The Project is a priority for the Agency as a result of the blighting effects the current apartment complexes are having on the immediate area which is generally comprised of single-family residences. Given the high number of bank-owned properties and the overall depressed state of the residential housing market, the Agency has a unique opportunity to acquire these properties at drastically reduced prices in order to obtain site control for future development. After the properties are acquired, the Agency will issue a request for proposals to the development community in an attempt to seek the best redevelopment solution on an open and competitive basis. On October 6, 2008, the Commission authorized the Agency to execute a Professional Services Agreement by and between the Agency and California Property Specialists, Inc. ("CPSI"), for property acquisition, preparation of a Relocation Plan/Replacement Housing Plan ("Plan") and Relocation Services associated with the Project. Since the time of that Commission approval, CPSI has worked diligently interviewing the tenants and assessing their relocation needs in order to prepare the draft Plan. As the Property will be used for future redevelopment, the current tenants will need to be relocated and the apartment complexes demolished. California Community Redevelopment Law ("CRL") requires that prior to displacement of any resident as a result of redevelopment activities that a relocation plan be prepared in order to assess the relocation and housing needs of displaced residents. Further, the CRL states that the Agency will provide relocation assistance and certain benefits to any displaced resident. As it relates to the Replacement Housing Plan component of the overall Plan, the demolition and removal of these eighteen four-plex apartments will result in a loss of units from the low- and moderate-income housing market. Therefore, the Agency will require, under their current contract, that CPSI prepare a Replacement Housing Plan, identifying how and over what period of time the eighteen separate apartments will be replaced per Section 33413.5 of the CRL. CURRENT ISSUE: On July 30, 2009, CPSI completed the draft Plan for Agency Staffs review and comments. The Plan was prepared and relocation assistance will be provided in accordance with the standards and provisions of the State of California Relocation Law, Government Code Section 7260, et seq., and the California Code of Regulations, Title 25, Chapter 6, Relocation Assistance and Real Property Acquisition, as amended January 1, 1998. Further, the draft Plan was available to the public in at least two separate locations in close proximity to the Project site. The draft Plan was made available on August 21, 2009. To date,no comments have been received on the draft Plan. ENVIRONMENTAL IMPACT: None. I FISCAL IMPACT: The estimated total relocation cost identified in the draft Plan is $365,154 and will be funded from the Agency's Low and Moderate Income Housing Fund. This estimate includes an aggregate fixed moving payment of$35,250 and a relocation assistance cost of$329,904. INTRODUCTION The Redevelopment Agency of the City of San Bernardino ("Agency") is proposing to proceed with the 5th Street and Meridian Avenue redevelopment project ("Project"). The proposed Project will require the acquisition of eighteen (18) parcels which includes seventeen (17) residential multifamily four-plex buildings and one (1) vacant lot. At this time, the seventeen (17) buildings are comprised of thirty (30) tenant occupied residential units and thirty-eight (38) vacant units. None of the residential units have been identified as being owner occupied. The high vacancy rates were due to overall economic conditions, subsequent foreclosures, and in one case, demolition for code compliance purposes. As vacancies increased, blight and crime increased within the project area. The Project was therefore initiated in response to these conditions. There are currently no specific plans for the redevelopment of the properties, upon completion of all acquisition and relocation activity. Rather, proposals from for-profit and non-profit developers will be requested to design the future redevelopment. This redevelopment may involve options such as construction of single family residences to match the nature and character of surrounding neighborhoods, or senior housing and other special needs housing. The general purpose of this Relocation Plan ("Plan") is to provide the Agency with summary and statistical information regarding the potential impact to the residential occupants within the Project area. Specifically, this report is concerned with identifying the potential impact that may occur as a result of the displacement of occupants. Upon the implementation of the Plan, advisory assistance will be provided to each occupant, which includes, but is not limited to personal interviews, a survey of existing conditions, needs analysis, provision of information regarding availability of replacement housing, and issuance of notices 3s required by state relocation law. This Plan is prepared in accordance with the State of California Relocation Law, Government Code Section 7260, et. seq., and Title 25, Chapter 6, Relocation Assistance and Real Property Acquisition, as amended. The Agency has retained the services of California Property Specialists, Inc. ("CPSI") to prepare and administer the Plan. The Plan will be available for public