THE 4 CITY OF SAN BERNARDINO. s WHEREAS, The Mayor and Common Council of the City of San Bernardino have 6 reviewed and considered the Budgetary Analysis and Recommendations for Budget 7 Stabilization Report dated June 26, 2012 (the "Report") that contains, among other things, an e o c 9 analysis of the City's fiscal year budgets from 2007-08 to 2012-13, budget projections and rn d E to recommendations for budget stabilization and resiliency in California's cyclical economy in W 0 v A 11 order to identify cost containment and cost recovery strategies necessary to reduce costs and d o� 12 5 increase revenue so that the City can align expenditures with annual revenues while addressing u 13 d immediate and long-term fiscal obligations;and o 14 Y Is WHEREAS, On July 10,2012 and July 16, 2012,the Mayor and Common Council also "A rr 16 heard and considered financial presentations prepared by the City's Finance Director and the �o Ln 17 City's consultants respecting the immediate dire fiscal crisis faced by the City, including, but �,CD 18 Ln 19 not limited to, the depletion of the City's reserves and the lack of cash available in the General w 2 zo Fund to meet the City's financial obligations. d 21 r v BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE 22 CITY OF SAN BERNARDINO AS FOLLOWS: a 23 SECTION 1. DECLARATION OF FISCAL EMERGENCY 24 zs The Mayor and Common Council of the City of San Bernardino find and declare, as follows: 26 27 28 DOCSOC/1572745v2/200430.0003 1 MI C1 1. The City is or will be unable to pay its obligations within the next 60 days, and that the 2 financial state of the City jeopardizes the health, safety,or well-being of the residents of the 3 City absent the protections of Chapter 9 of the United States Bankruptcy Code. 4 5 2. Given the City's dire financial condition and taking into consideration the advice of City 6 staff and counsel,the Mayor and Common Council hereby determines that it is in the best 7 $ interests of the City to declare a fiscal emergency and hereby declares such fiscal emergency.
