Description: Finance: Council Notes: Agenda Item No.: o0 1 CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: On-Call Civil Engineering Design and Project Management Services for the Capital Improvement Program (CIP). Background: In an effort to reduce project backlog, ensure that the City meets expenditure timeframes for certain funding sources, and to position Development Services for delivering anticipated stimulus program projects, staff released a Request for Proposals (RFP) for On-Call Civil Engineering Design and Project Management Services for the Capital Improvement Program. It should be noted that Development Services does not have the staff and/or expertise in the CIP design section and that is why the use of on-call consultants was contemplated. Copies of the RFP were sent to a total of twenty firms that appeared qualified to provide the services. The selection process consisted of the evaluation by City staff of proposals and interviews with all fourteen firms that submitted proposals. The method of evaluation of proposals, interviews and ratings was consistent with the rating system approved by the Mayor and Common Council on September 2, 2003 for non-federal aid projects. Experience, cost, understanding of the project and local preference were factors considered in the evaluation. From that process, staff determined that there were six engineering firms that met the City's needs and had the capabilities to design and manage various CIP projects. Staff submitted a request to execute Agreements for Services with six engineering consulting firms for on-call engineering design and project management services for various CIP projects. The six firms include: 1. AECOM of Ontario. 2. AEI-CASC Consulting of Colton. 3. David Evans and Associates, Inc. of Ontario. 4. Lim& Nascimento Engineering Corporation of San Bernardino. 5. Transtech Engineers, Inc./MAPCO of San Bernardino. 6. Willdan of San Bernardino. At the August 3, 2009 Mayor and Common Council meeting, the City Attorney's Office raised concerns with the legality of the requested action and the item was referred to the Legislative Review Committee. At the Legislative Review Committee meeting on August 18, 2009, the City Attorney stated that Section 3.04.085(B) of the Municipal Code requires: "Contractual services with a value in excess of twenty-five thousand dollars must be approved by the Mayor and Common Council pursuant to Requests for Proposals as authorized by the Mayor and Common Council." 2 i As a result, the City Attorney stated that an amendment to the Municipal Code would be required in order for staff to proceed. It was not the intent of Public Works staff to circumvent the Municipal Code nor to modify it, and staff decided not to proceed as initially requested. It was determined that the six firms were pre-qualified based on the selection process that had been completed. Staff will return to the Mayor and Common Council with individual Agreements for Services on a project-by-project basis, using the six pre-qualified firms. Financial Impact: N/A Recommendation: Staff recommends that the Mayor and Common Council receive and file this report. 3