review and comment for 30 days. All written and oral comments obtained during this comment period, along with the Agency's responses to these questions and concerns, will be added to the Final Plan and forwarded to the Redevelopment Agency Board for review and adoption. REGIONAL LOCATION AND DESCRIPTION The City of San Bernardino is located on the southwest part of the County of San Bernardino in the heart of the Inland Empire. The City lies near the boundaries of the cities of Fontana, Colton, Rialto, Loma Linda, Grand Terrace and Highland. It is approximately sixty (60) miles east of the City of Los Angeles. The City's major highway dividers include Interstate 210, which connects east-west through the northern part of the city, and Interstate 10, which connects east-west roughly on the south side of the city. The City of San Bernardino is within driving distance to several mountain resorts and lakes. See Figure i for Regional Location. SPECIFIC PROJECT LOCATION The project area under consideration is located on 5th Street east of Meridian Avenue, north of Foothill Blvd, and approximately 3 miles west of Interstate 215. The project area is near public schools, parks and shopping opportunities. GENERAL PROJECT DEMOGRAPHICS AND HOUSING The median annual household income, as reported by the occupants in the Project site in February and March 2009 was $19,800, which is lower than the 2000 U.S. Census Survey for the City of San Bernardino median annual income of $33,357. The median age within the Project site is 17 years old, which is lower than the median age from the 2000 U.S. Census Survey of 27.6 years old. The California Department of Finance for 2009 identified 66,640 housing units in the study area, with an average of about three (3) persons per household. The vacancy rate of 11% translates to a surplus of available housing units at any given time. See Figure 3, Project Demographics. Figure 4 below compares the ethnicity of the City of San Bernardino with the ethnicity of Project area households. ASSESSMENT OF RELOCATION NEEDS 1. SURVEY METHOD To gather the necessary information for this Relocation Plan, personal interviews were conducted with twenty-seven (27) of the thirty (30) occupied residential households. Three (3) households did not wish to participate in the Plan survey. The surveys were completed within the months of February and March, 2009, in the residents' homes and were conducted in English and Spanish, as appropriate. The residents were asked about the number of occupants, size of unit, length of occupancy, disabilities or special needs, household income, and desired area of preference for replacement. Table 1 below reflects some of the household characteristics and needs. See Exhibit F. 2. RESIDENTIAL DATA AND NEEDS ASSESSMENT A. FIELD SURVEY DATA The twenty-seven (27) respondent households are comprised of 62 minors and 57 adults, for an average household size of over 4 persons per household. The monthly rent paid by respondents ranges from $675 to $900, with an average monthly rent of $771. All of the respondent households occupy a two (2) bedroom unit. The three (3) households that chose not to participate in the survey also occupy two bedroom units. Prepared by California Property Specialists,Inc. 7 B. REPLACEMENT HOUSING NEEDS Replacement housing needs for tenant occupants are based on the ratio of total household's occupants to number of bedrooms. The standard for the maximum number of occupants follows a 2 + 1 theory, allowing for two occupants per bedroom with one occupant able to occupy a separate den, living or family room. For example, a one-bedroom dwelling may accommodate three (3) people, a two- bedroom may accommodate up to five (5) people, and a three-bedroom up to seven (7) people. Eight of the respondent households have been identified as being overcrowded when determining specific housing needs. Referrals presented to any potential tenant displacee will reflect the appropriate bedroom count as required by government regulations and Agency standards. Additionally, there were no households that reported having any occupants with any disabilities that would need to be accommodated at a replacement dwelling. 3. NON-RESIDENTIAL DATA AND NEEDS ASSESSMENT There are no commercial uses that have been identified as potentially being affected as a result of the Project acquisitions. RELOCATION RESOURCES The Agency's relocation consultant interviewed, viewed and evaluated each potentially impacted residential dwelling to assess the needs for a comparable replacement site. The information was the basis for an extensive resource survey conducted during the months of March and April 2009. To determine the availability of replacement housing and commercial replacement sites, the following sources were utilized: • Windshield/drive-by surveys conducted in the City of San Bernardino • Classified rental listings from local newspapers and "For Rent"publications; • Internet resources; Search efforts were generally contained within a 10-mile radius of the Project site. 1. RESIDENTIAL PROPERTY FOR RENT Replacement Housing research data indicates an adequate supply of replacement rental properties available to potential residential displacements. The survey identified a total of one hundred thirty five (135) available two, three and four bedroom, and two- bedroom section 8 rental units. Units include apartments, duplexes, triplexes and fourplexes. Specific replacement