Motion: That the Director of Public Works be authorized to execute Contract Change Order No. One with Elite Companies US, Inc. for Pavement Rehabilitation on Rialto Avenue from Lena Road to Tippecanoe Avenue (SS06-044), per Project Plan No. 12283B. Synopsis of Previous Council Action: 07/05/11 The Mayor and Common Council adopted the FY 2011/12 to FY 2015/16 Capital Improvement Program. 05/16/11 The Mayor and Common Council awarded a contract through a Resolution to Elite Companies US, Inc. for pavement Rehabilitation on Rialto Avenue from Lena Road to Tippecanoe Avenue(SS06-044),per Project plan No. 12283B. 06/30/10 The Mayor and Common Council adopted FY 2010/11 to 2014/15 Capital Improvement Program. Background: On May 16, 2011, the Mayor and Common Council adopted Resolution No. 2011-107, awarding a contract to Elite Companies US, Inc. for construction of street rehabilitation improvements on CRialto Avenue from Lena Road to Tippecanoe Avenue. The Notice to Proceed was issued to the Updated: 12/15/2011 by James F.Penman A Packet Pg. 61 1397 �1 contractor on July 18, 2011. V During construction, City inspectors identified a portion of the south concrete curb and gutter on Rialto Avenue that had been uplifted by the roots of an existing street tree, causing drainage water to pond in the roadway. This condition created excessive road damage and challenges to pedestrian access. Therefore, the contractor was directed to remove the displaced curb, gutter, and sidewalk, and City crews removed the tree and its conflicting roots. The contractor was then directed to realign and place the new concrete structures with the adjoining roadway and sidewalk. Excessive asphalt road damage had to be removed and additional asphalt concrete material was placed to correct the road drainage problem. This work was not included in the original contract plans and specifications. Also, during construction, the contractor was directed to remove additional distressed pavement areas at the two intersections of Alameda Avenue and Newport Avenue with Rialto Avenue to provide an acceptable driving surface for turning vehicles. Additional asphalt grinding and paving was required to encompass the distressed pavement that existed at those locations. This work was not included in the original contract plans and specifications. It was additionally determined to extend and adjoin the new roadway pavement to the existing driveway entries at the right-of-way line along Rialto Avenue. This was done to provide acceptable access to and from the affected residences and help prevent the tracking of mud onto the improved roadway. This required additional work and resulted in increased quantities from the original bid. This work was not included in the original contract plans and specifications. Upon installation of the new roadway striping, it was determined that the actual quantity for the double yellow centerline striping was 317 lineal feet more than initially estimated. This additional quantity was installed to complete the improvements identified in the contract plans and specifications.
