law.