housing data in the City of San Bernardino is summarized in Table 3 below. The information on the rental housing available in the immediate area is included as a general representation of available sites. As with any resource survey, results reflect conditions at a given point in time, and individual units may or may not be available at the time of displacement. Table 3. While adequate replacement sites are available, based on survey results, current rents paid by displaced occupants may increase. Any Prepared by California Property Specialists,Inc. 9 possible rent increases will be met through the Agency's obligation under the relocation regulations, including Last Resort Housing requirements. (See Section IV C). Through its relocation agent, CPS], the Agency will be responsible to assist each household in relocating into comparable replacement housing. In accordance with applicable state and federal rules and regulations and subsequent assistance, any replacement housing approved by the Agency must meet decent, safe and sanitary housing standards. In order to meet these standards, a replacement site must meet the following criteria: • Be structurally sound; weather tight and in good repair; • Contain a safe electrical wiring system adequate for lighting and other devices; • Contain a safe heating system capable of sustaining a reasonable temperature; • Be adequate in size with respect to the number of rooms and area of living space needed to accommodate the displaced household; • Contain unobstructed egress to safe, open space at ground level. If the dwelling unit is on the second story or above, with access directly from or through a common corridor, the common corridor must have at least two means of egress; • For a person who is not mobile or impaired, be free of barriers which would restrict reasonable ingress, egress, or use of the dwelling; 2. COMPETING PROJECTS The Agency is currently undertaking other projects within the city limits. However, due to the scope of this Project, it is anticipated that other ongoing projects will not have any significant impact on the availability of replacement resources as it relates to the relocation efforts of this specific Project. 3. ALTERNATE HOUSING PROGRAMS Section 8 housing vouchers are granted by the Housing Authority of the County of San Bernardino (County Housing Authority) when available to qualified low and moderate income families, seniors and disabled persons to secure suitable and affordable housing. Currently, the County Housing Authority has exhausted its vouchers. The program's waiting list was placed on hold effective March 2007, and will remain on hold until further notice. There are currently about 30,000 people on the waiting list. Nonetheless, one of the functions of the relocation program is to provide qualified displaced households rental assistance for the incurred increased rent for a period of forty-two (42) months. Therefore, the scope of assistance provided by the relocation program through the Agency should suffice. Prepared by California Property Specialists,Inc. 10 4. TEMPORARY HOUSING NEEDS The Agency does not foresee a need for temporary housing as a result of Project acquisitions or relocation requirements. Should such a need arise, the Agency will respond appropriately and in conformance with applicable laws, regulations, and guidelines. Prepared by California Property Specialists,Inc. IV. RELOCATION ASSISTANCE PROGRAM The Agency will be providing a comprehensive Relocation Assistance Program to all families displaced by the Project. The Agency's Relocation Program is designed to minimize hardship and be responsive to unique Project circumstances. Services will be provided in such a manner to ensure consistent and equal treatment of displacees, without regard to race, nationality, color, religion, national origin, sex, marital status, family status or disability. California Property Specialists, Inc, (CPSI) has been retained by the Agency to administer the Relocation Program. Bi-lingual (English/Spanish) relocation representatives from CPSI will be available to assist all displaced households. CPSI staff can be contacted by calling the phone numbers listed below, from 8:00 a.m. to 5:00 p.m. Monday through Friday. CPSI's offices are located at: 600 W. ADVISORY SERVICES Individuals moving from existing homes, as a result of the Agency's Project, will receive advisory assistance, including the following: • informing displacees about the relocation program; • helping with the process of locating replacement accommodations; • assisting the displacee with claims processing; • provide information and/or coordinate assistance with outside service providers. To follow through a comprehensive advisory assistance program and to assure that the Agency meets its obligations under the law, relocation staff will perform the following functions: a) A General Information Notice (GIN) will be sent to all occupants who will be displaced. (See Exhibits B and C); b) Determination of the needs of each residential displacee eligible for relocation Prepared by California Property Specialists, Inc. 12 assistance; c) Provide displacee with referrals to comparable properties within reasonable time prior to displacement; d) If necessary, provide transportation for displacees to inspect replacement sites; e) Provide reasonable services necessary to successfully relocate residential displacees being displaced by the Project; f) Assure that no occupant is required to move without a written 90-day notice to vacate; g) Establish and maintain a formal grievance or appeals procedure for use by displacees regarding any Agency decision regarding relocation assistance. 2. RELOCATION BENEFITS TO RESIDENTIAL OCCUPANTS The Relocation Benefit Program will assist eligible occupants, by paying costs and expenses to relocate to a replacement site in accordance with applicable relocation guidelines. These costs are limited to those necessary for the purchase or rental of a comparable replacement property and moving costs for their personal property. In the course of personal interviews and follow-up visits, each displacee will be counseled as to available options and the potential consequences of any choice with respect to financial assistance. Moving costs and relocation benefits will be paid to eligible displacees upon submission of required claim forms and documentation in accordance with the Agency's administrative procedures. These include: A. MOVING EXPENSE PAYMENTS Any eligible displaced person who lawfully occupies the property being acquired, regardless of the length of occupancy, will be eligible for reimbursement of moving costs associated with property located at the displacement site. Displacees will receive either a fixed payment based on a room count schedule or actual cost associated with a professional move. i. Fixed Payment (based on Room Count Schedule) The displacee may, while taking the responsibility for the move, elect to receive a fixed payment for moving expenses based on a room count in the displacement dwelling. The fixed payment is a one-time, all inclusive allowance that does not require back-up documentation. Actual Cost (Professional Move) The displacee may elect to retain the services of a licensed professional mover, in which case the Agency will pay for the actual cost of the moving within a 50 mile radius, based on the lower of two acceptable bids. After the move is complete, the displacee may pay the mover directly and seek reimbursement from the Agency or request a direct payment to the moving company. B. RELOCATION BENEFITS TO TENANT-OCCUPANTS Residential tenants who have established their residency in the displacement dwelling at least 90 days prior to the first written offer by the Agency, for the property acquisition, may be eligible to receive a Rental Assistance Payment ("RAP"), in addition to a payment for moving expenses. Payment to residential tenants are determined on the basis of their current rent, their ability to pay, household occupants, market rent of a comparable replacement dwelling and actual rent of the replacement unit plus any estimated cost increase for utilities. Except in the case of "Last Resort Housing" situations and, pursuant to the Regulations, any Rental Assistance Payment is limited to a maximum of $5,250. C. LAST RESORT HOUSING The Regulations contain policies and procedures for implementing a Last Resort Housing Program. This program is authorized by statute if affordable replacement housing cannot be found within the basic statutory relocation limits of $5,250 for tenants and $22,500 for owner occupants. Based on the results of our survey, many of the households in the Project area will qualify for Last Resort Housing. The following is the recommended course Prepared by California Property Specialists,Inc. 14 of action for the Project displaces and a summary of their entitlements for replacement housing: Provide additional rent supplements above the statutory amount of $5,250, with payments being made toward the rent differential or down payment to purchase a replacement site. Prepared by California Property Specialists,Inc. 15 V. ADMINISTRATIVE PROVISIONS A. CITIZEN PARTICIPATION Citizen participation will be in accordance with the California Relocation Assistance Act ("CRAL°), Government Code, Section 7260 et. seq., State Relocation Guidelines and Title 25, Chapter 6, as well as the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended ("URA"), and Section 49 Code of Federal Regulations ("CFR"), Part 24. 1. Timely and full access to all documents relevant to their relocation program. The Agency will only restrict access where confidentiality is protected by law or its disclosure is prohibited by law; 2. To ensure that the information in documents provided does not compromise the privacy of eligible persons; 3. To provide technical assistance necessary to interpret elements of the Plan and its pertinent materials; 4. A general notice of the Plan shall be provided to all displacees in the proposed Project site and city-wide by publicizing a notice in the newspaper of general circulation. The draft Plan will also be available for public review for 30 days prior to submission for adoption by the Agency Board; 5. Copies of the draft Plan can be obtained and comments from displacees and other interested persons regarding this Plan should be sent to: Carey K. Jenkins C/O Shannon M. Upon receipt of public comments, the Plan will be reviewed to ensure that it is Prepared by California Property Specialists,Inc. 16 feasible, complies with applicable environmental standards, locally adopted rules and applicable laws and regulations; 9. Public comments and the Agency's response will be included in the Final Plan; 10.Upon completion of all reviews, the Plan will be presented for adoption by the Agency. In the event that this Plan and the Project are not implemented within one (1) year from the date of the Plan adoption, and the Project subsequently proceeds, the Agency will prepare an amendment to the Plan outlining any significant changes that may have occurred in the interim. B. NOTICES Any official notice that the Agency is required to provide a Project occupant shall be personally delivered or sent by certified or registered first-class mail, return receipt requested. Notices will be written in understandable language, and persons unable to read or understand any notice will be provided translation and counseling. Each notice will indicate the name, address and telephone number of a person who may be contacted for answers to questions or other additional assistance. These are the five principal notices: 1. General Information Notice (See Exhibits B & C); 2. Relocation Brochure (See Exhibits D and E); 3. Title VI Non-Discrimination Statement (See Exhibit G); 4. Notice of Relocation Eligibility (See Exhibits H & 1); 5. Ninety (90) Day Notice To Vacate (See Exhibits J & K); The General Information Notice, Relocation Brochure and Non-Discrimination Statement are intended to provide potential displacees with a description of the Agency's relocation program, eligibility criteria, information regarding potential financial assistance, and appeal rights. The Notice of Relocation Eligibility will contain a determination of eligibility for relocation assistance and a description or itemization of potential entitlement benefits. No lawful occupant affected by this Project, will be required to move without having received at least 90 days advance written notice of the earliest date by which the move will be necessary. The ninety (90) Day Notice will either state a specific date or state that the occupant will receive further notice indicating at least 60 days in advance, the specific date required to move. A Ninety (90) Day Notice will not be issued to any residential displacee without first being given information regarding Prepared by California Property Specialists, Inc. 17 an available replacement dwelling. C. LANGUAGE ASSISTANCE Language assistance will be available for occupants who do not understand or speak English. D. RELOCATION APPEAL PROCESS A person who is dissatisfied with a determination as to eligibility for benefits, a payment amount, failure to provide a comparable replacement site referrals, or the Agency's property management practices may file a request for a review and/or appeal in accordance with state and federal regulations and the Grievance Procedures. E. EVICTION POLICY The Agency recognizes that eviction is permissible only as a last resort. Eviction will only take place in cases of illegal occupancy, nonpayment of rent, serious violation of the rental agreement, a dangerous or illegal act in the unit, or if the occupants refuse all reasonable offers and alternate accommodations. In all cases, relocation records must be documented to reflect the specific circumstances surrounding the eviction. If a tenant is evictad for cause, all relocation benefits to which they may be entitled may be jeopardized. The Agency pledges that an eviction will not be undertaken for the purposes of evading their obligations to make available payments under their Relocation Assistance Program or other assistance to which a person may otherwise be entitled. F. PROJECTED DATES OF DISPLACEMENT No displacee will be required to vacate without a minimum of a 90 day written notice. However, an occupant in the study area may choose to vacate prior to the issuance of a "Notice to Vacate," once they receive their Notice of Eligibility and are assured that they will receive relocation assistance. The Agency anticipates Prepared by California Property Specialists,Inc. 18 that date specific Notices to Vacate will not be issued prior to acceptance of this Plan. The Agency does reserve the right to provide assistance to vacate a property in less than 90 days if the property is considered unsafe or uninhabitable at the time the Agency takes possession. If this situation occurs, Agency staff and relocation consultants will work diligently with the occupants to assure fair treatment and opportunity to wisely use their RAP benefits. Displacement of all tenants is expected to be completed within ninety (90) days after the Agency gains possession of all Project parcels and structures. G. ESTIMATED RELOCATION COSTS The estimated relocation budget is based on the data obtained through occupant interviews, current Project scope, available replacement sites, and the experience and judgment of CPSI staff. The estimated relocation budget does not include any payment for property acquisitions, loss of business goodwill payments, or professional fees necessary to implement the Relocation Assistance Program. THE PROJECTED RELOCATION COSTS FOR THIS PROJECT IS: $329,904 RELOCATION ASSISTANCE $ 35,250 FIXED MOVING PAYMENT TOTAL $ 365,154 The Agency pledges to appropriate, on a timely basis, the funds necessary to ensure the successful completion of the Project, including funds necessary for Last Resort Housing, as indicated in Section IV C, of the Relocation Plan. Decent, safe, and sanitary housing is housing that: • Meets applicable housing and occupancy requirements. • Is structurally sound, weathertight, and in good repair. • Contains a safe, adequate electrical wiring system. • Has adequate living space for the occupants. • Has a kitchen with a sink, hot and cold running water, and connections for a stove and refrigerator (if you were displaced from a housekeeping unit). • Has a separate, complete bathroom with hot and cold running water. • Has heating as required by climatic conditions. • Has an unobstructed exit to safe, open space at ground level. • Meets standards protecting occupants from lead-based paint hazards. • If you are person with a physical disability, is free of any barriers which would preclude your reasonable use of the unit. Will The Agency Help Me Find A Replacement Home? Yes. You will be provided with referrals to housing that has been inspected to ensure that it meets established standards. If possible, you will be referred to at least three comparable replacement homes. The maximum financial assistance for which you may qualify will be based on the cost of the most representative comparable replacement home that is available to you. Promptly after you become eligible for relocation assistance, the Agency's representative will inform you of such unit and the maximum payment available. Prepared.by California Property Specialists,Inc. 27 Once the Agency's representative has a clear understanding of your needs and preferences, he or she will work with you to assure that you are given the best possible choice of housing. The Agency's representative will offer you appropriate transportation to inspect these units, if necessary. What If I Find My Own Replacement Housing? You have every right to find your own replacement housing. However, before you rent or buy, ask your representative to inspect the unit to make sure that it is decent, safe, and sanitary. If the housing unit is not decent, safe, and sanitary, you will not receive a replacement housing payment. What If I Encounter A Problem In Obtaining Housing Of My Choice? If you encounter a problem in buying or renting housing of your choice, notify the Agency's representative immediately. The Agency's representative will look into the matter and try to resolve it. You will receive this help whether you were referred to the housing unit or found it yourself. What Other Services Will I Receive? In addition to help in obtaining a comparable replacement home, other assistance, as necessary, will be provided in order to minimize the impact of your move. This assistance may include referral to appropriate public and private agencies that provide services concerning housing financing, employment, health, welfare, or legal assistance. The range of services depends on the needs of the person being displaced. You should ask the Agency's representative to tell you about the specific services that will be available to help you and your family. What Is a Payment For Actual Reasonable Moving and Related Expenses? You may choose to receive a relocation payment to cover the reasonable cost of your move. If you choose a Payment For Actual Reasonable Moving And Related Expenses, you may include in your claim the reasonable and necessary costs for: • Transportation for you and your family. • Packing, moving and unpacking your household goods. • Disconnecting and reconnecting household appliances and other personal property (e.g., telephone and cable TV). • Storage of household goods, as may be necessary. • Insurance for the replacement value of your property during the move and necessary storage (if necessary). The Agency's representative will explain all eligible moving costs, as well as those which are not eligible. You must be able to account for any costs that you incur, so keep all your receipts. Select your mover with care. The Agency's representative can help you select a reliable and reputable mover. You may elect to pay your moving costs yourself and be repaid by the Agency or, if you prefer, you may have the Agency pay the mover. In either case, let the Agency's representative know before you move. How Much Rental Assistance Will I Receive? You may be eligible to receive Rental Assistance for a 42-month period. The assistance is computed in the following manner: c Prepared by California Property Specialists, Inc. 28 { i The assistance needed for one month is determined by subtracting the "base monthly rent" for your present home from the cost of rent and utilities for your new home (or a comparable replacement home, if that cost is lower). That monthly need, if any, is multiplied by 42, to determine the total amount that you will receive. This amount will be paid directly to you. The Agency must provide the assistance in monthly installments or other periodic payments. Generally, the base monthly rent for your present home is the lesser of: (1)the monthly rent and average monthly cost for utilities, or (2)thirty (30) percent of your average monthly gross household income, if you are low-income based on HUD income limits. To qualify for rental assistance, you must rent and occupy a decent, safe, and sanitary home within one year after the date you move. However, the Agency will extend this period for good cause. If I Decide to Buy, Rather Than Rent, How Much Assistance Will I Receive? If you buy a replacement home, you may be eligible for assistance to make a down payment equal to the amount you would receive if you rented a comparable replacement home. A down payment assistance payment will be paid in a lump sum. Must I File A Claim To Obtain A Relocation Payment? Yes. You must file a claim for each relocation payment. The Agency will, however, provide you with the required claim form, help you to complete it, and explain the type of documentation, if any, that you must submit in order to receive the payment. If you must pay any relocation expenses before you move (e.g., a security deposit when you sign a lease for your new home), discuss your financial needs with the Agency's representative. While refundable deposits are not covered, you may be able to obtain an advance payment to meet these costs. An advance payment may be placed in "escrow" or paid directly to a contractor to ensure that the move will be completed on a timely basis. You must file your claim within 18 months after the date you move. However, it is to your advantage to file as soon as possible after you move. The sooner you submit your claim, the sooner it can be processed and paid. If you are unable to file your claim within 18 months, ask the Agency to extend this period. Be careful not to confuse this 18-month period with the 12-month period within which you must rent(or buy)and occupy a replacement dwelling in order to be eligible for a replacement housing payment. You will be paid promptly after you file an acceptable claim. If there is any question regarding your right to a relocation payment or the amount of the payment, you will be notified, in writing, of the problem and the action you may take to resolve the matter. Will I Have To Pay Rent To The Agency Before I Move? If the Agency acquires the property in which you live, you may be required to pay a fair rent to the Agency for the period between the acquisition of the property and the date that you move. Such rent will not exceed the market rent for comparable properties in the area. Do I Have To Pay Federal Income Taxes On My Relocation Payments? No. Section 216 of the URA states that you need not report relocation payments as part of your gross income for Federal tax purposes. For information on State or local income taxes, you should check with the State or local income tax office in your area or with your personal tax advisor. What If I Don't Receive The Required Assistance. Can I Appeal? If you disagree with the Agencys decision as to your right to relocation assistance or the amount of a payment, or the adequacy of the housing to which you have been referred, you may appeal the decision to the Agency. The Agency's representative will inform you of its appeal procedures. At a minimum, you will have 60 days to file your appeal with the Agency after you receive written notification of the Agency's determination on your claim. Your appeal must be in writing. INTRODUCTION Section 33413.5 of the California Relocation Law (Health & Safety Code, Section 33000 et. seq.), requires the Agency to adopt a Replacement Housing Plan (Plan) whenever the Agency executes an agreement for the acquisition of real property, or an agreement for the disposition and development of property, that would lead to the demolition or removal of dwelling units from the low and moderate income housing market. The Plan should identify the impacts that the Project will have on the community's supply of low and moderate- income housing, and detail the measures that the Agency will take to ensure that the appropriate amount and type of replacement housing is replaced within the specified four (4) year time period. Replacement housing units may be either for rent or sale to persons and families of low or moderate income, provided an equal number of replacement dwelling units are offered at affordable prices within the redevelopment project areas or within the territorial jurisdiction of the Agency. California Relocation Law also provides that if insufficient housing units are available for use by households of low and moderate income displaced by a redevelopment project, the agency may direct, or cause the development, rehabilitation or construction of housing units within the community, both inside and outside of redevelopment project areas. Additionally, one hundred percent (100%) of replacement dwelling units are required to be affordable, available to, and occupied by persons in the same, or lower income category (i.e., Very Low, Lower and Moderate) as the persons displaced from the units that were destroyed or otherwise removed. II . UNITS REMOVED FROM AFFORDABLE HOUSING POOL The proposed project, in its present configuration, will result in the destruction and removal of sixty eight (68) residential rental dwelling units from the City's overall housing inventory. Thirty eight (38) units are vacant. Twenty seven (27) of the remaining thirty (30) occupied units responded to the relocation survey. Table 5 details the respondent tenant occupied dwellings, with the corresponding bedroom count, that may be destroyed and removed from the City's inventory of affordable housing. It also details the "100% requirement" for the replacement housing units by bedroom count and income level, relative to the prospective displacee households. This may be accomplished through either new construction or rehabilitation of existing structures. A further requirement provides that the replacement units subsequently developed must be in "standard" condition and designed to remain affordable to Very Low, Lower and Moderate income households for fixed time periods. Specifically, Assembly Bill No. 637, made effective January 1, 2002, established those time limits at forty-five (45) years for ownership units and, fifty-five (55) years for rental units. III . COMPLIANCE WITH STATE LAW Section 33413(a) of the California Health and Safety Code states: "Whenever dwelling units housing persons and families of low or moderate income are destroyed or removed from the low and moderate income housing market as part of a redevelopment project which is subject to a written agreement with the Agency or where financial assistance has been provided by the Agency, the Agency shall, within four years of the destruction or removal, rehabilitate, develop or construct, or cause to be rehabilitated, developed or constructed, for rental or sale to persons and families of low or moderate income, an equal number of replacement dwelling units that have an equal or greater number of bedrooms as those destroyed or removed units at affordable housing costs within the territorial jurisdiction of the Agency. When dwelling units are destroyed or removed after September 1, 1989, 75 percent of the replacement dwelling units shall replace dwelling units available at affordable housing cost in the same income level of very low income households, lower income households, and persons and families of low and moderate income, as the persons displaced from those destroyed or removed units." Section 33143(c) of the California Health and Safety Code also states: Prepared by California Property Specialists, Inc. 4 "The Agency shall require the aggregate number of replacement dwelling units and the dwelling units rehabilitated, developed or constructed pursuant to subdivision (a) or (b) remain available at affordable housing cost to persons and families of low income, moderate income, and very low income households, respectively, for the longest feasible time, as determined by the Agency, but for not less than the period of the land use controls established in the Redevelopment Plan, except to the extent a longer period of time may be required by other provisions of law. If land on which those dwelling units are located is deleted from the project area, the Agency shall continue to require that those units remain affordable as specified in the previous sentence. These requirements shall be made enforceable in the same manner as provided in subdivision (e) or Section 33334.3." The following terms shall have the same meaning in this Replacement Housing Plan as in California Health and Safety Code Section 33411 .2: "affordable housing cost," "persons and families of low and moderate income," and `very low income households." IV. MEANS OF FINANCING The Agency has the capacity and is authorized to finance projects developed under the Redevelopment Plan with the assistance of the United States government as a part of the Community Development Program through the U.S. Department of Housing and Urban Development ("HUD") and with financial assistance from the State of California, the City, Agency or any other available source. Funding of housing development may include, but is not limited to, Community Development Block Grant ("CDBG") funds, other federal grant and loan funds, tax increment and proceeds of tax allocation bond sales, FHA insured loans, Section 202/Section 8 elderly housing assistance, Section 17 housing grants, HUD Rental Rehabilitation Program, California Rental Housing Construction Program, California SB 99 housing revenue bonds, land sales proceeds, and pre-construction developer advances. GENERAL AND SPECIFIC LOCATION OF REPLACEMENT HOUSING All of the Replacement Dwelling Units as defined in California Health and Safety Code Section 33411.2, to be developed or caused to be developed by the Agency because of the proposed Project shall be located within the territorial jurisdiction of the Agency. The Agency has and will continue to rehabilitate, develop or construct for rent, or sale to persons and families of Very Low, Lower and/or Moderate income, dwelling units/bedrooms in conjunction with the development of projects located in the Redevelopment Project Area's Median income. In addition, the proposed number of up to (two hundred twenty (220)) affordable housing units being created by the Agency will be more than adequate to off-set the displacements caused by the proposed Redevelopment Project. The Agency intends to develop these affordable units through its annual notice of funding available mechanism and will seek to fund large-scale projects 40 or more units needing substantial rehabilitation. MONITORING AND REPORTING Pursuant to California Health and Safety Code Section 33418, the Agency shall monitor, on an ongoing basis, any housing affordable to persons and families of low or moderate income developed or otherwise made available pursuant to this Replacement Housing Plan. The Agency shall require owners or managers of housing to submit an annual report to the Agency. For rental housing, the annual report to the Agency must set forth the rental rate, income, and family size of the occupants of each unit (with the income information certified by each occupant). For owner-occupied housing, the owner's annual report to the Agency must disclose whether there was an ownership change during the year and, if so, the income and family size of the new owner. The Agency may impose fees on the owners of the monitored property to defray the cost of this monitoring system. The information obtained from this monitoring system shall be included in any reports that are required by law to be submitted to the California State Department of Housing and Community Development or to the State Controller.
